सा.का.जन. 885(अ).— मोटरयान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन

यथा अपेजित केन्‍द रीय मोटरयान जनयम, 1989 का और संिोधन करने के जलए जनयमों का प्रारूप भारत के रािपत्र,

असाधारण, भाग II, खंड 3, उपखंड (i) में भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं.

सा.का.जन. 683 (अ), तारीख 06 जसतंबर, 2022 द्वारा उन सभी व् यज‍ तयों से जिनकी उससे प्रभाजवत होने की संभावना ह ,

ऐसी तारीख से जिसकों उ‍ त अजधसूचना से यक‍ त रािपत्र की प्रजतयां िनसाधारण को उपल्‍ ध करवाई गई थं, तीस दिवस

की अवजध की समाज‍ त से पूवग, आिेप और सकझाव आमंजत्रत करते हुए प्रकाजित दकए गए थे ;

और, उ‍ त रािपत्र अजधसूचना की प्रजतयां जिसमें उ‍ त अजधसूचना प्रकाजित की गई थी, िनसाधारण को 06

जसतंबर, 2022 को उपल्‍ ध करवाई गई थं ;

और, उ‍ त प्राुपप जनयमों के संबंध में िनसाधारण से कोई आिेप और सकझाव प्रा‍ त नहं हुए हैं ;

अत:, अब केन्‍द रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 109 और धारा 110 द्वारा प्रित् त

िज‍ तयों का प्रयोग करते हुए ह , केन्‍द रीय मोटर जनयम, 1989 का और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती

हैं, अथागत् :--

1 (1) इस जनयमों का संजि‍ त नाम केन्‍द रीय मोटर जनयम (चौबीसवााँ संिोधन) जनयम, 2022 ह ।

(2) ये उनके रािपत्र में प्रकािन की तारीख को प्रवृत होंगे ।

(1) 7% तक बायो डीिल जमिणों से चलने वाले यानों या इंिनों का संिभग डीिल (बी7) के साथ परीिण दकया िाएगा

और 7% से ऊपर बायों डीिल जमिणों वाले यानों का संबंजधत जमिणों के साथ परीिण दकया िाएगा।

(2) िोहरी ईंधन इंिन के जलए परीिण लागू होने की अपेिाएं जवश्व हामोनाइज्ड िजणक चक्र (ड्‍ लयूएचटीसी) परीिण-

चक्र के गमग भाग पर मापे गए ग स ऊिाग अनकपात (िीईआर) पर जनभगर करती हैं। िीईआर वगीकरण, एआईएस: 137 के

अनकसार और समय-समय पर यथा संिोजधत होगा ।

(3) संिभग ईंधन 'बीएस-VI पॉजिरटव इजििन इंिन के जलए हाइड्रोिन' ह ि सा उपाबंध IV-ब में जनर्िगष्ट ह ।

(4) संिभग ईंधन 'बीएस-VI पॉजिरटव इजििन इंिन के जलए हाइड्रोिन' ह ि सा उपाबंध IV-यघ में जनर्िगष्ट ह ।.

(5) िब यान हाइड्रोिन पर चल रहा हो तो केवल एनओए‍ स उत्सिगन अवधाररत दकया िाएगा";

रट‍ पण.-

(1) परीिण इंिन डायनेमोमीटर पर दकया िाएगा ।

(2) कम्प्रेिन इजििन इंिन से ल स यानों के मामले में, समय-समय पर यथा संिोजधत एआईएस:137 में वर्णगत प्रदक्रया के

अनकसार ड्‍ ल् यूएचएससी और ड्‍ ल् यूएचटीसी चक्रों के अनकसार ग सीय और कण उत्सिगन को मापा िाएगा ।

(3) सकारात्मक इजििन इंिन से ल स वाहनों के मामले में, समय-समय पर यथा संिोजधत एआईएस:137 में वर्णगत

प्रदक्रया के अनकसार ड्‍ ल् यूएचटीसी चक्रों के अनकसार ग सीय और कण उत्सिगन को मापा िाएगा ।

