सा.का.जन. 492(ऄ).—केन्द रीय मयार यान जनयम, 1989 का और संियधन करने के जलए प्रारूप कजतपय जनयम,
मयार यान ऄजधजनयम, 1988 (1988 का 59) की धारा 212 की ईपधारा (1) के ऄधीन यथा ऄपेजित, भारत सरकार के
सड़क पररवहन और राजमागग मंत्रालय की ऄजधसूचना द्वारा भारत के राजपत्र, ऄसाधारण, भाग II, खंी 3, ईपखंी (i) में
ऄजधसूचना सं. सा.का.जन. 734(ऄ), तारीख 25 नवम्बर, 2020 द्वारा प्रकाजित दकए गए थे, जजसमें ईन सभी व् यज तयस से,
जजनके ईनसे प्रभाजवत हयने की संभावना है, ईस तारीख से, जजसकय ई त ऄजधसूचना में ऄंत्व् ा राजपत्र की प्रजतयां
जनता कय ईपलब् ध करा दी गइ थं, तीस ददन की ऄवजध की समाज त के पूवग अिेप और सुझाव अमंजत्रत दकए गए थे ;
और, ई त राजपत्र की प्रजतयां जजसमें ई त ऄजधसूचना प्रकाजित की गइ थी, जनता कय 25 नवम्बर, 2020 कय
ईपलब् ध करा दी गइ थी ;
और, ई त प्रारूप जनयमस के संबंध में प्रा त अिेपस और सुझावस पर द्वारा जवचार कर जलया गया है ;
ऄत:, ऄब, केन्द रीय सरकार, मयार यान ऄजधजनयम, 1988 (1988 का 59) की धारा 110 के साथ परित
धारा 64 द्वारा प्रदत् त िज तयस का प्रययग करते ए,ए, जनम् नजलजखत जनयम बनाती है, ऄथागत् :-
1. संजि त नाम और प्रारंभ:- (1) आन जनयमस का संजि त नाम केन्द रीय मयार यान (पंरहवॉ संियधन) जनयम, 2021 है ।
(2) आन जनयमस में ऄन्दयथा ईपबंजधत के जसवाय, ये राजपत्र में ईनके प्रकािन की तारीख कय प्रवृत्त हसगे ।
2. केंरीय मयारयान जनयम, 1989 (जजसे आसमें आसके पश्चात् ईक्त जनयम कहा गया है) के जनयम 81 की, सारणी में, क्रम
संखयांक 15 और ईससे संबंजधत प्रजवजियस के पश्चात् जनम्नजलजखत ऄंतःस्ट्थाजपत दकया जाएगा, ऄथागत् :-

