सा.का.जन. 333(अ).—िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 5 सपठित धारा 9क की उप-धारा

(1) तथा उप-धारा (2) के खंड (ण) तथा (द) के अंतगगत प्रदत् त िजियों का प्रयोग करते हुए, केन्‍द रीय सरकार एतद्दिारा

नागर जिमानन मंत्रालय (जिमान प्रचालनों की सुरक्षा के जलए ऊंचाई प्रजतबंध) जनयमािली, 2015 में आगे संिोधन के

जलए, कजतपय जनयमों का ड्राफ्ट, िैसा दक उि अजधजनयम की धारा 14 में अपेजक्षत है, इससे प्रभाजित होने िाले सभी

व्यजियों की सूचना के जलए एतद्द्वारा प्रकाजित करती है; तथा एतद्दिारा सूचना दी िाती है दक उि ड्राफ्ट जनयमों पर, उस

जतजथ से, जिस जतजथ को उस सरकारी रािपत्र की प्रजतयां जिसमें यह अजधसूचना प्रकाजित है, िनता को उपलब्ध करा दी

िाती हैं, से तीस ददन की अिजध के उपरांत जिचार दकया िाएगा;

कजथत ड्राफ्ट जनयमों के संबंध में, उपरोिानुसार जिजनर्ददष्ट समयािजध के भीतर दकसी व्यजि से प्राप्त होने िाली

दकन्‍दहीं आपजियों तथा सुझािों पर मंत्रालय द्वारा जिचार दकया िाएगा।

तकनीकी प्रामाजणकता द्वारा यथासमर्थथत आपजियां या सुझाि, यदद कोई हों, तो उन्‍दहें उप सजचि भारत सरकार,

प्रारूप जनयम

1.

संजक्षप्त नाम और प्रारंभ:- (1) इन जनयमों को नागर जिमानन मंत्रालय (जिमान प्रचालनों की सुरक्षा के जलए ऊंचाई

प्रजतबंध) जनयमािली, 2022 कहा िाएगा।

(2) ये रािपत्र में इनके प्रकािन की तारीख को प्रिृत् त होंगे।

नागर जिमानन मंत्रालय (जिमान प्रचालनों की सुरक्षा के जलए ऊंचाई प्रजतबंध) जनयमािली, 2015 में, अनुसूची-II

में, पैराग्राफ 1, उप-पैराग्राफ 1.3 में, खंड 1.3.1.4 में, जनम्नजलजखत जनयम को अन्‍दतीःस्ट्थाजपत दकया िाएगा, नामतीः-

“बिते, यदद थ्रेिोल्ड को स्ट्थायी रूप से, िैसा दक संबंजधत हिाईअड्डा प्रचालक द्वारा घोजित दकया गया हो तथा नागर

जिमानन महाजनदेिक द्वारा अनुमोददत दकया गया हो, जिस्ट्थाजपत दकया गया हो तो, जिस्ट्थाजपत थ्रेिोल्ड को अप्रोच

जनधागरण के जलए, एक संदभग बबदु के तौर पर जलया िाएगा”

2016 की अजधसूचना सं. सा.का.जन. 610 (अ) के माध्यम से संिोजधत तथा अंजतम बार ददनांक 17 ददसंबर, 2020

की अजधसूचना सं. के सा.का.जन. 770 (अ) के माध्यम से संिोजधत दकया गया था।

NOTIFICATION

New Delhi, the 2nd May, 2022

G.S.R. 333(E).—The following draft of certain rules to further amend the Ministry of Civil

Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Rules, 2015, which the Central

government hereby proposes to make, in exercise of the powers conferred by sub-section (1) and clause (o)

and clause (r) of sub-section (2) of section 5 read with section 9A of the Aircraft Act, 1934 (22 of 1934), is

hereby published as required by section 14 of the said Act, for the information of all persons likely to be

affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after

the expiry of a period of thirty days from the date on which the copies of the Official Gazette in which this

notification is published are made available to the public;

Any objections and suggestions, which may be received from any person with respect to the said

draft rules within the period specified above, shall be considered by this Ministry.

Objections or suggestions, if any, duly supported with technical justification, may be addressed to

the Deputy Secretary to the Government of India, ‗B‘ Block, Rajiv Gandhi Bhawan, New Delhi – 110003;

Draft Rules

1. Short title and commencement:- (1) These rules shall be called the Ministry of Civil Aviation

(Height Restrictions for Safeguarding of Aircraft Operations) Amendment Rules, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations)

Rules, 2015, in Schedule-II, in paragraph 1, in sub-paragraph 1.3, in clause 1.3.1.4, the following

proviso shall be inserted namely:-

―Provided that, in case the threshold has been displaced permanently, as declared by the concerned airport

operator and approved by the Director General of Civil Aviation, the displaced threshold shall be taken as

reference point for determining the approach.‖.
