का.आ. 85(अ).— जवजधजवरुद्ध-दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसमें इसके

पश्चात् उक्त अजधजनयम कहा गया है) का अजधजनयमन व्यजियों और संगमों के कजतपय जवजधजवरुद्ध- दियाकलापों के अजधक

प्रभावी जनवारण करने और आतंकवािी दियाकलापों से जनपटने के जलए और तत्संसक्त जवषयों का उपबंध करने के जलए

दकया गया है ;

और, उक्त अजधजनयम की धारा 2 की उपधारा (1) के खंड (ड) के ‘अनुसार आतंकवािी संगठन’ से उक्त अजधजनयम

की पहली अनुसूची में सूचीबद्ध कोई संगठन या इस प्रकार सूचीबद्ध दकसी संगठन के रूप में उसके नाम से कायय करने वाला

कोई संगठन अजभप्रेत है;

और, उक्त अजधजनयम की पहली अनुसूची में ऐसे आतंकवािी संगठनों की सूची अंतर्वयि है;

और, पीपुल्स एंटी फाजसस्ट्ट फ्रंट (पीएएफएफ), वषय 2019 में िैि-ए-मोहम्मि के प्रॉक्सी आउटदफट के रूप में

उभरा है, िो दक उक्त अजधजनयम के अधीन पहली अनुसूची के िम सं. 6 पर सूचीबद्ध एक जनजषद्ध आतंकवािी संगठन है ;

और, पीपुल्स एंटी फाजसस्ट्ट फ्रंट (पीएएफएफ) लगातार भारतीय सुरक्षा बलों, रािनैजतक नेताओं, िम्मू-कश्मीर में

काम करने वाले अन्य राज्यों के लोगों के जलए चेतावनी िारी करता है ;

और, पीपुल्स एंटी फाजसस्ट्ट फ्रंट (पीएएफएफ) अन्य संगठनों के साथ भारत में िम्मू-कश्मीर और अन्य प्रमुख िहरों

में हहंसक आतंकवािी कृत्यों को करने के जलए पूवय सदिय रूप से भौजतक रूप में और सोिल मीजडया पर षडयंत्र करने में

संजलप्त है;

और, पीपुल्स एंटी फाजसस्ट्ट फ्रंट (पीएएफएफ) अन्य संगठनों के साथ बंिूकें, गोला बारूि और जवस्ट्फोटकों को

चलाने के जलए भती तथा प्रजिक्षण के प्रयोिन से प्रभावनीय युवाओं को अजतवािी बनाने में लगा हुआ है;

और, केंद्रीय सरकार का यह जवश्वास है दक पीपुल्स एंटी फाजसस्ट्ट फ्रंट (पीएएफएफ) आतंकवाि में संलग्न है और

इसने भारत में आतंकवाि के अनेक कृत्यों को दकया है और उनमें भाग जलया है;

अत: अब, केंद्रीय सरकार, जवजधजवरुद्ध-दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1)

के खंड (क) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की पहली अनुसूची में जनम्नजलजखत और संिोधन

करती है, अथायत्:-

उक्त अजधजनयम की पहली अनुसूची में िम सं. 6 में, “तहरीक-ए-फुरकन” िब्िों के पश्चात् “/पीपुल्स एंटी फाजसस्ट्ट

फ्रंट (पीएएफएफ) और इसके सभी रूप तथा फ्रंट संगठन” िब्ि और कोष्ठक अंतःस्ट्थाजपत दकए िाएंगे ।

NOTIFICATION

New Delhi, the 6th January, 2023

S.O. 85(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to

as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals

and associations and for dealing with terrorist activities and for matters connected therewith;

And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, ‘terrorist organisation’ means

an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an

organisation so listed;

And whereas, the First Schedule to the said Act contains the list of such terrorist organisations;

And whereas, the ‘People’s Anti-Fascist-Front (PAFF)’ emerged in the year 2019 as a proxy outfit of Jaish-e-

Mohammed, a proscribed terrorist organisation listed at serial number 6 of the First Schedule under the said Act;

And whereas, the ‘People’s Anti-Fascist-Front (PAFF)’ regularly issues threats to Indian Security Forces,

political leaders, civilians working in Jammu-Kashmir from other states;

And whereas, the ‘People’s Anti-Fascist-Front (PAFF)’ alongwith other organisations is involved in

conspiring pro-actively physically and in social media to undertake violent terrorist acts and Jammu-Kashmir and

other major cities in India;

And whereas, the ‘People’s Anti-Fascist-Front (PAFF)’ alongwith other organisations is indulging in

radicalization of impressionable youth for the purpose of recruitment and training in handling guns, ammunitions and

explosives;

And whereas, the Central Government believes that the ‘People’s Anti-Fascist-Front (PAFF)’ is involved in

terrorism and it has committed and participated in various acts of terrorism in India;

Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the

Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following further

amendments in the First Schedule to the said Act, namely:-

In the First Schedule to the said Act, in serial number 6, after the words “Tahrik-E-Furqan”, the words and

brackets “/ People’s Anti-Fascist-Front (PAFF) and all its manifestations and front organisations”, shall be inserted.
