का. अ. 2219(ऄ).—भारत सरकार ने पेरोजलयम और खजनज पाआपलाआन (भूजम में ईपयोग के ऄजधकार का
ऄजजन) ऄजधजनयम, 1962 (1962 का 50) (जजसे आसमें आसके पश्चात ईक्त ऄजधजनयम कहा गया है) की धारा 3 की ईपधारा
(1) के ऄधीन जारी भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का.अ. 2423(ऄ)
क्रमिः ददनांक 08.07.2019 तथा ऄजतररक्त भूखंडों/ऄजतररक्त क्षेत्र के जलए का.अ. 4374(ऄ) क्रमिः ददनांक
21.10.2021 ईस ऄजधसूचना से संलग्न ऄनुसूची में जिजनर्ददष्ट भूजम में गेल (आजण्डया) जलजमटेड द्वारा पजश्चम बंगाल राज्य में
जगदीिपुर-हजल्दया-बोकारो- धामरा पाआपलाआन (जे एच बी डी पी एल) और स्ट्पर पाआपलाआन के माध्यम से प्राकृजतक
गैस के पररिहन के जलए पाआप लाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार का ऄजजन करने के ऄपने अिय की
घोषणा की थी;
और ईक्त राजपजत्रत ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी गइ थी;
और, सक्षम प्राजधकार ने, ईक्त ऄजधजनयम की धारा 6 की ईप-धारा (1) के ऄधीन भारत सरकार को ऄपनी ररपोटज
दे दी है;
और भारत सरकार ने, ईक्त ररपोटज पर जिचार करने के पश्चात और यह संतुष्ट हो जाने पर दक ईक्त भूजम
पाआपलाआनें जबछाने के जलए ऄपेजक्षत है, ईस में ईपयोग के ऄजधकार का ऄजजन करने का जिजनश्चय दकया है;

ऄतः ऄब, भारत सरकार, ईक्त ऄजधजनयम की धारा 6 की ईप-धारा (1) द्वारा प्रदत्त्त िजक्तयों का प्रयोग करते हुये,
यह घोषणा करती है दक आस ऄजधसूचना से संलग्न ऄनुसूची में जिजनर्ददष्ट भूजम में पाआपलाआनें जबछाने के जलए ईपयोग के
ऄजधकार का ऄजजन दकया जाता है;
और भारत सरकार, ईक्त ऄजधजनयम दक धारा 6 दक ईप-धारा (4) द्वारा प्रदत िजक्तयों का प्रयोग करते हुये, जनदेि
देती है दक पाआपलाआनें जबछाने के जलए भूजम में ईपयोग का ऄजधकार, आस घोषणा के प्रकािन की तारीख को, भारत
सरकार में जनजहत होने के बजाए, पाआपलाआनें जबछाने का प्रस्ट्ताि करने िाली गेल (आजण्डया) जलजमटेड में जनजहत होगा और
तदुपरर, भूजम में ऐसे ईपयोग का ऄजधकार, आस प्रकार ऄजधरोजपत जनबंधनों और ितों के ऄधीन रहते हुये, सभी जिल्लंगमों
से मुक्त, गेल (आजण्डया) जलजमटेड में जनजहत होगा।

NOTIFICATION
New Delhi, the 12th May, 2022
S.O. 2219(E).— Whereas by the notification of Government of India in Ministry of Petroleum and
Natural Gas published vide S.O No: 2423(E) Dated 08.07.2019 for Additional Plots/Additional Area
published vide S.O No: 4374(E) Dated 21.10.2021 issued under sub- section (1) of section 3 of the
Petroleum and Minerals Pipeline ( Acquisition of Right of Users in Land ) Act, 1962 (50 of 1962)
(hereinafter referred to as the said Act), Government of India declared its intention to acquire the Right of
User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline
for transportation of natural gas through Jagdishpur – Haldia – Bokaro – Dhamra Pipeline (JHBDPL) &
Spur Pipeline in the State of West Bengal by GAIL (India) Limited;

And whereas copies of the said Gazette notification were made available to the public;
And, whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act,
submitted his report to Government of India;
And whereas Government of India after considering the said report and on being satisfied that the
said land is required for laying the pipelines, has decided to acquire the Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,
Government of India hereby declares that the Right of User in the land specified in the Schedule appended
to this notification is hereby acquired for laying the pipeline;
And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act,
Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead
of vesting in Government of India, vest, on this date of the publication of the declaration, in the GAIL
(India) Limited, free from all encumbrances.