3. ईक्त जनयमस में, ऄध्याय 3 के पश्चात्, जनम्नजलजखत ऄध्याय ऄंतःस्ट्थाजपत दकया जाएगा, ऄथागत् :-
“ऄध्याय 3क
ववाेज मयारयानस के रजजस्ट्रीकरण के जलए जविेष ईपबंध
81क. ववाेज मयारयान के रूप में रजजस्ट्रीकरण प्रमाणपत्र के जलए अवेदन और जारी करने की प्रदक्रया.- (1) दकसी ववाेज
मयारयान के जलए रजजस्ट्रीकरण या पुनः रजजस्ट्रीकरण के जलए अवेदन प्ररूप 20 के ऄनुसार दकया जाएगा और
रजजस्ट्रीकरण के जलए प्रत्येक अवेदन के साथ जनम्नजलजखत संलग्न दकया जाएगा,-
(i) बीमा पॉजलसी;
(ii) जनयम 81 में यथा जवजनर्ददि समुजचत फीस;
(iii) अयाजतत ववाेज मयारयानस की दिा में प्रवेि पत्र;
(iv) भारत में पहले से रजजस्ट्रीकृत यान की दिा में पुराना रजजस्ट्रीकरण प्रमाणपत्र ।
स्ट्पिीकरण.- आस जनयम के प्रययजन के जलए, “ववाेज मयार यान” से एल1 और एल2 प्रवगों (दुपजहया) और एम1 प्रवगग
(चार पजहया) के जलए आस अदेि में यथा पररभाजषत ववाेज यान प्रवगों के ऄधीन वगीकृत कयइ यान ऄजभप्रेत है जय प्रथम
जवक्रय के पश्चात्, प्रथम रजजस्ट्रीकरण की तारीख से पचास वषग से ऄजधक पुराना है और जजसके ऄंतगगत भारत में अयाजतत
कयइ यान, आस ितग के ऄधीन रहते ए,ए दक ऐसा यान ईसके मूल रूप में रखा जाना और ईसमें कयइ सारवान पररवतगन नहं
दकया जाना चाजहए, जजसमें चेसेस या बॉीी िेल या आंजन में कयइ ईपांतरण भी सम्मजलत है, भी है ।
(2) राज्य रजजस्ट्रीकरण प्राजधकारी, ईसके द्वारा रजजस्ट्रीकृत ववाेज मयार यान के स्ट्वामी कय ऐसे अवेदन की प्राजि से साि
ददन की ऄवजध के भीतर प्ररूप 23क के ऄनुसार रजजस्ट्रीकरण प्रमाणपत्र जारी करेगा और ऐसे प्रमाणपत्र की जवजिजियस
तथा ईसके पररवतगनस कय राष्ट्रीय रजजस्ट्ार में भी दजग करेगा :
परंतु दकसी मयारयान के पुराने रजजस्ट्रीकरण प्रमाणपत्र, यदद कयइ है, कय ववाेज मयार यान के रूप में रजजस्ट्रीकृत
करने के पश्चात् रद्द कर ददया जाएगा और ऐसे रद्द ए,ए रजजस्ट्रीकरण प्रमाणपत्र कय ईसका स्ट्वामी केवल ऐजतहाजसक
प्रययजनस के जलए प्रजतधाररत कर सकेगा ।
(3) रजजस्ट्रीकरण करने वाला प्राजधकारी पूवगवती रजजस्ट्रीकरण के पूणग ररकॉीग बनाए रखेगा और स्ट्वाजमत्व ररकॉीग तथा
सभी ऐसे ररकॉीग पयागल पर ऄद्यतन दकए जाएंगे ।
(4) यदद दकसी ववाेज मयार यान के रजजस्ट्रीकरण के पश्चात्, दकसी समय कयइ अवेदन,
(i) रजजस्ट्रीकरण प्रमाणपत्र की दूसरी प्रजतजलजप जारी करने:
(ii) मयारयान के स्ट्वाजमत्व का ऄंतरण करने; या
(iii) पता पररवतगन करने,
के संबंध में, रजजस्ट्रीकरण करने वाले प्राजधकारी कय ददया जाएगा तय ऐसा अवेदन मयारयान ऄजधजनयम 1988 के ऄधीन
ईपबंजधत रीजत में ददया जाएगा और ऐसी फीस जय केंरीय मयारयान जनयम, 1989 के ऄधीन जवजहत है, संलग्न की जाएगी ।
81ख. ववाेज मयार यानस पर रजजस्ट्रीकरण जचन्दह प्रद्ित करने का प्ररूप और रीजत.- (1) रजजस्ट्रीकरण करने वाला
प्राजधकारी, ऐसे यानस के नए रजजस्ट्रीकरण के जलए, ऄजधजनयम की धारा 41 के ऄधीन, ववाेज मयार यान कय ईसपर
प्रदिगन के जलए , “XX VA YY ****”से जमलकर बने रजजस्ट्रीकरण जचह्न, जहां VA से ववाेज, XX से राज्य कयी, YY से
दय ऄिर की श्ृंखला और “****” संखयांक 0001 से 9999 हैं जय राज्य रजजस्ट्रीकरण प्राजधकरण द्वारा अबंरात दकए जाते हैं,
समनुदेजित करेगा ।

(2) दकसी ववाेज मयार यान कय समनुदेजित रजजस्ट्रीकरण जचन्दह, यान के अगे और पीछे रजजस्ट्रीकरण लेा से संबंजधत
अकार और जवजिजियस के ऄनुसार स्ट्पि और पिनीय प्ररूप में प्रद्ित दकया जाएगा और यह आन जनयमस के जनयम 50 और
जनयम 51 में बताइ गइ जवजिजियस के ऄनुरूप हयगा ।
(3) वे सभी यान जय ववाेज मयार यान के रूप में पहले से रजजस्ट्रीकृत हैं, मूल रजजस्ट्रीकरण संखयांक और जबना दकसी
पररवतगन के रजजस्ट्रीकरण लेा प्रजतधारण करते रहेंगे ।
(4) सभी ऐसे ववाेज मयार यानस कय जनयम 50 के ऄधीन अज्ञाजपत ईच्च सुरिा रजजस्ट्रीकरण लेा के ईपबंधस से छूा हयगी ।
81ग. रजजस्ट्रीकरण प्रमाणपत्र की जवजधमान्दयता.- रजजस्ट्रीकरण प्रमाणपत्र दस वषग की ऄवजध के जलए जवजधमान्दय हयगा और
ईसके पश्चात पश्चात्वती पांच वषों के जलए नवीकरणीय हयगा ।
81घ. क्रय और जवक्रय.- (1) ववाेज मयार यान के रूप में रजजस्ट्रीकृत यानस का क्रय और जवक्रय ऄनुज्ञेय है परंतु क्रेता और
जवक्रेता संबंजधत राज्य पररवहन प्राजधकरण कय सूजचत करें और नए स्ट्वामी के नाम में रजजस्ट्रीकरण ऄजभलेखस में दजग दकया
जाए और क्रेता तथा जवक्रेता दयनस की यह संयुक्त जजम्मेदारी हयगी दक वे आस संबंध में क्रय और जवक्रय के नब्बे ददनस की
ऄवजध के भीतर प्राजधकरण कय जानकारी देंगे ।
81ङ. प्रययग पर जनबंधन.- जनयजमत प्रययजनस के जलए सड़कस पर ववाेज मयार यान चलाए या ईपययग में नहं लाए जाएंगे
और दकन्दहं भी वाजणजज्यक प्रययजनस के जलए प्रययग नहं दकए जाएंगे ।”।
(4) ईक्त जनयमस में, जनयम 92 में, ईपजनयम (2) में, खंी (ग) के स्ट्थान पर जनम्नजलजखत खंी रखा जाएगा, ऄथागत् :-
“(ग) जय ववाेज मयार यान के रूप में रजजस्ट्रीकृत है ।”।

