सा.का.जन. 925(ऄ).—राष्ट्रपजत, संजिधान के ऄनुच्छेद 318 के खंड (क) द्वारा प्रदत्त िजियों का ईपयोग करते हुए संघ लोक सेिा
अयोग (सदस्ट्य) जिजनयमािली, 1969 में अगे और संिोधन करने के जलए एतद्द्वारा जनम्नजलजखत जिजनयम बनाते हैं, नामत:-
1. संजक्षप्त िीर्षक एिं प्रारंभ –(1)आन जिजनयमों को संघ लोक सेिा अयोग (सदस्ट्य) संिोधन जिजनयमािली, 2022 कहा जा
सकेगा।
(2) िे सरकारी राजपत्र में ईनके प्रकािन की जतजथ से प्रिृत्त होगे।
2. संघ लोक सेिा अयोग (सदस्ट्य) जिजनयमािली, 1969 में (आसके बाद से ईि जिजनयमािली के रूप में संदर्मभत) जिजनयम
7क के जलए जनम्नजलजखत जिजनयम को प्रजतस्ट्थाजपत दकया जाएगा:-
“7क ऄप्रयुि ऄर्मजत ऄिकाि के बदले में नकद भुगतान – (1) दकसी सदस्ट्य को पदभार छोड़ते समय ईसके पास जमा
ऄर्मजत ऄिकाि की ऄिजध के जलए छुट्टी िेतन के समतुल्य नकद भुगतान दकया जाएगा।

(2) ईप-जिजनयम (1) के तहत छुट्टी िेतन के समतुल्य नकद का भुगतान, एक सदस्ट्य के रूप में जनयुजि से पहले, जजस
ऄिजध के जलए नकद भुगतान दकया गया ईस ऄिजध के सजहत ऄजधकतम तीन सौ ददनों के ऄर्मजत ऄिकाि तक सीजमत
होगा।
(3) आस प्रकार स्ट्िीकायष छुट्टी िेतन के समतुल्य नकद दकसी सदस्ट्य को ईसके पदभार छोड़ने के समय देय होगा और
आसका एकमुश्त एक बार के व्यिस्ट्थापन के रूप में भुगतान दकया जाएगा।
(4) नकद भुगतान पदभार पर छोड़ने की जतजथ पर ईस छुट्टी िेतन पर प्रिृत्त दरों पर स्ट्िीकायष ऄर्मजत ऄिकाि और
महंगाइ भत्ते के जलए यथा स्ट्िीकायष छुट्टी िेतन के समतुल्य होगा, छुट्टी िेतन पर कोइ अिास दकराया भत्ता देय नहीं
होगा।”