(4) संिभग ईंधन के जलए जवजनिेि नीचे दिए गए हैं :-

(क) प्राकृजतक ग स या ि व-मीथेन मोनो-ईंधन या जद्व-ईंधन वाहनों में प्रयक्त

संिभग प्राकृजतक ग स ईंधन उपाबंध IV-ठ

(िी20, िी23 और िी25) के अनकसार होगा।

(ख) एलपीिी मोनो-ईंधन या जद्व-ईंधन वाहनों में प्रयक्त

संिभग एलपीिी ईंधन, उपाबंध IV-ड़ (ईंधन ए और ईंधन बी)

के अनकसार होगा। यद्यजप, सीएनिी/एलपीिी के जलए संिभग ईंधन की अनकपल्‍धता के मामले में, समय-समय पर

संिोजधत बीआईएस 15958:2012 के अनकसार व्यावसाजयक रूप से उपल्‍ध सीएनिी और समय-समय पर

संिोजधत बीआईएस 14861:2000 के अनकसार एलपीिी का उपयोग टाइप अनकमोिन के उद्देश्य के जलए दकया

िाएगा और उत्पािन की अनकरूपता

(ग) संिभग इथेनॉल ईंधन (ईडी95) उपाबंध IV-ि में यथा जवजनर्िगष्ट होगा।

(घ) संिभग ग सोलीन ईंधन (ई5) या ई(10) (जनमागता द्वारा यथा जवजनर्िगष्ट) क्रमिः उपाबंध IV-भ या उपाबंध IV-भक

में यथा जवजनर्िगष्ट होगा।

(ङ) संिभग डीिल ईंधन (बी7) उपाबंध IV-ि में यथा जवजनर्िगष्ट होगा।

(च) संिभग ईंधन बायोग स (बायो-मीथेन) आईएस 16087:2013 के अनकसार और समय-समय पर यथा संिोजधत

होगा।

(छ) संिभग ईंधन हाइड्रोिन समृद्ध संपीजड़त प्राकृजतक ग स (एचसीएनिी) आईएस 17314: 2019 के अनकसार और

समय-समय पर यथा संिोजधत होगा।

(ि) बीएस-VI हाइड्रोिन ईंधन वाहनों का उक्त जनयमों के उपाबंध IV-ब में जनर्िगष्ट संिभग ईंधन के साथ परीिण

दकया िाएगा।

(झ) बीएस-IV हाइड्रोिन ईंधन वाहनों का उक्त जनयमों के उपाबंध IV-यघ में जनर्िगष्ट संिभग ईंधन के साथ परीिण

दकया िाएगा।

(5) उत्पािन की अनकरूपता (सीओपी) परीिण प्रदक्रया समय-समय पर संिोजधत एआईएस: 137 में यथा वर्णगत होगी।

(6) उत्पािन की अनकरूपता (सीओपी), आवृजि और नमूने जनम्नानकसार होंगे: -

(i) प्रत्येक इंिन मॉडल के जलए उसके वेररएंट सजहत उत्पािन अवजध की अनकरूपता वषग में एक बार होगी।

(ii) िहां छह महीने में उत्पािन की मात्रा इसके संस्ट्करण सजहत प्रजत मॉडल 250 से कम ह , जनयम 126-क के परंतकों में

अंतर्वगष् ट उपबंध लागू होंगे।

(7) वाजणजज्यक ईंधन के जलए जवजनिेि जनम्नानकसार होंगे:-

(i) वाजणजज्यक ग सोलीन ईंधन उपाबंध IV-प के अनकसार और समय-समय पर संिोजधत होगा।

(ii) वाजणजज्यक सीएनिी और वाजणजज्यक एलपीिी के जलए जवजनिेि क्रमिः बीआईएस 15958:2012 और बीआईएस

14861:2000 के अनकसार होंगे और समय-समय पर संिोजधत होंगे।

(iii) वाजणजज्यक डीिल में इस्ट्तेमाल होने वाला बायोडीिल समय-समय पर संिोजधत आईएस 15607 के अनकसार होगा।

(iv) 7% तक ि व डीिल जमिण वाले वाजणजज्यक डीिल ईंधन के जलए जवजनिेि उपाबंध IV-फ और समय-समय पर यथा

