का. आ. 2204(अ).—सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) (उक्त अजधजनयम) की धारा 17

की उप-धारा (1) सहायताप्राप्त िननीय प्रोद्योजगकी और सरोगेसी बोडड के गठन का उपबंध करती है;

और उक्त अजधजनयम के उपबंध 25 िनवरी, 2022 को प्रवृत्त हुए;

और उक्त अजधजनयम की धारा 17 की उप-धारा (2) का खंड (ग) जनम्नजलजखत उपबंध करने के जलये है , अर्ाडत:-

“(ग) तीन मजहला संसि सिस्ट्य, जिनमें से िो का जनवाडचन लोक सभा द्वारा और एक का जनवाडचन राज्य सभा

द्वारा, सिस्ट्य, पिेन";

सहायताप्राप्त िननीय प्रोद्योजगकी (जवजनयमन) अजधजनयम, 2021 (2021 का 42) की धारा 3 उपबंध करती है

दक सेरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) के उपबंधों के अधीन गरठत दकया िाने वाला राष्ट्रीय

सहायताप्रास िननीय प्रोद्योजगकी और सरोगेसी बोडड सहायताप्राप्त िननीय प्रौद्योजगकी (जवजनयमन) अजधजनयम, 2021

(2021 का 42) के प्रयोिनों जलए राष्ट्रीय बोडड होगा;

और सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) की धारा 17 की उप-धारा (2) के उक्त खंड (ग) में

"पिेन” पि का प्रयोग संसि सिस्ट्यों के संबंध में राष्ट्रीय सहायताप्राप्त िननीय प्रोद्योजगकी और सरोगेसी बोडड की सिस्ट्यता

धारण करने हेतु समुजचत नहीं हो सकेगा, क्योंदक संसि सिस्ट्यों को दकसी भी हैजसयत से अजधकारी नहीं माना िाता है;

अब इसजलए, केंद्रीय सरकार सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) की धारा 54 की उपधारा (1) द्वारा

प्रित्त िजक्तयों का प्रयोग करते हुए उक्त करठनाइयों को िूर करने के जलए जनम्नजलजखत आिेि बनाती है, अर्ाडत्:-

1. (1) इस आिेि का संजिप्त नाम सरोगेसी (जवजनयमन) करठनाइयों को िूर करने का आिेि, 2022 है।

(2) यह रािपत्र में इसके प्रकािन की तारीख को प्रवृत्त होगा।

2. सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) की धारा 17 की उप-धारा (2) के खंड (ग) में, "पिेन" िब्ि

का लोप दकया िाएगा।

NOTIFICATION

New Delhi, the 12th May, 2022

S.O. 2204(E).—WHEREAS, sub-section (1) of section 17 of the Surrogacy (Regulation) Act, 2021

(47 of 2021) (the said Act) provides for the constitution of the National Assisted Reproductive Technology

and Surrogacy Board;

AND WHEREAS, the provisions of the said Act came into force on the 25th day of January, 2022;

AND WHEREAS, clause (c) of sub-section (2) of section 17 of the said Act provides for the

following, namely:--

“(c) three women Members of Parliament, of whom two shall be elected by the House of the

People and one by the Council of States, Members, ex officio;”;

AND WHEREAS, section 3 of the Assisted Reproductive Technology (Regulation) Act, 2021 (42

of 2021) provides that the National Assisted Reproductive Technology and Surrogacy Board to be

constituted under the provisions of the Surrogacy (Regulation) Act, 2021 (47 of 2021) shall be the National

Board for the purposes of the Assisted Reproductive Technology (Regulation) Act, 2021 (42 of 2021);

AND WHEREAS, usage of the expression “ex officio” in the said clause (c) of sub-section (2) of

section 17 of the Surrogacy (Regulation) Act, 2021 (47 of 2021) in respect of Members of Parliament for

holding membership of the National Assisted Reproductive Technology and Surrogacy Board may not be

appropriate, as Members of Parliament are not regarded as officers in any capacity;

Now THEREFORE, in exercise of the powers conferred by subsection(1) of section 54 of the

Surrogacy (Regulation) Act, 2021 (47 of 2021), the central Government herby makes the following order to

remove the said difficulty, namely:-

1. (1) This order may be called the Surrogacy (Regulation) Removal of Difficulties Order, 2022.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In clause (c) of sub-section (2) of section 17 of the Surrogacy (Regulation) Act, 2021 (47 of

2021), the word, “ex officio” shall be omitted.
