नइ ददल् ली, 13 ददसम् बर, 2022

का.अ. 5987(ऄ).—भारत सरकार ने पेरोजलयम और खजनज पाआपलाआन (भूजम में ईपयोग के ऄजधकार का

ऄजजन) ऄजधजनयम, 1962 (1962 का 50) (जजसे आसमें आसके पश्चात् ईक्त ऄजधजनयम कहा गया है) की धारा 3 की

ईपधारा (1) के ऄधीन जारी भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या

का.अ. 3020(ऄ) तारीख 29.06.2022 जो भारत के ऄसाधारण राजपत्र तारीख 01.08.2022, में प्रकाजित की गयी थी,

द्वारा ईस ऄजधसूचना से संलग्न ऄनुसूची में जिजनर्ददष्ट भूजम में गेल (आजण्डया) जलजमटेड द्वारा मध्य प्रदेि राज्य में मुम्बइ –

नागपुर – झारसुगुडा प्राकृजतक गैस पाआपलाआन के खंड नागपुर - जबलपुर पाआपलाआन के माध्यम से प्राकृजतक गैस के

पररिहन के जलए पाआपलाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार का ऄजजन करने के ऄपने अिय की घोषणा

की थी;

और ईक्त राजपत्र ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी गइ थी;

और सक्षम प्राजधकारी ने, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन भारत सरकार को ऄपनी ररपोटज

दे दी है;

और भारत सरकार ने, ईक्त ररपोटज पर जिचार करने के पश्चात् और यह संतुष्ट हो जाने पर दक ईक्त भूजम

पाआपलाआन जबछाने के जलए ऄपेजक्षत है, ईसमें ईपयोग के ऄजधकार का ऄजजन करने का जिजनश्चय दकया है;

ऄतः ऄब, भारत सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत्त्त िजक्तयों का प्रयोग करते हुए,

यह घोषणा करती है दक आस ऄजधसूचना से संलग्न ऄनुसूची में जिजनर्ददष्ट भूजम में पाआपलाआन जबछाने के जलए ईपयोग के

ऄजधकार का ऄजजन दकया जाता है;

और, भारत सरकार, ईक्त ऄजधजनयम की धारा 6 दक ईपधारा (4) द्वारा प्रदत्त्त िजक्तयों का प्रयोग करते हुए,

जनदेि देती है दक पाआपलाआन जबछाने के जलए भूजम में ईपयोग का ऄजधकार, आस घोषणा के प्रकािन की तारीख से, भारत

सरकार में जनजहत होने के बजाए, सभी जिल्लंगमों से मुक्त होकर, गेल (आजण्डया) जलजमटेड में जनजहत होगा।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 13th December, 2022

S.O. 5987(E).—Whereas by notification of Government of India in the Ministry of Petroleum and Natural

Gas S. O. No. 3020 (E) dated 29.06.2022 issued under sub- section (1) of Section 3 of the Petroleum and Minerals

Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act),

published in the Extra Ordinary Gazette of India dated 01.08.2022, the Government of India declared its intention to

acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying

pipeline for transportation of natural gas through Nagpur – Jabalpur Pipeline section of Mumbai – Nagpur –

Jharsuguda Pipeline Project in the State of Madhya Pradesh by GAIL (India) Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its

report to Government of India;

And whereas Government of India after considering the said report and on being satisfied that the said land is

required for laying the pipeline, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,

Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government

of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government

of India, vest, on this date of the publication of the declaration, in the GAIL (India) Limited, free from all

encumbrances.
