का.अ. 6178(ऄ).—केन्द्रीय सरकार ने, राष्ट्रीय रािमागग ऄजधजनयम, 1956 (1956 का 48) (जिसे आसमें आसके

पश्चात् ईक्त ऄजधजनयम कहा गया है) की धारा 3क की ईपधारा (1) के ऄधीन िारी की गइ भारत सरकार के सड़क पररवहन

और रािमागग मंत्रालय की ऄजधसूचना संख्या का.अ. 390 (ऄ) तारीख 28 िनवरी 2022, िो भारत के रािपत्र,

ऄसाधारण, भाग II, खण्ड 3, ईपखंड (ii) में प्रकाजित की गइ थी, द्वारा महाराष्ट्र राज्य के नागपुर जिले में राष्ट्रीय रािमागग

क्रमांक 361 के दक.मी. 465.500 से दक.मी.524.690 (वधाग-बुटीबोरी सेक्िन) तक के राष्ट्रीय रािमागग के जनमागण (चौड़ा

करने/चार लेन का बनाने, अदद), ऄनुरक्षण, प्रबंधन और प्रचालन के लोक प्रयोिन के जलए ईस ऄजधसूचना से ईपाबद्ध

ऄनुसूची में जवजनर्ददष्ट भूजम का ऄिगन करने के ऄपने अिय की घोषणा की थी;

और ईक्त ऄजधसूचना का सार ईक्त ऄजधजनयम की धारा 3क की ईपधारा (3) के ऄधीन तारीख "16 फरवरी

2022" को "द जहतवाद" और "तरूण भारत" दोनों में प्रकाजित दकया गया था;

और सक्षम प्राजधकारी को दकसी व्यजक्त से कोइ अक्षेप प्राप्त नहीं हुए है;

और सक्षम प्राजधकारी ने ईक्त ऄजधजनयम की धारा 3घ की ईपधारा (1) के ऄनुसरण में, केन्द्रीय सरकार को ऄपनी

ररपोटग दे दी है;

ऄतः ऄब, केन्द्रीय सरकार, सक्षम प्राजधकारी की ईक्त ररपोटग प्राप्त हो िाने पर और ईक्त ऄजधजनयम की धारा 3घ

की ईपधारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, यह घोषणा करती है दक ईक्त ऄनुसूची में जवजनर्ददष्ट भूजम का

पूवोक्त प्रयोिन के जलए ऄिगन दकया िाना चाजहए;

और ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 3घ की ईपधारा (2) के ऄनुसरण में यह घोषणा करती है दक

आस ऄजधसूचना के रािपत्र में प्रकािन पर, ईक्त ऄनुसूची में जवजनर्ददष्ट भूजम, सभी जवल्लंगमों से मुक्त होकर अत्यजन्द्तक रूप

से केन्द्रीय सरकार में जनजहत हो िाएगी ।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS

NOTIFICATION

New Delhi the 29th December, 2022

S.O. 6178(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport

and Highways, S.O. 390(E), dated 28th January 2022, published in the Gazette of India, Extraordinary, Part II, Section

3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of 1956)

(hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in

the Schedule annexed to the said notification for building (widening/four-laning, etc.), maintenance, management and

operation of National Highway No. 361 on the stretch of land from Km. 465.500 to Km. 524.690 (Wardha-Butibori

Section) in the district of NAGPUR in the state of MAHARASHTRA;

And whereas the substance of the said notification has been published in “The Hitavada” and “Tarun Bharat”

both dated 16th February 2022; under sub-section (3) of section 3A of the said Act;

And whereas no objection has been received from any person by the Competent Authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the Competent Authority has

submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the Competent Authority and in exercise of the powers

conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land

specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby

declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest

absolutely in the Central Government, free from all encumbrances.
