सा.का.जन. 879(अ).—केन्द रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए प्रारूप जनयम मोटर यान
अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथापेजित भारत सरकार के सड़क पररवहन और
रािमागग मंत्रालय की अजधसूचना संख् या सा.का.जन. 762(अ), तारीख 04 अक् टूबर, 2022 द्वारा तारीख 04 अक् टूबर, 2022 को भारत
के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में प्रकाजित दकए गए थे, जिसमें उन सभी व् यजक् तयों से जिनका उससे प्रभाजवत
होना संभाव् य है, उस तारीख से, जिसको प्रारूप जनयमों में अंतर्वगष् ट रािपत्र की प्रजतयां िनता को उपलब् ध करा िी गई थी, तीस दिनों
की अवजध के अवसान से पूवग आिेप और सुझाव आमंजत्रत दकए गए थे ;
और उक् त रािपत्र अजधसूचना की प्रजतयां 06 अक् टूबर, 2022 को िनता को उपलब् ध करा िी गई थी;
और उक् त प्रारूप जनयमों के संबंध में िनता से प्राप् त आिेपों और सुझावों पर केन्द रीय सरकार द्वारा सम् यक् रूप से जवचार कर
जलया गया है ;
अत:, अब केन्द रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 64 के खंड (क), खंड (घ) और खंड (त)
द्वारा प्रित् त िजक् तयों का प्रयोग करते हुए, केन्द रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती
है, अथागत् :-
1. संजिप् त नाम और प्रारंभ.- (1) इन जनयमों का संजिप् त नाम केन्द रीय मोटर यान (तेईसवााँ संिोधन) जनयम, 2022 है ।
(2) ये रािपत्र में तारीख उनके प्रकािन की तारीख को प्रवृत् त होंगे ।

2. केन्द रीय मोटर यान जनयम, 1989 (जिसे इसमें इसके पश् चात् उक् त जनयम कहा गया है), के जनयम 47 के उपजनयम (1) की मि (गख)
में “अजधकाररक पहचान पत्र” िब् िों के पश् चात् “या सेवा प्रमाणपत्र” िब् ि अंत:स्ट् थाजपत दकए िाएंगे ।
(3) उक् त जनयम के 48 के उपजनयम (1) में, परन्द तुक के स्ट् थान पर जनम् नजलजखत परन्द तुक रखा िाएगा, अथागत् :-
“परन्द तु ऐसे बी एच श्रृखंला के अन्द तगगत यान के रजिस्ट् रीकरण के जलए आवेिन, जिसका यान के स्ट् वामी द्वारा स्ट् वेच् छा से जवकल् प
जलया गया है, ऐसे राज् य के दकसी रजिस्ट् रीकरण प्राजधकरण को दकया िाएगा जिसमें यान के स्ट् वामी का या तो स्ट् थायी जनवास है या कायग
का स्ट् थान है और रजिस्ट् रीकरण जचन्द ह, रजिस्ट् रीकरण प्राजधकरण द्वारा, यथाजस्ट् थजत, प्ररूप 60 में कायगकरण प्रमाणपत्र या िासकीय
पहचान पत्र/सेवा प्रमाणपत्र के सत् यापन के पश् चात् पोटगल के माध् यम से यािृजच् छक रूप से सृजित दकया िाएगा ।”।
4. उक् त जनयम के जनयम 51ख में,--
(क) उपजनयम (3), के परन्द तुक के पश् चात्, जनम् नजलजखत परन्द तुक रखे िाएंगे, अथागत्:--
“परन्द तु यह और दक बी एच श्रृखंला में दकसी रजिस्ट् रीकृत यान को दकसी ऐसे व् यजक् त के नाम में अन्द तररत दकया िाता है, िो जनयम
47 के उपजनयम (1) के खंड (गक) या खंड (खग) के अनुसार बी एच श्रृखंला के जलए पात्र नहीं है तब ऐसा यान संबंजधत राज् य या संघ
राज् य िेत्र में जवद्यमान जनयजमत रजिस्ट् रीकरण श्रृखंला से नए रजिस्ट् रीकरण जचन्द ह के समनुिेिन के जलए िायी होगा और ऐसा यान
संबंजधत राज् य या संघ राज् य िेत्र के कराधान जनयमों के अनुसार मोटर यान कर के जलए िायी होगा :
परन्द तु यह भी दक यदि बी एच श्रृखंला में रजिस्ट् रीकृत कोई यान दकसी ऐसे व् यजक् त के नाम में अंतररत दकया िाता है िो बी एच
श्रृखंला के जलए पात्र है, तब ऐसा यान िब तक अन्द तररती बी एच श्रृखंला के जलए पात्र रहता है, तब तक बी एच श्रृखंला के अधीन
जवजधमान्द य रूप से रजिस्ट् रीकृत बना रहेगा:
परन्द तु यह भी दक बी एच श्रृखंला में रजिस्ट् रीकृत यान का स्ट् वामी दकसी समय जनयम 47 के उपजनयम (1) के खंड (गक) या खंड
(गख) के अनुसार, बी एच श्रृखंला के जलए पात्र नहीं रह िाता है तब ऐसा यान ऐसी िेष अवजध, जिसके जलए कर का संिाय कर दिया
है, के जलए बी एच श्रृखंला के अधीन रजिस्ट् रीकृत बना रहेगा ।”।
(ख) उपधारा (3) के पश् चात् जनम् नजलजखत उपजनयम अन्द त:स्ट् थाजपत दकए िाएंगे, अथागत् :-
“(4) यदि दकसी समय, दकसी भी राज् य या संघ राज् य िेत्र की जनयजमत श्रृखंला में रजिस्ट् रीकृत दकसी यान का स्ट् वामी जनयम 47 के
उपजनयम (1) के खंड (गक) या खंड (गख) के अनुसार बी एच श्रृखंला के जलए पात्र हो िाता है, तब ऐसे यान का स्ट् वामी, ऐसे राज् य या
संघ राज् य िेत्र जिसमें ऐसा यान वतगमान में रजिस्ट् रीकृत दकया गया है या रखा गया है, के दकसी ऐसे रजिस्ट् रीकरण प्राजधकरण को बी
एच श्रृखंला में रजिस्ट् रीकरण जचन्द ह के समनुिेिन के जलए प्ररूप 27क में आवेिन करेगा ।
(5) बी एच श्रृखंला में रजिस्ट् रीकरण जचन्द ह के समनुिेिन पर, उपजनयम (4) में जनर्िगष् ट यान का स्ट् वामी उपजनयम (3) के अनुसार का
संिाय करने का िायी होगी ।”।
5. उक् त जनयम में, प्ररूप 27 के पश् चात्, जनम् नजलजखत प्ररूप अन्द त:स्ट् थाजपत दकया िाएगा, अथागत् :-

