का.आ. 105(अ).—जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसमें इसके
पश्चात् उक्त अजधजनयम कहा गया है) को व्यजियों और संगमों के कजतपय जवजधजवरूद्ध दियाकलापों के और प्रभावी
जनवारण करने के जलए तथा आतंकवािी दियाकलापों और उससे समबजधधत मामलों से जनपटने के जलए अजधजनयजमत दकया
गया है ;
और, उक्त अजधजनयम की धारा 35 की उपधारा (1) का खंड (क) और उपधारा (2), केंद्रीय सरकार को उक्त
अजधजनयम की चौथी अनुसूची में दकसी व्यजि के नाम को िोड़ने के जलए सिक्त करता है, यदि उसका यह जवश्वास है दक वह
आतंकवाि में सज मजलत है ;
और, अिशिीप ससंह जगल उर्श अिश डाला, जिसके िधम की तारीख 21 मई, 1996 है, पुत्र चरनिीत ससंह जगल,
जिसका िधम िगरान, लुजधयाना, पंिाब में हुआ है, यह वाडश नं0 02, पत्ती माल, वीपीओ-डाला, पुजलस स्ट्टेिन – मेहना,
जिला मोगा, पंिाब, भारत का रहने वाला है, िो वतशमान में कनाड़ा में रह रहा है, यह खाजलस्ट्तान टाइगर र्ोसश (केटीएर्)
नामक संगठन से संबंध रखता है ;
और, उक्त अिशिीप ससंह जगल उर्श अिश डाला का, उक्त अजधजनयम के अधीन घोजित आतंकवािी हरिीप ससंह
जनज्जर से नििीकी संबंध है और वह उसकी ओर से आतंकी माड्यूल्स चलाता है ;
और, उक्त अिशिीप ससंह जगल उर्श अिश डाला, आतंकवािी गजतजवजधयों के अजतररक्त िघधय अपराधों िैसे हत्या, िबरन
वसूली और लजित हत्याओं में िाजमल है ;

और, उक्त अिशिीप ससंह जगल उर्श अिश डाला, बड़ी मात्रा में सीमापार से निीले पिाथों और हजथयारों की तस्ट्करी तथा
आतंक के जवत्तीयन में िाजमल है ;
और, उक्त अिशिीप ससंह जगल उर्श अिश डाला, राष्ट्रीय अधवेिण अजभकरण द्वारा रजिस्ट्रीकृत और अधवेजित जवजभन्न मामलों
में अजभयुक्त है, जिनमें लजित हत्याओं, आंतक के जवत्तीपन के जलए वसूली, हत्या का प्रयास, साप्रिाजयक सौहािश जबगाड़ने
और भारत के पंिाब राज्य में लोगों के बीच भय पैिा करना िाजमल है ;
और, केंद्रीय सरकार का यह जवश्वास है दक अिशिीप ससंह जगल उर्श अिश डाला आतंकवािी कृत्यों में िाजमल है और उक्त
अिशिीप ससंह जगल उर्श अिश डाला को उक्त अजधजनयम के अधीन आतंकवािी के रूप में िोड़ा िाना है ;
अतः, अब, केंद्रीय सरकार, जवजधजवरूद्ध दियाकलाप (जनवारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1)
के खंड (क) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की चौथी अनुसूची में जनम्नजलजखत संिोधन करती है,
अथाशत् :-
उक्त अजधजनयम की चौथी अनुसूची में िम सं. 52 और उससे संबंजधत प्रजवजियों के पश्चात्, जनम्नजलजखत िम सं. और
प्रजवजियां अंतः स्ट्थाजपत की िाएगी, अथाशत् :-
“53. अिशिीप ससंह जगल उर्श अिश डाला ”

NOTIFICATION
New Delhi, the 9th January, 2023
S.O.. 105(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred
to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of
individuals and associations and for dealing with terrorist activities and for matters connected therewith;
And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the
Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is
involved in terrorism;
And whereas, Arshdeep Singh Gill @ Arsh Dala having date of birth on the 21st May, 1996, son of Charanjit
Singh Gill, born in Jagraon, Ludhiana, Punjab, resident of Ward No. 02, Patti Mall, VPO-Dala, Police Station-
Mehna, District Moga, Punjab, India ,presently based in Canada, is associated with Khalistan Tiger Force (KTF) ;
And whereas, the said Arshdeep Singh Gill @ Arsh Dala is very close to Hardeep Singh Nijjar, a designated
terrorist under the said Act and runs terror modules on behalf of him;
And whereas, the said Arshdeep Singh Gill @ Arsh Dala is involved in heinous crimes such as murder,
extortion and targeted killings besides terror activities;
And whereas, the said Arshdeep Singh Gill @ Arsh Dala is involved in terror financing, cross border
smuggling of drugs or weapons in large scale;
And whereas, the said Arshdeep Singh Gill @ Arsh Dala is accused in various cases registered and
investigated by the National Investigation Agency including targeted killing, extorting money for terror funding,
attempt to murder, disturbing communal harmony and creating terror among the people in the state of Punjab, India;
And whereas, the Central Government believes that Arshdeep Singh Gill @ Arsh Dala is involved in
terrorism and the said Arshdeep Singh Gill @ Arsh Dala is to be added as a terrorist under the said Act;
Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the
Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the
Fourth Schedule to the said Act, namely:-

In the Fourth Schedule to the said Act, after serial number 52 and entries relating thereto, the following serial
number and entries shall be inserted, namely:-
“53.
Arshdeep Singh Gill @ Arsh Dala ”.