ईि जिजनयमािली में, जिजनयम 8 में, ईप-जिजनयम (2) के जलए जनम्नजलजखत ईप जिजनयम प्रजतस्ट्थाजपत होगा, नामतः-
“(2). ऄध्यक्ष और सदस्ट्यों को देय पेंिन- प्रत्येक ऐसे सदस्ट्य को, जो ऄपनी जनयुजि की जतजथ से केंद्र सरकार या राज्य
सरकार या क्षेत्रीय जनकाय या सरकार द्वारा पूणष रूप से या पयाषप्त रूप से स्ट्िाजमत्ि ऄथिा जनयंत्रण में अने िाले दकसी
ऄन्य जनकाय में सेिा में नहीं थे, ऄपने पद पर न रहने पर पेंिन और ग्रेच्युटी नहीं दी जाएगी।‖
4.
ईि जिजनयमािली में, जिजनयम 11 के जलए जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत होगा, नामतः-
“11. छुट्टी यात्रा ररयायत लेने पर छुट्टी नकदीकरण- (1) भारत सरकार में सजचि की रैंक के पद पर भारतीय प्रिासजनक
सेिा के सदस्ट्य को स्ट्िीकायष जनयमों के ऄनुसार छुट्टी के दौरान ऄपने गृह जनपद सजहत भारत के दकसी भी स्ट्थान की यात्रा
करने के जलए ऄध्यक्ष एिं ऄन्य सदस्ट्य स्ट्ियं, ईनकी पत्नी/ पजत तथा ईन पर अजित ईनके पररिार के सदस्ट्य भी छुट्टी
यात्रा ररयायत के पात्र होंगे।
(2) ऄध्यक्ष तथा ऄन्य सदस्ट्यों को ितों के ऄध्यधीन ईनके द्वारा ली गइ यात्रा छुट्टी ररयायत की अिजधकता के बािजूद
संघ लोक सेिा अयोग में ऄपने कायषकाल के दौरान ऄजधकतम 60 ददनों के ऄध्यधीन यात्रा छुट्टी ररयायत लेते समय 10
ददनों तक के ऄर्मजत ऄिकाि को नकदीकृत (एनकैि) करने की ऄनुमजत दी जा सकती है, जैसा दक भारत सरकार के
सजचि की रैंक के पद पर भारतीय प्रिासजनक सेिा के सदस्ट्यों द्वारा यात्रा ररयायत छुट्टी लेते समय ऄर्मजत ऄिकाि के
नकदीकरण के जलए स्ट्िीकायष है।‖

NOTIFICATION
New Delhi, the the 30th December, 2022
G.S.R. 925(E).—In exercise of the powers conferred by clause (a) of article 318 of the Constitution, the
President hereby makes the following regulations, further to amend the Union Public Service Commission (Members)
Regulations,1969, namely:-
1. Short title and commencement.-(1) These regulations may be called the Union Public Service Commission
(Members) Amendment Regulations, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Union Public Service Commission (Members) Regulations, 1969 (hereinafter referred to as the said
regulations), for regulation 7A, the following regulation shall be substituted:-
―7ACash payment in lieu of unutilised Earned Leave.-(1) A Member shall be paid cash equivalent to
leave salary in respect of period of Earned Leave at his credit at the time of his ceasing to hold office.
(2) The payment of cash equivalent of leave salary under sub-regulation (1) shall be limited to a maximum
period of three hundred days of Earned Leave including the period for which cash payment was made, prior
to the appointment as Member.
(3) The cash equivalent of leave salary thus admissible shall become payable to a Member at the time of
his ceasing to hold office and shall be paid in lumpsum as a onetime settlement.
(4) Cash payment shall be equivalent to leave salary, as admissible for Earned Leave and Dearness
Allowance admissible on that leave salary at the rates in force on the date of relinquishment of office andno
House Rent Allowance shall be payable on the leave salary‖.
3. In the said regulations, in regulation 8, for sub-regulation (2) the following sub-regulation shall be substituted,
namely:-
“(2). Pension payable to Chairman and Members.-Every Member, who at the date of his appointment, as such,
was not in the service of the Central Government or the State Government or a local body or any other body,
wholly or substantially owned or controlled by Government,shall on his ceasing to hold office, not be paid
pension and gratuity‖.
4. In the said regulations, for regulation 11, the following regulation shall be substituted, namely: -
“11. Leave Encashment on availing Leave Travel Concession – (1) The Chairman and other Members shall be
entitled to Leave Travel Concession for himself, his spouse and the family member dependent on him for visiting
any place in India including his home townduring his leave in accordance with the rules admissible to a member
of the Indian Administrative Service holding the rank of Secretary to the Government of India.
(2) The Chairman and other Members may be allowed to encash Earned Leave upto tendays at the time of
availing Leave Travel Concession subject to the maximum of sixtydays during his tenure in Union Public Service
Commission irrespective of the periodicity of Leave Travel Concession availed by him subject to the conditions
as are admissible for encashment of Earned Leave while availing Leave Travel Concession by members of Indian
Administrative Service holding the rank of Secretary to the Government of India‖.