संिोजधत के अनकसार होंगे।

(v) वाजणजज्यक ई85 और ईडी95 के जलए जवजनिेि समय-समय पर संिोजधत भारतीय मानकों के अनकसार यथा जवजनर्िगष्ट

होंगे।

(vi) वाजणजज्यक बायोग स (बायो-मीथेन) के जलए जवजनिेि आईएस 16087:2013 और समय-समय पर यथा संिोजधत के

अनकसार होगी।

(vii) वाजणजज्यक हाइड्रोिन समृद्ध संपीजड़त प्राकृजतक ग स (एचसीएनिी) के जलए जवजनिेि आईएस 17314:2019 और

समय-समय पर यथा संिोजधत के अनकसार होंगे।

(8) सीआई इंिन वाहनों के जलए, िृश्य प्रिूषकों (धकआं) का उत्सिगन, जनयम 115 के उप-जनयम (9) के उपाबंध I के अनकसार

धकएं के घनत्व के सीमा मूल्य से अजधक नहं होगा। ये धकएं की सीमा सकधार कारक और इंिन के जबना हैं जिन्‍द हे 0.98 से 1.02

के वायकमंडलीय कारक को बनाए रखने के जलए इंिन को आपूर्तग की गई वातानकूजलत हवा के साथ परीिण दकया िाना ह ।

(9) इंिन िजक्त को इंिन डायनेमोमीटर पर मापा िाएगा और मापी गई िजक्त समय-समय पर संिोजधत एआईएस:137 में

जवजहत प्रदक्रयाओं के अनकसार जवजनर्िगष्ट और परीिण की गई िजक्त के अनकरूप होगी।

(10) जनजष्क्रय उत्सिगन और धकआाँ घनत्व जनम्नानकसार होगा: -

(i) इस उप-जनयम में जवजनर्िगष्ट पीआई इंिन से ल स यान जनयम 115 के उप-जनयम (2) के खंड (i) के उपबंधों का पालन

करेंगे।

(ii) इस उप-जनयम में जवजनर्िगष्ट सीआई इंिन से ल स यान जनयम 115 के उप-जनयम (2) के खंड (ii) के उपबंधों का पालन

करेंगे।

(11) ह्रास कारक.-

(i) ह्रास के कारक नीचे िी गई सारणी में दिए गए हैं: -

जगरावट कारक परीिण का मूल्यांकन, जनयम 126 में जवजनर्िगष्ट अनकमोदित परीिण एिेंसी द्वारा दकया िाएगा ।

(12) (क) टाइप अनकमोिन के िौरान और 1 अप्र ल, 2020 से सीओपी लागू होने पर, आंकड़े एकजत्रत करने के जलए सड़क

पर पीईएमएस का प्रयोग करते हुए यानों पर उत् सिगन माप जलया िाएगा और 1 अप्र ल, 2023 से सेवा में अनकुपपता कारक

लागू होगा । जवस्ट् तृत प्रदक्रया एआईएस:137, तथा समय-समय पर यथा संिोजधत, में अजधकजथत ह ।

(ख) पीईएमएस प्रििगन परीिण के जलए उपयोग दकया गया यान इंिन प्रणाली की स्ट् थापना के जलए आिजयत यान िेणी

का प्रजतजनजधत् व करेगा । यान एक प्रोटोटाइप यान या एक ुपपांतररत उत् पािन यान हो सकता ह ।

(ग) टाइप अनकमोिन पर पीईएमएस प्रििगन परीिण के जलए, यान को 1 अप्र ल, 2023 सेवा-में अनकपालन की अपेिाओं

को पूरा करना पड़ेगा ।

(13) इस उपखंड में जवजनर्िगष् ट यानों को एआईएस:137 और समय-समय पर यथा संिोजधत जनधागररत प्रदक्रया के अनकसार

ग सीय और कण जनकास उत् सिगनों के जलए जनम् न वल् डग नॉट-टू-एज‍ सड (ड्‍ ल् यूएनटीई) ऑफ-साइकल प्रयोगिाला परीिण

सीमा को पूरा करना होगा :