NOTIFICATION
New Delhi, the 15th July, 2021
G.S.R. 492(E).—Whereas, the draft of certain rules further to amend the Motor Vehicles Rules,
1989 was published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59
of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways, in
the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 734 (E), dated
the 25th November, 2020, inviting objections and suggestions from all persons likely to be affected thereby,
before the expiry of thirty days from the date on which copies of the Gazette of India in which the said
notification was published, were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the
25th November, 2020;
And whereas, the objections and suggestions received in respect of the said draft rules within the
period so specified have been taken into consideration;
Now, therefore, in exercise of the powers conferred by section 64 read with section 110 of the Motor
Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules, namely: -
1. Short title and commencement. - (1) These rules may be called as the Central Motor Vehicles
(Fifteenth Amendment) Rules, 2021.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their final
publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules), in rule 81, in the
table, after serial no. 15 and the entries relating thereto, the following shall be inserted, namely:-

3. In the said rules, after Chapter III, the following Chapter shall be inserted, namely:-
―CHAPTER IIIA
SPECIAL PROVISION FOR REGISTRATION OF VINTAGE MOTOR VEHICLES
81A. Procedure of application and issuance of Certificate of Registration as a Vintage Motor
Vehicle.– (1) An application for registration or re-registration of a vintage vehicle shall be made as per
Form 20 and every application for registration shall be accompanied by,-
(i) a policy of insurance;
(ii) appropriate fee as specified in rule 81;
(iii) Bill of Entry in the case of imported vintage motor vehicles;and
(iv) old Registration Certificate in case of already registered vehicle in India.
Explanation.- For the purpose of thisrule, ―Vintage Motor Vehicle‖ means any vehicle classified
under vintage vehicle category as defined in this order for L1 and L2 categories (two-wheeler) and
M1 category (four-wheeler), which is more than fifty years old from the date of first registration
after first sale including any vehicle imported into India subject to the condition that such vehicle
should be maintained in its original form and should not have undergone any substantial overhaul,
which includes any modification in chassis or body shell or engine.
(2) The State Registering Authority shall issue to the owner of a Vintage Motor Vehicle registered
by it, a certificate of registration, as per Form 23A within a period of sixty days from the receipt of
such an application and shall also enter in the National register, the particulars of such certificate
and changes thereof:
Provided that the old certificate of registration of a motor vehicle after being registered as
Vintage Motor Vehicle, if any, shall be cancelled and the owner may retain such cancelled
certificate of registration for historical purposes only.
(3) The Registering Authority shall maintain a complete record of previous registration
and ownership record and all such records shall be updated on the portal.
(4) If, at any time after the registration of a Vintage Motor Vehicle, an application shall be made to
the registering authority regarding, -
(i) issuance of a duplicate certificate of registration:
(ii)transfer of ownership of the motor vehicle; or
(iii) change of address,
such application shall be made in the manner provided under the Motor Vehicles Act, 1988 and be
accompanied by such fees as prescribed under theCentral Motor Vehicles Rules, 1989.
81B. Form and manner of display of registration marks on Vintage Motor Vehicles. - (1) For fresh
registration of such vehicles, under section 41 of theAct, the Registering Authority shall assign to a
Vintage Motor Vehicle for display thereon, a registration mark consisting of the letters ―XX VA YY ****‖,
where VA stands for Vintage, XX stands for State code, YY will be a two letter series and ―****‖ is a
number from 0001 to 9999 allotted by State Registering Authority.

(2) The registration mark assigned to a Vintage Motor Vehicle shall be exhibited both at the front and at the
rear of the vehicle clearly and legibly in the form of a license plate in the size and specifications related to
registration plate and it shall conform to the specifications spelt out in rules 50 and 51 of these rules.
(3) All those vehicles which are already registered as Vintage Motor Vehicle shall continue to retain the
original registration number and registration plate intact without any change.
(4) All such Vintage Motor Vehicles shall be exempted from the provisions of High Security Registration
Plate as mandated under rule 50.
81C. Validity of the certificate of registration.– The certificate of registration shall be valid for a
period of ten years and shall be renewable for subsequent five years thereafter.
81D. Sale and Purchase.– (1) Sale and purchase of vehicles registered as the Vintage Motor Vehicle is
permissible provided the buyer and seller inform respective State Transport Authority and registration
under the new owner’s name to be recorded and it shall bethe joint responsibility of both buyer and seller
that information in this regard shall be submitted to the authority within ninety days of sale and purchase.
81E. Restriction on uses. – Vintage Motor Vehicles shall not be driven or plied on the roads for regular
purposes and shall not be used for any commercial purposes whatsoever.‖.
4. In the said rules, in rule 92, in sub-rule (2), for clause (c), the following clause shall be substituted,
namely: -
―(c) which is registered as Vintage Motor Vehicle:‖.
