पश्चात् उक्त अजधजनर्म कहा गर्ा है) की धारा 3 की उपधारा (1) और उपधारा (3) द्वारा प्रदत्त िजक्तर्ों का प्रर्ोग करते
हुए, नीचे सारणी में उजल्लजखत, जनम्नजलजखत व्यजक्तर्ों से जमलकर बने गोवा तटीर् िोन प्रबंध प्राजधकरण (जिसे इसमें
इसके पश्चात् प्राजधकरण कहा गर्ा है) का, रािपत्र में इस आदेि के प्रकािन की तारीख से तीन वर्ा की अवजध के जलए,

5.
सदस्ट्र्, जहतों के दकसी भी जवरोध से बचने के जलए, दकसी ऐसी पररर्ोिना के, जिसके जलए उन्द्होंने परामिा सेवा
प्रदान की है, अंकन की प्रदक्रर्ा में, प्राजधकरण की दकसी बैठक में से स्ट्वर्ं को अलग कर सकेगा (सकेंगे) ।

प्राजधकरण, गोवा राज्र् में तटीर् पर्ाावरण की क्वाजलटी को संरजक्षत करने और सुधारने तर्ा तटीर् जवजनमर् िोन
क्षेत्रों में पर्ाावरणीर् प्रदूर्ण के जनवारण, उपिमन और जनर्ंत्रण के प्रर्ोिन के जलए जनम्नजलजखत उपार् करेगा, अर्ाात् :--
(i) प्राजधकरण, पररर्ोिना प्रस्ट्ताव के अनुमोदन के जलए आवेदन प्राजि के पश्चात्, र्दद वह अनुमोददत तटीर्
िोन प्रबंध र्ोिना के अनुसरण में हैं और भारत सरकार द्वारा, र्र्ाजस्ट्र्जत, संख्र्ांक का.आ. 19(अ), तारीख
6 िनवरी, 2011 द्वारा िारी की गई तटीर् जवजनमर् िोन की अजधसूचना, 2011 र्ा का.आ. 37(अ),
तारीख 18 िनवरी, 2019 द्वारा िारी तटीर् जवजनमर् िोन अजधसूचना, 2019 (जिसे इसमें इसके पश्चात्
उक्त अजधसूचना कहा गर्ा है) की अपेक्षाओं के भीतर है तो उसका परीक्षण करेगा और संबद्ध प्राजधकरण
ऐसी पररर्ोिना के अनुमोदन के जलए, िैसा दक उक्त अजधसूचना में जवजनर्दाष्ट है, ऐसे आवेदन की प्राजि की
तारीख से साठ ददन के भीतर जसफाररि करेगा;
(ii) प्राजधकरण, उक्त अजधसूचना में जवजनर्दाष्ट दकए गए के अनुसार तटीर् जवजनर्मन िोन में सभी जवकासात्समक
दक्रर्ाकलापों को जवजनर्जमत करेगा;
(iii) प्राजधकरण, उक्त अजधसूचना के उपबंधों का प्रवतान और मानीटरी के जलए उत्तरदार्ी होगा;
(iv) प्राजधकरण को, उक्त अजधजनर्म की धारा 5 के अधीन जनदेि िारी दकर्ा िाएगा;
(v) प्राजधकरण, उसके समक्ष मामले के तथ्र्ों को सत्सर्ाजपत करने के जलए, ऐसी कारावाई करेगा, िैसी उक्त
अजधजनर्म की धारा 10 के अधीन अपेजक्षत है;
(vi) प्राजधकरण, उक्त अजधजनर्म की धारा 19 के अधीन पररवाद फाइल करने के जलए प्राजधकृत है;

