प्राजधकरण, मजणपुर के अध्यक्ष और सदस्ट्य रािपत्र में इस अजधसूचिा के प्रकािि की तारीख से तीि वषा की

अवजध के जलए पद धारण करेंगे।

प्राजधकरण, मजणपुर उि अजधसूचिा में यर्ा जवजिर्दाष्ट ऐसी िजियों का प्रयोग और प्रदियाओं का पालि करेगा।

प्राजधकरण, मजणपुर पैरा 5 के अधीि मजणपुर राज्य के जलए गठित राज्य स्ट्तरीय जविेषज्ञ अंकि सजमजत (एस ई ए

सी) की जसफ़ाठरिों पर अपिा जिणाय लेगा।

प्राजधकरण, मजणपुर की सहायता के प्रयोिि के जलए केंद्रीय सरकार, मजणपुर की राज्य सरकार के परामिा से,

राज्य स्ट्तरीय जविेषज्ञ अंकि सजमजत (एसईएसी) (जिसे इसमें इसके पश्चात एसईएसी, मजणपुर कहा गया है) का गिि

करती है जिसमें जिम्नजलजखत सदस्ट्य होंगे, अर्ाात: -

एसईएसी, मजणपुर उि अजधसूचिा में यर्ा जवजिर्दाष्ट ऐसी िजियों का प्रयोग और प्रदियाओं का पालि करेगी।

एसईएसी, मजणपुर सामूजहक उत्तरदाजयत्व के जसद्ांत पर काया करेगी और अध्यक्ष प्रत्येक मामले में सवासम् मजत पर

पहुंचिे का प्रयास करेंगे और यदद सवासम् मजत पर िह पहुंचा िा सकता तो बहुमत का मत अजभभावी होगा।

जहतों के दकसी द्वन्‍द द से बचिे के जलए :

(क)

प्राजधकरण, मजणपुर और एसईएसी, मजणपुर के अध्यक्ष और सदस्ट्य यह घोजषत करेंगे दक वे दकस

परामिी संगिि और दकस पठरयोििा प्रस्ट्तावक के सार् िुड़े हुए हैं।

(ख)

प्राजधकरण, मजणपुर और एसईएसी, मजणपुर के अध्यक्ष और सदस्ट्य अपिे कायाकाल के दौराि ऐसी

दकसी भी पठरयोििा के जलए पयाावरण समाघात मूल्यांकि (ईआईए), पयाावरण प्रबंधि योििा तैयार

करिे में ि तो कोई परामिा देंगें, ि ही उससे िुड़ेंगे, जिसका मूल् यांकि प्राजधकरण, मजणपुर और

एसईएसी, मजणपुर द्वारा दकया िािा है; और

(ग)

यदद गत पााँच वषों में प्राजधकरण, मजणपुर और एसईएसी, मजणपुर के अध्यक्ष या दकसी सदस्ट्य िे दकसी

पठरयोििा प्रस्ट्तावक के जलए कोई परामिी सेवा प्रदाि की हैं या ईआईए अध्ययिों का संचालि दकया

हैं, ऐसी जस्ट्र्जत में, वे ऐसे प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत की िािे वाली दकसी पठरयोििा के अंकि की

प्रदिया में प्राजधकरण, मजणपुर और एसईएसी, मजणपुर की बैिकों में स्ट्वयं सजम्मजलत होिे से बचेंगे।

मजणपुर सरकार, प्राजधकरण, मजणपुर और एसईएसी, मजणपुर के जलए सजचवालय के रूप में काया करिे के जलए

एक अजभकरण को अजधसूजचत करेगी और वह सजचवालय उिके सभी सांजवजधक कायों के संबंध में आवास, पठरवहि और

ऐसी अन्‍दय सुजवधाओं सजहत सभी जवत्तीय और संभार तंत्र सहायता प्रदाि करेगा।

11.

प्राजधकरण, मजणपुर और एसईएसी, मजणपुर के अध्यक्ष और सदस्ट्यों को बैिक फीस, यात्रा भत्ता और महंगाई भत्ता

मजणपुर राज्य सरकार के जियमों के अिुसार ददया िाएगा।

NOTIFICATION

New Delhi, the 12th July, 2021.

S.O. 2781(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the

Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of

India in the erstwhile Ministry of Environment and Forests, number S.O.1533(E), dated the 14^th September,

2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State

Level Environment Impact Assessment Authority, Manipur (hereinafter referred to as the Authority,

Manipur) comprising of the following Members, namely: -

The Chairman and Members of the Authority, Manipur shall hold office for a term of three years

from the date of publication of this notification in the Official Gazette.

The Authority, Manipur shall exercise such powers and follow such procedures as specified in the

said notification.

The Authority, Manipur shall take its decision on the recommendations of the State Level Expert

Appraisal Committee (SEAC) constituted under paragraph 5 for the State of Manipur.

For the purpose of assisting the Authority, Manipur, the Central Government in consultation with the

State Government of Manipur, hereby constitutes the State Level Expert Appraisal Committee (SEAC)

(hereinafter referred to as SEAC, Manipur) comprising of the following Members, namely: -

The Chairman and Members of SEAC, Manipur shall hold office for a term of three years from the

date of publication of this notification in the Official Gazette.

The SEAC, Manipur shall exercise such powers and follow such procedures as specified in the said

notification.

The SEAC, Manipur shall function on the principle of collective responsibility and the Chairman

shall endeavor to reach consensus in each case, and if consensus cannot be reached, the view of the majority

shall prevail.

In order to avoid any conflict of interest, -

(a)

the Chairman and Members of the Authority, Manipur and SEAC, Manipur shall declare as

to which consulting organisation they have been associated with and also the project

proponents;

(b)

the Chairman and Members of the Authority, Manipur and SEAC, Manipur shall not

undertake any consultation or associate with preparation of Environmental Impact

Assessment (EIA) Environment Management Plan for a project, which is to be appraised

by the Authority, Manipur and SEAC, Manipur during their tenure; and

(c)

if in the past five years, the Chairman or any of the Members of the Authority, Manipur and

SEAC, Manipur have provided consultancy services or conducted EIA studies for any

project proponent, in that event they shall recuse themselves from the meeting of the

Authority, Manipur and SEAC, Manipur in the process of appraisal of any project being

proposed by such proponents.

The Government of Manipur shall notify an agency to act as Secretariat for the Authority, Manipur

and SEAC, Manipur and the Secretariat shall provide all financial and logistic support including

accommodation, transportation and such other facilities in respect of all their statutory functions.

11.

The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the

Authority, Manipur and SEAC, Manipur shall be paid as per the rules of the State Government of Manipur.
