जिद्युत अजधजनयम, 2003 की धारा 63 के अंतगगत दििाजनिेिों में संिोधन

जिद्युत अजधजनयम, 2003 की धारा 63 के उपबंधों के अंतगगत दिनांक 20 अिूबर 2022 को भारत के रािपत्र
(असाधारण) (भाग 1 - खंड 1) में प्रकाजित संकल्प संख्या 23/03/2022-आरएंडआर द्वारा िजि नीजत के पैरा बी(v) के
अंतगगत जित्तपोषण, स्ट्िाजमत्ि तथा प्रचालन (एफओओ) आधार पर जिद्युत की खरीि के जलए जिद्युत अजधजनयम, 2003 की
धारा 63 के अंतगगत दििा-जनिेि अजधसूजचत दकए गए हैं।
2.0 दिनांक 20 अिूबर, 2022 के उि दििा-जनिेिों में एतिद्वारा जनम्नजलजखत संिोधन दकए िाते हैं, अथागत् : -

पैरा 7.2 कोजनम्नानुसार पढा िाए:
7.2 जनजित प्रभार:
जनजित प्रभार की िसूली, आपूर्तगकताग द्वारा रु/केडब्लल्यूएच में उद्धृत प्रभारों के अनुसार, िास्ट्तजिक उपलब्लधता पर
आधाररत होगी। 85% की मानक उपलब्लधता की प्राजि पर पूणग जनजित प्रभार िसूल दकया िाएगा। उपलब्लधता
का िार्षगक रूप से जमलान दकया िाएगा। बोलीिाता पीपीए के अंतगगत आपूर्तग आरंभ होने के बाि पहले िषग के
जलए लागू मूल जनजित प्रभार उद्धृत करेगा। मूल जनजित प्रभार पीपीए में जनधागररत कायग प धजत के अनुरूप
डब्लल्यूपीआई में उतार-चढाि के आधार पर बाि के िषों में बढाया िाएगा।

यदि, यूरिजलिी द्वारा पूणग क्षमता िेड्यूल्ड नहीं की गई हो, दफर भी संपूणग अनुबंजधत क्षमता के जलए जनजित
प्रभारों का िाजयत्ि यूरिजलिी का होगा।
2.2
पैरा 9.2 कोजनम्नानुसार पढा िाए:
"9.2 दकसी स्रोत के मूल्यांकन पर जिचार करने के जलए सूचीबध दकए गए बोलीिाताओं की सूची उस अंजतम
बोलीिाता पर जिचार करके तैयार की िाएगी, जिसकी बोली उस स्रोत के जलए एल1 बोलीिाता की बोली (कुल
उद्धृत िैररफ रु/केडबल्यूएच में)के 110% से कम या उसके बराबरहो।"

Amendments to Guidelines under Section 63 of the Electricity Act, 2003 for procurement of power on
FOO basis under para B(v) of the SHAKTI Policy
No. 23/03/2022-R&R.—
1.0
The Guidelines under Section 63 of the Electricity Act, 2003 for procurement of power on FOO
basis under para B(v) of the SHAKTI Policy have been notified under the provisions of Section 63 of the
Electricity Act, 2003 vide resolution No. 23/03/2022-R&R published in the Gazette of India
(Extraordinary) (Part I - Section 1) on 20th October, 2022.
2.0
The following amendments are hereby made in the said guidelines of 20th October, 2022 namely:-
2.1
The Para 7.2may be read as under:
“7.2 The Fixed Charge:
Fixed Charge recovery shall be based on actual availability, as per charges quoted by supplier in
Rs/kWh. Full Fixed Charge will be recovered on achievement of normative availability of 85%.
Availability shall be reconciled annually. The bidder shall quote Base Fixed Charge applicable for
first year after commencement of supply under PPA. Base Fixed Charge shall be escalated in
subsequent years based on variation in the WPI in accordance with the methodology prescribed in
the PPA.
Even if , the full capacity is not scheduled by the Utility, the liability of fixed charges for the entire
Contracted Capacity shall be that of the Utility.”
2.2
The Para 9.2may be read as under:
“9.2 The list of Shortlisted bidders for consideration of evaluation for a source shall be arrived at
by considering the last bidder whose bid is less than or equal to 110% of bid (total quoted Tariff in
Rs/kWh) of the L1 bidder for that source.”
