जवषय: गहरे समुद्री, अत्यजधक गहरे समुद्री और उच् च िाब-उच् च तापक्रम वाले क्षेत्रों में खोिों से उत्पादित गैस की जबक्री
और पुनर्बिक्री तथा मूल्य जनधािरण की आिािी के संबंध में।

अजधसूचना सं. 300 और दिनााँक 03 दिसंबर, 2020 की अजधसूचना सं. 351 के क्रम में दिनााँक 21 माचि 2016 की
सरकारी अजधसूचना सं. 86 द्वारा यथा अजधसूजचत अजधकतम मूल्य सजहत गहरे समुद्री (डीडब्लल्यू), अत्यजधक गहरे समुद्री
(यूडीडब्लल्यू) और उच् च िाब-उच् च तापक्रम वाले क्षेत्रों (एचपी एचटी) में खोिों से उत्पादित गैस के बािार मूल्य के जनधािरण
और आगे गैस के व्यापार के संबंध में जनम्नजलजखत स्ट्पष्टीकरण एतिद्वारा िारी दकए िाते हैं:-
क.
उपयुिक्त उजल्लजखत गैस की ई-बोली प्रदक्रया में भाग ले रहे सहयुक्तों सजहत बोलीिाताओं को स्ट्पष्ट रूप से यह
बताना होगा दक क्या वे अंत्य उपभोक्ताओं (अपनी समूह कंपजनयों द्वारा उपयोग सजहत) के रूप में अपने उपयोग
के जलए अथवा एक व्यापारी के रूप में नीलामी के माध्यम से गैस खरीिना चाहते हैं।

अंत्य उपभोक्ता: खरीिी गई उपयुिक्त उजल्लजखत गैस की दकसी मात्रा तथा संयंत्र के अजनयोजित तरीके से बंि होने
की जस्ट्थजत सजहत दकसी भी कारण से िेष अप्रयुक्त गैस की पुनर्बिकी पेरोजलयम और प्राकृजतक गैस मंत्रालय द्वारा
अलग से अजधसूजचत की िाने वाली ितों पर की िा सकती है।
ग.
व्यापारी: व्यापाररयों के रूप में उपयुिक्त उजल्लजखत गैस खरीिने वाले सहयुक्तों सजहत उन सभी कंपजनयों के जलए
जनम्नजलजखत ितें लागू होंगी। यह ितें इस अजधसूचना के प्रवृत्त होने की तारीख से भूतलक्षी प्रभाव से लागू होंगी।
i.
व्यापारी उपयुिक्त गैस की पुनर्बिक्री दकसी अन्य व्यापारी या अंत्य उपभोक्ता को कर सकते हैं,
ii.
उपयुिक्त गैस की पुनर्बिक्री पर समग्र व्यापार मार्ििन यूररया और एलपीिी उत्पािकों (वतिमान में 200
रुपये प्रजत हिार एससीएम) को पुनर्बिक्री के जलए दिनााँक 24 नवंबर, 2015 को सरकार द्वारा पूवि में
अजधसूजचत जवपणन मार्ििन की िरों पर कैप दकया िाएगा। अन्य अंत्य उपभोक्ताओं या व्यापाररयों को
पुनर्बिक्री के जलए पुनर्बिक्री पर समग्र व्यापार मार्ििन मानक जवपणन मार्ििन का अजधकतम होगा।
नोट 1: मानक जवपणन मार्ििन से आिय उपभोक्ताओं को आपूर्ति के जलए पेरोनेट एलएनिी जलजमटेड के साथ
िीर्िकाजलक संजविा के तहत पुनगैसीकृत तरलीकृत प्राकृजतक गैस (आरएलएनिी) के ऑफ-टेकसि द्वारा लगाए िा
रहे जवपणन मार्ििन से है, िो वतिमान में कैलेंडर वषि 2023 के जलए 16.62 रुपए/एमएमबीटीयू है।
नोट 2: ऊपर जवजनर्ििष्ट व्यापार मार्ििन संजविाकार और अंजतम खरीिार के बीच लेन-िेन की श्ृंखला में िाजमल
सभी व्यापाररयों द्वारा लगाए गए व्यापार मार्ििन का संचयी मूल्य होगा।
iii.
अंत्य उपभोक्ताओं की जस्ट्थजत स्ट्व-प्रमाणन पर आधाररत होगी। तथाजप, सरकार स्ट्व-प्रमाणन की
प्रामाजणकता को सत्याजपत करने का अजधकार, यदि ऐसा आवश्यक हो, अपने पास सुरजक्षत रखेगी।
iv.
व्यापारी सम्पूणि लेन-िेन के जववरण की सूचना संजविाकारों को िेंगे िो इस तरह के अजभलेख रखेंगे।
संजविाकार समय-समय पर बोली समापन ररपोटि के अनुपूरक के रूप में डीिीएच को यह सूचना प्रस्ट्तुत
करेंगे। डीिीएच समय-समय पर इस संबंध में पेरोजलयम और प्राकृजतक गैस मंत्रालय को अनुपालन ररपोटि
भेिेगा।