NOTIFICATION
New Delhi, the 14th December, 2022
G.S.R. 879(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were
published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide
notification of the Government of India in the Ministry of Road Transport and Highways, number G.S.R. 762 (E),
dated the 4th October, 2022 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) dated the 4th
October, 2022 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of
the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were
made available to the public;
And whereas, copies of the said notification were made available to the public on the 6th October, 2022;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have
been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clause (a), (d) and (p) of section 64 of the Motor
Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the
Central Motor Vehicles Rules, 1989, namely:-
1. (1) These rules may be called as the Central Motor Vehicles (Twenty-third Amendment) Rules, 2022.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 47, in sub-rule (1), in
item (cb), after the words “Official Identity Card”, the words “ or Service Certificate” shall be inserted.
3. In rule 48 of the said rules, in sub-rule (1), for the proviso, the following proviso shall be substituted, namely: -
“Provided that application for registration of vehicle under BH series, opted voluntarily by the vehicle owner, shall be
made to any registering authority of the state, in which the vehicle owner has either permanent residence or place of
work and the registration mark shall be generated randomly through the portal after verification of working certificate
in Form 60 or Official identity card / Service Certificate, as the case may be, by the registering authority.”.
4. In rule 51B of the said rules, -
(a) in sub-rule (3), after the proviso, the following provisos shall be inserted, namely: -
“Provided further that if a vehicle registered in BH-series, is transferred in the name of such person who is
not eligible for BH-series, as per clause (ca) or (cb) of sub-rule (1) of rule 47, then, such vehicle shall be liable for
assignment of new registration mark from regular registration series prevailing in the concerned State or Union
Territory and such vehicle shall also be liable for motor vehicle tax as per the taxation rules of concerned State or
Union Territory:
Provided also that if a vehicle registered in BH-series, is transferred in the name of such person who is
eligible for BH-series, then such vehicle shall continue to be validly registered under BH-series so long as transferee
remains eligible for BH-series:

Provided also that if at any time owner of the vehicle registered in BH-series, ceases to be eligible for BH-
series, as per clauses (ca) or (cb) of sub-rule (1) of rule 47, then such vehicle shall continue to be registered under BH-
series for the remaining period for which tax has been paid.”.
(b) after sub-rule (3), the following sub-rules shall be inserted, namely:-
“(4) if at any time, owner of a vehicle registered in regular series of any State or Union Territory becomes eligible for
BH-series as per clause (ca) or (cb) of sub-rule (1) of rule 47 and owner of such vehicle opts for registration mark in
BH-series for such vehicle, then owner of such vehicle shall apply in Form 27A for assignment of registration mark in
BH-series to any registering authority of the State or Union Territory in which such vehicle is currently registered or
placed.
(5) On assignment of registration mark in BH-series, the owner of the vehicle referred to in sub-rule (4) shall be liable
to pay tax as per sub-rule (3).”.
5. In the said rules, after Form 27, the following Form shall be inserted, namely:-
