सा.का.जन. 32(अ).—केन्‍द रीय सरकार, भारत-जतब्बत सीमा पुजलस बल अजधजनयम, 1992 (1992 का 35) की

धारा 156 की उप-धारा (2) के खंड (ख) द्वारा प्रित्त िजियों का प्रयोग करते हुए तथा भारत जतब्बत सीमा पुजलस बल में

िि अटनी िनरल, अपर िि अटनी िनरल (कमांडेंट), उप िि अटनी िनरल और िि अटनी समूह ’क’ पिों पर भती

तथा सेवा की िते जनयम 2019 को उन बातों के जसवाए अजधक्ांत करते हुए जिन्‍दहें ऐसे अजधक्मण से पूवव दकया गया है या

करने का लोप दकया गया है, गृह मंत्रालय के अधीन भारत जतब्बत सीमा पुजलस बल में अपर िि अटनी िनरल (कमांडेंट),

वररष् ठ उप िि अटनी िनरल (जद्वतीय कमान) समूह ‘क’ पिों पर भती की पद्धजत को जवजनयमन करने के जलए केंरीय

सरकार जनम्नजलजखत जनयम बनाती है, अथावतः-

संजिप् त नाम और प्रारंभ - (1) इन जनयमों का संजिप् त नाम भारत-जतब्बत सीमा पुजलस बल, अपर िि अटनी

िनरल (कमांडेंट) और वररष् ठ उप िि अटनी िनरल (जद्वतीय कमान) समूह ‘क’ भती जनयम, 2023 है।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे।

लागू होना- ये जनयम इससे उपाबद्ध अनुसूची के स्ट्तम्भ (1) में जवजनर्िवष्ट पिों पर लागू होंगे।

पिों की संख्या, वगीकरण और वेतन मैररक्स में स्ट् तर.— उि पिों की संख्या, उनका वगीकरण और मैररक्स में

स्ट्तर वे होंगे, िो इन जनयमों से उपाबद्ध अनुसूची के स्ट्तंभ (2) से स्ट्तंभ (4) में जवजनर्िवष्ट हैं।

भती की पद्धजत, आयु सीमा और अन्‍दय अहवताएं आदि.— उि पिों पर भती की पद्धजत, आयु सीमा, अहवताएं और

उससे संबंजधत अन्‍दय बातें वे होंगी िो उि अनुसूची के स्ट्तंभ (5) से स्ट्तंभ (13) में जवजनर्िवष्ट हैं।

जचदकत्सीय िृष्टया योग्यता.— इन जनयमों में अंतर्ववष्ट दकसी बात के होते हुए भी, केवल वे व्यजि िो केंरीय सिस्त्र

पुजलस बलों की स्ट्वास्ट््य िेखभाल प्रणाली में यथा जवजनर्िवष्ट जचदकत्सा प्रवगव िेप-I में हैं। प्रोन्नजत और जनयुजि जिसके

अंतगवत इन जनयमों के उपबंधों के अधीन प्रजतजनयुजि या पुनर्नवयोिन पर जनयुजि भी है, के जलए पात्र होंगे।

वररष्ठता.— वररष्ठता जनम्नजलजखत जसद्धातों के अनुसार अवधाररत होगी अथावत ः-

(i) दकसी सारभूत हैजसयत में जनयुि कोई अजधकारी स्ट्थानापन्न हैजसयत में जनयुि दकए गए दकसी अजधकारी से

वररष्ठ होगा,

(ii) दकसी सारभूत हैजसयत में दकसी पि पर जनयुि दकए गए अजधकाररयों की वररष्ठता उस पि पर अजधष्ठायी

हैजसयत में उनकी जनयुजि की तारीख के अनुसार अवधाररत होगी और िहां िो या अजधक अजधकारी एक

ही तारीख को सारभूत हैजसयत में जनयुि दकए िाते हैं, वहीं उनकी वररष्ठता दकसी स्ट्थानापन्न हैजसयत में