संजविाकार/बोलीिाता एिेंजसयााँ पहले से ही एक िायरा प्रिान करती हैं जिसके भीतर बोजलयों का मूल्य
जवजनधािररत दकया िा सकता है। ऐसी दकसी भी जस्ट्थजत, जिसमें बोली प्रदक्रया के तहत प्रस्ट्ताजवत गैस के
आनुपाजतक जवतरण की आवश्यकता हो, संजविाकार उसी क्रम में सीएनिी(टी)/पीएनिी(डी) क्षेत्र, उविरक,
एलपीिी और जबिली क्षेत्र से सम्बजन्धत बोलीिाताओं को गैस की पेिकि करेगा। िेष कोई भी गैस प्रस्ट्ताव के
जलए अनुरोध (आरएफपी) की प्रदक्रया के अनुसार अन्य बोलीिाताओं को पेि की िाएगी।
ङ .
जबक्री/पुनर्बिक्री के अन्य सभी जनयम और ितें, लागू सरकारी जवजधयों और नीजतयों के अनुरूप होंगी। इस
दििाजनिेि को उपयुिक्त गैस के जवपणन और मूल्य जनधािरण की आजािी से सम्बजन्धत सभी लागू जवजधयों और
नीजतयों के प्रावधानों के साथ सामंिस्ट्यपूणि रूप से पढा िाएगा।

NOTIFICATION
New Delhi, the 13th January, 2023
Subject: Regarding Sale and Resale of Gas produced from Discoveries in Deepwater, Ultra Deepwater and
High Pressure-High Temperature areas with marketing and pricing freedom-reg.
No. Expl-15022(13)/234/2019-ONG-V (E-33916).—In continuation of Gazette notifications No: 300 dated
15 October 2020 and No: 351 dated 03rd December 2020, the following clarifications are hereby issued regarding the
discovery of market price and further trading of gas produced from Discoveries in Deepwater (DW), Ultra Deepwater
(UDW) and High Pressure-High Temperature areas (HP HT) with ceiling price as notified vide Government
Notification No: 86 dated 21 March 2016:
a. Bidders, including affiliates, participating in the e-bidding process of above mentioned gas will have to
clearly specify whether they wish to purchase gas through the auction for own use as end consumers
(including for use of their group entities) or as a trader.
b. End consumers: Any quantity of above mentioned gas purchased and remaining unconsumed for any reason,
including in cases of unplanned plant shutdowns, can be resold, subject to conditions, which would
separately be notified by the MoPNG.
c. Traders: For those entities, including affiliates, seeking above mentioned gas as traders, following conditions
would be applicable. These conditions would apply prospectively from date of issue of this Notification.
i.
Traders may resell above mentioned gas to another trader or to an end consumer,
ii.
Overall trading margin on resale of above mentioned gas would be capped at rates of marketing
margin previously notified by Government on 24th November 2015 for its resale to Urea and LPG
producers (currently Rs. 200 per thousand SCM). For resale to other end consumers or traders the
overall trading margin on resale would be the maximum of Standard Marketing Margin.
Note 1: Standard Marketing Margin refers to Marketing Margin being charged by off-takers of Regasified
Liquefied Natural Gas (RLNG) under Long-term Contract with Petronet LNG Limited for supply to
Consumers, currently at Rs.16.62/mmbtu for Calendar Year 2023.
Note 2: The trading margin specified above shall be the cumulative value of the trading margin charged
by all the traders involved in the chain of transactions between the contractor and the ultimate buyer.
iii.
End consumers status shall be based on self-certification. Government would however, reserve the
right to verify authenticity of the self-certification, should it be so warranted.
iv.
Traders shall report details of completed transaction to the Contractors who shall maintain such
records. Contractor shall submit this information to DGH as a supplement to the bid closure report
from time to time. DGH shall periodically send compliance reports in this regard to MoPNG.
d. Contractors/ Bidding agencies already provide a range within which bids can be priced. In any situation,
which may require proportionate distribution of the gas offered under the bidding process, the contractor
shall offer gas to bidders belonging to CNG(T)/PNG(D) sector, fertilizer, LPG and power sector in that order.
Any leftover gas shall be offered to other bidders as per the procedure in Request For Proposal (RFP).
e. All other terms and conditions of the sale/resale shall be in consonance with the applicable
government laws and policies. These guidelines shall be read harmoniously with provisions of all applicable
laws and policies relating to marketing and pricing freedom of above mentioned gas.