(14) इस उप-खंड में जवजनर्िगष्ट यान िो 1 अप्र ल, 2023 को या उसके पश् चात् जवजनर्मगत यान के पास एआईएस:137 और

समय-समय पर यथा संिोजधत में जनधागररत प्रदक्रया के अनकसार ऑन-बोडग जनिान के इन-यूि प्रििगन के मूल् यांकन की िमता

होगी ।

(15) इस उपखंड में इंिन दफट दकए हुए ऐसे यान िो उत् सिगन में कमी लाने के जलए एक ररिेंट का प्रयोग करते हैं, को

एआईएस:137 और समय-समय यपर यथा संिोजधत अजधकजथत प्रदक्रया के अनकसार एनओए‍ स जनयंत्रण उपायों के सही

संचालन को सकजनजश् चत करना होगा ।

(16) इस उपखंड में जवजनर्िगष् ट यान उत् सिगन जनयंत्रण हेतक एक ऑन-बोडग जनिान प्रणाली (बीएस VI-ओबीडी 1 और

बीएस VI ओबीडी 2) से यक‍ त होंगे जिसमें एआईएस:137 में वर्णगत प्रदक्रया के अनकसार कं‍ यूटर मेमोरी में संग्रहीत फॉल् ट

कोड के िररए खराबी के संभाजवत िेत्रों की पहचान करने की िमता होगी िब ऐसी जवफलता के पररणामस्ट् वुपप जनम् न

सारणी में िी गई सीमा से अजधक उत् सिगन होंगे :-

(क) 1 अप्र ल, 2020 को या उसके पश्चात जवजनर्मगत यानों के जलए बीएस VI ओबीडी-1 सीमा रेखा नीचे दिए गए अनकसार

होगी :-

जवजनमागता के अनकरोध पर टाइप अनकमोिन को कायागन्‍द वयन से पूवग बीएस-VI ओबीडी 2 अपेिाओं के

अनकपालन के जलए प्रिान दकया िा सकता ह :

परंतक इस उपजनयम की कोई बात िेि की रिा से संबंजधत सरकारी प्रयोिनों के जलए प्रयोग दकए िाने

वाले उस मोटर यान को लागू नहं होगी िो अजधजनयम की धारा 60 के अधीन रजिस्ट् रीकृत ह और जविेष प्रयोिन

यान (आमडग और अन्‍द य जवजिष् ट यान) िो कानून और व् यवस्ट् था बनाए रखने तथा आंतररक सकरिा के कायागत् मक

प्रयोिनों के जलए प्रयोग दकए िाते हैं ।

(17) सीएनिी या बायो-सीएनिी या एचसीएनिी यान एआईएस:024, एआईएस:028 पकनरीिण-1 यथालागू,

के अनकसार सभी सकरिा अपेिाओं को पूरा करेंगे । ”.

(18) यान का इडी 95 का ईथानॉल ग् लैंड का स्ट् तर यान जवजनमागता द्वारा पररभाजषत दकया िाएगा और उसे यान

पर स्ट् पष् टत: िृश् य स्ट् टीकर लगाकर उपिर्िगत दकया िाएगा ।”

3. उ‍ त जनयमों के जनयम 115 में, उपाबंध IV-ब में जवद्यमान िीषगक के स्ट् थान पर, जनम् नजलजखत िीषगक रखा िाएगा,

अथागत् :-

“बीएस- VI यानों के जलए संिभग हाइड्रोिन ईंधन की तकनीकी जविेषताएं”।

4. उ‍ त जनयमों के जनयम 115 में उपाबंध IV- यग के पश् चात्, जनम् नजलजखत उपाबंध अंत:स्ट् थाजपत दकया िाएगा,

NOTIFICATION

New Delhi, the 16th December, 2022

G.S.R. 885(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles

Rules, 1989, was published as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988

(59 of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways

number G.S.R. 683(E), dated the 6^th September, 2022, in the Gazette of India, Extraordinary, Part-II,

Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby

within a period of thirty days from the date on which copies of the Gazette containing the said notification

were made available to public;

And whereas, copies of the Gazette containing the said notification were made available to the public

on the 6^th September, 2022;