ऐसे पि धारण करते समय उनकी वररष्ठता के अनुसार अवधाररत होगी; और

(iii) वररष् ठता के अवधारण के प्रयोिन के जलए तिथव/ स्ट्थानापन्न आधार पर सेवा के जलए कोई बल नही दिया

िाता है और वररष्ठता सारभूत जनयुजि की तारीख से गणना की िाती है।

सेवा की अन्‍दय ितें.— ऐसे जवषयों के संबंध में जिनके बारे में इन जनयमों के अधीन कोई उपबंध नहीं दकए गए हैं

या अपयावप्त उपबंध हैं, अपर िि अटनी िनरल (कमांडेंट), वररष् ठ उप िि अटनी िनरल (जद्वतीय कमान) की सेवा ितें िब

तक दक केंरीय सरकार जलजखत में दकसी आिेि द्वारा अन्‍दयथा जनिेि न िें, वही होंगी िो भारत जतब्बत सीमा पुजलस बल के

ऐसे अन्‍दय अजधकाररयों िो तत्समान रैंक या प्राजस्ट्थजत धारण दकए हुए हैं, के जलए समय-समय पर लागू होती हैं।

जनरहवता.— वह व्यजि,-

(क)

जिसने ऐसे व्यजि से जिसका पजत या जिसकी पत्नी िीजवत है, जववाह दकया है, या जववाह की संजविा की

है, या

(ख)

जिसने अपने पजत या अपनी पत्नी के िीजवत रहते हुए दकसी व्यजि से जववाह दकया है, या जववाह की

संजविा की है।

उि पिों में से दकसी पि पर जनयुजि का पात्र नहीं होगा:

परन्‍दतु यदि केंरीय सरकार का यह समाधान हो िाता है दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्‍दय पिकार

को लागू स्ट्वीय जवजध के अधीन अनुज्ञेय है और ऐसा करने के जलए अन्‍दय आधार हैं तो वह दकसी व्यजि को इस जनयम के

प्रवतवन से छूट िे सकेगी।

जिजथल करने की िजि.— िहााँ केंरीय सरकार की यह राय है दक ऐसा करना

आवश् यक या समीचीन है,

वहााँ वह उसके जलए िो कारण हैं उन्‍दहें लेखबद्ध करके, इन जनयमों के दकसी उपबंध को दकसी वगव या प्रवगव के व्यजियों की

बाबत, आिेि द्वारा जिजथल कर सकेगी।

जविेजियों की अपात्रता.— कोई व्यजि, िो भारत का नागररक नहीं है, जलजखत में केन्‍दरीय सरकार की पूवव अनुमजत

के जसवाय, इन जनयमों के अधीन जनयुि नहीं दकया िाएगा:

परंतु इन जनयमों में अंतर्ववष्ट दकसी बात के होते हुए भी नेपाल या भूटान के नागररकों की जनयुजि या जनयोिन को

वर्िवत नहीं करेगी।

11.

अजधवर्षवता.— (1) ऐसे अजधकारी िो अपर िि अटनी िनरल (कमांडेंट) और वररष् ठ उप िि अटनी िनरल

(जद्वतीय कमान) का पि धारण दकए हुए हैं, उस मास के जिसमें वह साठ वषव की आयु प्राप्त करते हैं, अंजतम दिन के अपराह्न

में सेवाजनवृत होंगे।

परंतु कोई जिसके िन्‍दम की तारीख दकसी मास की पहली तारीख है, वे सेवाजनवृजत्त की आयु अथावत साठ वषव प्राप्त

करने के पूववती मास के अंजतम दिन के अपराह्न में सेवाजनवृत्त होंगे।

(2) दकसी भी व्यजि को अजधवर्षवता पर सेवाजनवृजत के जलए जवजहत आयु के पश्चात सेवा जवस्ट्तार प्रिान नहीं दकया

िाएगा।

12.