(vii) प्राजधकरण, तटीर् जवजनमर् िोन क्षेत्रों और तटीर् िोन प्रबंध र्ोिना के वगीकरण में पररवतान र्ा
उपांतरणों के जलए गोवा राज्र् सरकार से प्राि प्रस्ट्तावों की परीक्षा करेगा और राष्ट्रीर् तटीर् िोन प्रबंध
प्राजधकरण को उस पर जवजनर्दाष्ट जसफाररि देगा;
(viii) प्राजधकरण, उक्त अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अजभकजर्त अजतक्रमण के
मामलों में िांच करेगा और उक्त अजधजनर्म तर्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अजतक्रमण
र्ा उल्लंघन को अंतवाजलत करने वाले मामलों का पुनर्वालोकन करेगा;
(ix) प्राजधकरण, उक्त अजधसूचना के अजतक्रमण र्ा उल्लंघन के मामलों में स्ट्वप्रेरणा से र्ा दकसी व्यजष्ट र्ा जनकार्
र्ा संगठन द्वारा दकए गए पररवाद के आधार पर िांच र्ा पुनर्वालोकन करेगा ।
7.
प्राजधकरण, अपने कृत्सर्ों में पारदर्िाता बनाए रखने के प्रर्ोिन के जलए एक समर्पात वेबसाइट तैर्ार करेगा और
इसके कृत्सर्, जिसके अंतगात बैठकों में कार्ासूची, बैठकों का कार्ावृत्त, प्रत्सर्ेक बैठकों में दकए गए जवजनश्चर्, उक्त अजधसूचना के
अजतक्रमण तर्ा उल्लंघन के मामलों में जसफाररिें और ऐसे अजतक्रमण तर्ा उल्लंघन पर की गई कारावाई और न्द्र्ार्ालर्
मामले जिसके अंतगात न्द्र्ार्ालर्ों के आदेि हैं और राज्र् सरकार की अनुमोददत तटीर् िोन प्रबंध र्ोिना से संबंजधत
सूचना डालेगा ।
8.
प्राजधकरण, छह मास में कम से कम एक बार अपने दक्रर्ाकलापों की ररपोटा राष्ट्रीर् तटीर् िोन प्रबंध प्राजधकरण
को भेिेगा ।

S.O. 6071(E).—In exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the
Environment (Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central
Government hereby constitutes the Goa Coastal Zone Management Authority (hereinafter referred to as the
Authority) consisting of the following members, specified in column (2) of the table below, for a period of
three years, with effect from the date of publication of this Order in the Official Gazette, namely:-

2. The Authority shall have its headquarters at Panaji, Goa.
3. The quorum for the meeting of the Authority shall be one-third of the total number of its Members.
4. A Member, other than an exofficio Member, shall be paid allowances as per the terms and conditions
decided by the Central Government in this behalf.
5. In order to avoid any conflict of interest, the Member shall recuse himself from the meeting of the
Authority, in the process of appraisal of any project, for which they have rendered consultancy service.
6. The Authority shall, for the purposes of protecting and improving the quality of the coastal
environment and preventing, abating and controlling environmental pollution in the Coastal Regulation
Zone areas in the State of Goa, take the following measures, namely: -
(i)
Examine after receiving the application for approval of project proposal, in accordance with the
approved Coastal Zone Management Plan and within the requirements of the Coastal Regulation
Zone notification, 2011 issued by the Government of India vide number S.O.19(E), dated the
6th January, 2011 or Coastal Regulation Zone Notification, 2019 issued vide number G.S.R.
37(E), dated the 18th January, 2019 (hereinafter referred to as the said notification), as the case
may be, and make recommendations for approval of such project to the concerned authority, as
specified in the said notification, within a period of sixty days from the date of receipt of such
application;
(ii)
regulate all developmental activities in the Coastal Regulation Zone areas as specified in the
said notification;
(iii)
responsible for enforcing and monitoring the provisions of the said notification;
(iv)
issue directions under section 5 of the said Act;
(v)
take such action as may be required under section 10 of the said Act, to verify the facts of the
cases before it;
(vi)
file complaint under section 19 of the said Act;
(vii)
examine the proposals received from the State Government of Goa for changes or modifications
in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan
and make specific recommendations thereon, to the National Coastal Zone Management
Authority;

inquire into cases of alleged violation of the provisions of the said Act or the rules made
thereunder, and review the cases involving violations or contraventions of the provisions of the
said Act and the rules made thereunder; and
(ix)
inquire or review cases of violations or contraventions of the said notification suo-moto, or on
the basis of a complaint made by any individual or body or organization;
7. The Authority shall, for the purpose of maintaining transparency in its functioning, create a dedicated
website and post the information relating to its functions, including the agenda in its meetings, minutes of
the meetings, decisions taken in each meeting, recommendations for matters on violations and
contravention of the said notification and actions taken on such violations and contraventions, court matters
including the orders of the courts and the approved Coastal Zone Management Plan of the State
Government.
8. The Authority shall furnish reports of its activities at least once in six months to the National Coastal
Zone Management Authority.