And whereas, no objections and suggestions were received from the public in respect of the said draft

rules;

Now, therefore, in exercise of the powers conferred by section 109 and section 110 of the Motor

Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to

amend the Central Motor Vehicles Rules, 1989, namely:-

1. (1) These rules may be called as the Central Motor Vehicles (Twenty-fourth Amendment) Rules, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), in rule 115, in sub-

rule 18, in clause (ii), for the existing Table 2, the following Table shall be substituted, namely:-

(1) The vehicles or engines fuelled with bio diesel blends up to 7% shall be tested with reference diesel

(B7) and vehicles fuelled with bio diesel blends above 7% shall be tested with respective blends.

(2) The test applicability requirements for dual fuel engine is depending on the Gas Energy Ratio (GER)

measured over the hot part of the World Harmonized Transient Cycle (WHTC) test-cycle. GER

classification shall be as per AIS: 137 and as amended from time to time.

(3) Reference Fuel is ‘Hydrogen for BS-VI Positive Ignition Engine’ as specified in Annexure IV-W.

(4) Reference Fuel is ‘Hydrogen for BS-IV Positive Ignition Engine’ as specified in Annexure IV-ZD.

(5) Only NOx emission shall be determined when the vehicle is running on Hydrogen";

Notes.-

(1) The test shall be done on engine dynamometer.

(2) In case of vehicles equipped with Compression Ignition engines, the gaseous and particulate emissions

shall be measured as per WHSC and WHTC cycles as per procedure described in AIS:137 as amended

from time to time.

(3) In case of vehicles equipped with positive Ignition engines, the gaseous and particulate emissions shall

be measured as per WHTC cycle as per procedure described in AIS:137 and as amended from time to

time.

(4) Specifications for Reference fuels are as below:-

(a) Reference natural gas fuel used in Natural Gas or Bio-Methane mono-fuel or bi-fuel vehicles shall

be as per Annexure IV-L (G20, G23 and G25)

(b) Reference LPG fuel used in LPG mono-fuel or bi-fuel vehicles shall be as per Annexure IV-M

(Fuel A and Fuel B). However, in case of non-availability of reference fuels for CNG / LPG, the

commercially available CNG as per BIS 15958:2012 and LPG as per BIS 14861:2000 as amended

from time to time shall be used for the purpose of Type Approval and Conformity of Production.

(d) The Reference Gasoline fuels (E5) or E (10) (as specified by the manufacturer) shall be as specified

in Annexure IV-X or Annexure IV-XA, respectively.

(e) The Reference Diesel fuel (B7) shall be as specified in Annexure IV–T.

(f) The reference fuel Biogas (Bio-methane) shall be as per IS 16087:2013 and as amended time to

time.

(g) The reference fuel Hydrogen Enriched Compressed Natural Gas (HCNG) shall be as per IS

17314:2019 and as amended from time to time.

(h) BS-VI Hydrogen Fuel vehicles shall be tested with reference fuel specified in the Annexure IV-W

to said rules.

(i) BS-IV Hydrogen Fuel vehicles shall be tested with reference fuel specified in the Annexure IV-ZD

to said rules.

(5) The Conformity of Production (COP) testing procedure shall be as described in AIS:137 as amended

from time to time.

(6) The Conformity of Production (COP) frequency and samples shall be as under:-

(i)

The Conformity of Production period for each engine model including its variant(s) shall

be once a year.

(ii)

Where production volume in six month is less than 250 per model including its variant, the

provisions contained in the provisos to rule 126-A shall apply.

(7) Specifications for Commercial fuels shall be as under:-

a. The Commercial Gasoline fuel shall be as per Annexure IV-U and as amended from time

to time.

b. Specification for Commercial CNG and Commercial LPG shall be in accordance with BIS

15958:2012 and as per BIS 14861:2000 respectively and as amended from time to time.

c. Biodiesel used in Commercial Diesel shall be as per IS 15607 as amended from time to

time.

d. Specification for Commercial Diesel fuel up to 7% of bio diesel blend shall be as per

Annexure IV-V and as amended from time to time.

e. Specifications for commercial E85 and ED95 shall be as specified in accordance with the

Indian Standards as amended from time to time.

f. Specification for commercial Biogas (Bio-methane) shall be as per IS 16087:2013 and as

amended time to time.

g. Specifications for commercial Hydrogen Enriched Compressed Natural Gas (HCNG) shall

be as per IS 17314:2019 and as amended from time to time

(8) For CI engine vehicles, the emission of visible pollutants (smoke) shall not exceed the limit value of

smoke density, as per Annexure I to sub-rule (9) of rule 115. These smoke limits are without correction

factor and engines are to be tested with conditioned air supplied to the engine to maintain atmospheric

factor of 0.98 to 1.02.

