सा.का.जन. 488(अ).—केंद्रीय सरकार, जिद्युत अजधजनयम, 2003 (2003 का 36) की धारा 89 के खंड (2) और

खंड (3) द्वारा प्रित्त िजियों का प्रयोग करते हुए संघ राज्य क्षेत्रों के जलए, दिल्ली को छोड़कर, संयुि जिद्युत जिजनयामक

आयोग (अध्यक्ष और सिस्ट्य के िेतन, भत्ते और सेिाओं की अन्य ितें) जनयम, 2007 में संिोधन करने के जलए जनम् नजलजखत

जनयम बनाती है; अर्ाात्:—

1. (1) इन जनयमों का संजक्षप्त नाम संघ राज्य क्षेत्रों के जलए, दिल्ली को छोड़कर, संयुि जिद्युत जिजनयामक आयोग

(अध्यक्ष और सिस्ट्यों के िेतन, भत्ते और सेिाओं की अन्य ितें) संिोधन जनयम, 2021 है।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रिृत्त होंगे।

संघ राज्य क्षेत्रों के जलए, दिल्ली को छोड़कर, संयुि जिद्युत जिजनयामक आयोग (अध्यक्ष और सिस्ट्य के िेतन, भत्ते

और सेिाओं की अन्य ितें) जनयम, 2007 में, (क) जनयम 1 के उप जनयम (1) में, "संयुि जिद्युत जिजनयामक आयोग के

जलए" िब्िों के पश्चात् "गोिा राज्य और" िब्ि अंतःस्ट्र्ाजपत दकए िाएंगे; (ख) जनयम 4 के स्ट्र्ान पर, जनम्नजलजखत जनयम

रखा िाएगा, अर्ाात्:—

"4. िेतन- संयुि आयोग के अध्यक्ष और सिस्ट्य, भारत सरकार के सजचि को अनुमेय िेतन प्राप्त करने के हकिार

होंगे।

परंतु यदि सिस्ट्य सेिाजनिृत्त भारत सरकार का अपर सजचि या उसके समतुल्य या उससे नीचे की कोई

रैंक का है, िह अपर सजचि को अनुमेय या समान रैंक के अजधकारी को सेिाजनिृजत्त पर िेतन, िो भी कम हो, का

हकिार होगा;

परंतु यह और भी दक यदि अध्यक्ष या सिस्ट्य के रूप में जनयुि व्यजि जनम्न स्रोतों से पेंिन प्राप्त करता

हो—

(क)

संघ सरकार जिसमें रेलिे, रक्षा, डाक और िूरसंचार सजम्मजलत हैं; या

(ख)

राज्य सरकारों और संघ राज्य क्षेत्र प्रिासनों; या

(ग)

पजब्लक सेक्टर के उपक्रमों, स्ट्र्ानीय जनकायों, स्ट्िायत्त जनकायों िैसे जिश्वजिद्यालयों या अधा सरकारी

संगठनों िैसे पत्तन न्यास;

तो ऐसे व्यजि को िेतन में से उसके द्वारा प्राप्त की िाने िाली पेंिन की कुल रकम को घटा दिया िाएगाः

परंतु यह भी दक अध्यक्ष या सिस्ट्य िेतन के ऐसे जनयतन के पूिा मूल िेतन पर भत्ते पाने के हकिार होंगे।"

और सेिाओं की अन्य ितें) जनयम, 2007 तारीख 19 माचा, 2007 की अजधसूचना संख्या सा.का.जन. 211 (अ) द्वारा भारत

के रािपत्र, भाग-II, खंड 3, उप-खंड (i) में प्रकाजित दकए गए र्े।

NOTIFICATION

New Delhi, the 13th July, 2021

G.S.R. 488(E).—In exercise of the powers conferred by clauses (2) and (3) of section 89 of the Electricity

Act 2003 (36 of 2003), the Central Government hereby makes the following rules to amend the Joint Electricity

Regulatory Commission for Union Territories except Delhi (Salary, Allowances and other Conditions of Service of

Chairperson and Member) Rules, 2007, namely:-

1.

(1) These rules may be called the Joint Electricity Regulatory Commission for Union Territories except Delhi

(Salary, Allowances and other Conditions of Service of Chairperson and Members) Amendment Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

In the Joint Electricity Regulatory Commission for Union Territories except Delhi (Salary, Allowances and

other Conditions of Service of Chairperson and Member) Rules, 2007, (a) in rule 1, in sub-rule (1), after the words

“Joint electricity Regulatory Commission for”, the words “the State of Goa and” shall be inserted; (b) for rule 4, the

following rule shall be substituted, namely:-

“4 Pay.- The Chairperson and the Members of the Joint Commission shall be entitled to receive pay, as

admissible to Secretary to the Government of India.

Provided that if the Member is a retired Additional Secretary to the Government of India or

equivalent or of any rank below, he shall be entitled to receive the pay as admissible to an Additional Secretary

or the pay that an officer of the same rank as his at retirement would draw, whichever is lower:

Provided further that in case a person appointed as the Chairperson or Member is in receipt of

pension from-

(a) Union Government including Railways, Defence, Posts and Telecommunication; or

(b) State Governments and Union territory Administrations; or

(c) Public sector undertakings, local bodies, autonomous bodies like Universities or semi-Government

organisations like Port Trusts;

the pay of such person shall be reduced by the gross amount of pension drawn by him:

Provided also that the Chairperson or Member shall be entitled to receive allowances on the original basic

pay before such fixation of pay”.
