का.अ. 5997(ऄ).—केन्द्रीय सरकार ने पेरोजलयम और खजनज पाआपलाआंस (भूजम मे ईपयोग के ऄजधकार का

ऄजजन) ऄजधजनयम, 1962 (1962 का 50) (जजसे आसमें आसके पश्चात ईक्त ऄजधजनयम कहा गया है) की धारा 3 की

ईपधारा (1) के ऄधीन जारी की गइ भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की ऄजधसूचना संख्या

का.अ. 1056 (ऄ). तारीख 09 माचज, 2022, भारत के राजपत्र सं० 1024, तारीख 10, माचज, 2022 एवं

का.अ. 3914(ऄ). तारीख 20 जसतम् बर, 2021, भारत के राजपत्र सं० 3590, तारीख 22 जसतम् बर, 2021 में प्रकाजित

की गइ थी । आस ऄजधसूचना से संलग्न ऄनुसूची में जवनीर्ददष्ट भूजम में जबहार राज्य में “हल्दीया - बरौनी पाआपलाआन जसस्ट्टम्स

पररयोजना“ हेतु जजला पटना में कच्चा तेल के पररवहन हेतु आंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा पाआपलाआन जबछाने के

प्रयोजन के जलए ईपयोग के ऄजधकार के ऄजजन के ऄपने अिय की घोषणा की थी ।

और ईक्त राजपत्र ऄजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को तारीख 25 माचज 2022 तक ईपलब्ध करा दी

गइ थी,

और सक्षम प्राजधकारी (बरौनी, जबहार) ने ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार

को ररपोटज दे दी है,

और केन्द्रीय सरकार ने, ईक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो जाने पर दक ईक्त भूजम

पाआपलाआन जबछाने के जलए ऄपेजक्षत है, ईसमें ईपयोग के ऄजधकार के ऄजजन करने का जवजनश्चय दकया है;

ऄतः ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए

यह घोषणा करती है की आस ऄजधसूचना से संलग्न ऄनुसूची में जवनीर्ददष्ट भूजम में पाआपलाआन जबछाने के जलए ईपयोग के

ऄजधकार का ऄजजन दकया जाए,

और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए, यह

जनदेि देती है दक ईक्त भूजम में ईपयोग के ऄजधकार आस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के

बजाए, सभी जवल्लंगमो से मुक्त होकर आंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगी,

पेरोजलयम और खजनज पाआपलाआंन ऄजधजनयम,1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए आंजडयन

ऑयल कॉपोरेिन जलजमटेड पूणजतया ईत्तरदाइ होगा और पाआपलाआन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के

जवरुद्ध कोइ दावा या कानूनी कायजवाही नहीं हो सकेगी ।

NOTIFICATION

New Delhi, the 13th December, 2022

S.O. 5997 (E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum

and Natural Gas S. O. No. 1056(E), Dated 09 March, 2022, published in the Gazette of the India No. 1024

Dated 10 March, 2022, and S. O. No. 3914(E), Dated 20 September, 2021, published in the Gazette of the India No.

3590 Dated 22 September, 2021, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines

(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central

Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that

notification for the purpose of laying “Haldia-Barauni Pipeline Systems Project” for the transportation of Crude Oil in

Patna District in the state of Bihar by Indian Oil Corporation Limited.

And whereas copies of the said Gazette notification were made available to the public up to 25 March 2022.

And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted report

to the Central Government;

And whereas the central Government, after considering the said report and on being satisfied that the said

land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central

Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the

Central Government, vest on the date publication of the declaration, in Indian Oil Corporation Limited, free from all

encumbrances.

Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the

P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter

relating to the pipeline.