(9) The engine power shall be measured on engine dynamometer and the measured power shall conform to

the power specified and tested as per procedures prescribed in AIS:137 as amended time to time.

(10) Idle emissions and Smoke Density shall be as under:-

a. The vehicles equipped with PI engine specified in this sub- rule shall comply with the

provisions of clause (i) of sub-rule (2) of rule 115.

b. The Vehicles equipped with CI engine specified in this sub- rule shall comply with the

provisions of clause (ii) of sub-rule (2) of rule 115.

(11) Deterioration Factors.-

(i) Deterioration factors shall be as given in the Table below:-

(ii) Alternatively, the vehicle manufacturers may opt for evaluation of deterioration factor over

normal useful life period as per procedure described in AIS:137 and as amended time to time.

(iii) Useful life period and minimum service accumulation period for evaluation of deterioration factor

given in Table below:-

The evaluation of deterioration factor test shall be carried out by the approved test agency specified

in rule 126.

(12) (a) During type approval and COP applicable from 1^st April, 2020, emission measurement on vehicles

using PEMS shall be carried out on road for data collection and from1^st April, 2023 in-service

conformity factor shall be applicable. The detailed procedure is laid down in AIS:137 and as

amended from time to time

(b) The type approval vehicle used for the PEMS demonstration test shall be representative for the

vehicle category intended for the installation of the engine system. The vehicle may be a prototype

vehicle or an adapted production vehicle.

(13) The vehicles specified in this sub-clause shall meet the following World Not-To-Exceed (WNTE) Off-

cycle laboratory testing limits for gaseous and particulate exhaust emissions, and as per procedure laid

down in AIS:137 and as amended time to time:-

(14) The vehicles specified in this sub-clause manufactured on or after 1^st April, 2023 shall have the

capability of assessing the in-use performance of on-board diagnostic, as per procedure laid down in

AIS:137 and as amended time to time.

(15) The vehicles specified in this sub-clause fitted with engine, which rely on the use of a reagent in order

to reduce emissions, shall ensure the correct operation of NOx control measures, as per procedure laid

down in AIS:137 and as amended time to time.

(16) The vehicles specified in this sub- rule shall be equipped with an On-Board Diagnostic system (BS VI

OBD-I and BS-VI OBD-II) for emission control which shall have the capability of identifying the likely

area of the malfunctions by means of fault codes stored in computer memory and communicating that

information off-board, as per procedure described in AIS:137, when that failure results in an increase in

emission above the limits given in the following Tables below:-

At the manufacturer’s request type approval may be granted for compliance to BS-VI

OBD-II requirements before its implementation:

Provided that nothing in this sub-rule shall apply to the motor vehicle used for Government

Purposes relating to the defence of the country which is registered under section 60 of the Act and

to the special purpose vehicle (armoured and other specialised vehicle) used for operational

purposes for the maintenance of law and order and internal security.

(17) The CNG or Bio-CNG or HCNG Vehicles shall meet all the safety requirements as per

AIS:024, AIS:028 Revision 1 as applicable.

(18) The compatibility of vehicle to level of ethanol blend of ED95 shall be defined by the vehicle

manufacturer and the same shall be displayed on vehicle by putting a clearly visible sticker.”.

3. In rule 115 of the said rules, in Annexure IV-W, for the existing title, the following title shall be

substituted, namely:-

“Technical Specification of Reference Hydrogen Fuel for BS- VI vehicles”.

4. In rule 115 of the said rules, after Annexure IV- ZC, the following Annexure shall be inserted,

namely:-