व्यावृजत.— इन जनयमों की कोई बात, ऐसे आरिण, आयु सीमा में छूट और अन्‍दय ररयायतों पर प्रभाव नहीं

डालेगी, जिनका केंरीय सरकार द्वारा इस संबंध में समय-समय पर िारी दकए गए आिेिों के अनुसार अनुसूजचत िाजतयों,

अनुसूजचत िनिाजतयों, अन्‍दय जपछडे वगों, भूतपूवव सैजनकों और अन्‍दय जविेष प्रवगव के व्यजियों के जलए उपबंध करना अपेजित

है।

जवजधक या न्‍द यायालय मामलों से जनपटने का पंरह वषव का अनुभव हो और उन्‍द होंने केन्‍द रीय सरकार द्वारा जवजनर्िवष्ट पूवव

प्रोन्‍द नजत पाठ्यक्म सफलतापूववक पूरा कर चुके हों।

रटप् पण 1: सीधे जनयुक् त उप सेनानी िि अटनी िनरल (उप सेनानी ) के मामले में समूह 'क' में सेवा पंरह वषव की अपेिा

िस वषव होगी। (चूंदक ऐसे अजधकाररयों की सेवा में समूह 'क' की कजल्पत सेवा के पांच वषव उनकी जनयुजि की तारीख से

िोडे िाते हैं)

रटप् पण 2: िहां ऐसे कजनष् ठ व् यजियों के संबंध में, जिन्‍द होंने अपनी अहवक/ पात्रता सेवा पूरी कर ली है, प्रोन्‍द नजत के जलए

जवचार दकया िा रहा हो िहां उनसे ज् येष् ठ व् यजियों के संबंध में भी जवचार दकया िाएगा परंतु यह तब िब दक उनके द्वारा

की गई अहवक या पात्रता सेवा, अपेजित अहवक या पात्रता सेवा के आधे से अजधक से या िो वषव से, इनमें से िो भी कम हो,

कम न हो और उन्‍द होंने अपने ऐसे कजनष् ठ व् यजियों सजहत जिन्‍द होंने ऐसी अहवक/ पात्रता सेवा पहले ही पूरी कर ली है अगली

उच् चतर श्रेणी में प्रोन्‍द नजत के जलए अपनी पररवीिा की अवजध सफलतापूववक पूरी कर ली हो।

प्रजतजनयुजि द्वारा :

ऐसे व्यजि िो

(i) केन्‍द रीय सैन्‍द य पुजलस बल में वेतन मैररक्स स्ट् तर-13 (रू.123100-215900) में सेनानी अथवा समकि पि पर

तैनात हों तथा दकसी मान्‍दयता प्राप्त जवश्वजवद्यालय से जवजध स्ट् नात्तक हो और जवजधक मामलों तथा न्‍द यायालय

मामलों के जनपटान का पंरह वषों का अनुभव हो; अथवा

(ii) सेना या नौसेना या वायु सेना में िि एडवोकेट िनरल जवभाग में कनवल या समकि रैंक का अजधकारी हो,

अथवा सेना या वायु सेना में िि एडवोकेट िनरल जवभाग में लेजटटनेंट कनवल या समकि/नौसेना अजधकारी

जिसने कम से कम पंरह वषव की कमीिन सेवा पूणव कर ली हो, रैंक का अजधकारी; अथवा

(iii) केन्‍द रीय सैन्‍द य पुजलस बल में वेतन मैररक्स स्ट् तर-12 (78800-209200) में जद्वतीय कमान अथवा समकि पि

पर पांच वषों की सेवा तथा समूह ‘क’ में 15 वषों की जनयजमत सेवा पूणव कर ली हो तथा दकसी मान्‍द यता

प्राप् त जवश् वजवद्यालय से जवजध स्ट् नातक या समकि हों तथा उन्‍द हें बल के जवजध संबंधी मामलों के जनपटान का

पंरह वषों का अनुभव हो; अथवा

(iv) केंरीय या राज्य न्‍दयाजयक सेवा में वेतन मैररक्स स्ट् तर -12 (रू.78800-209200) में पांच वषव की जनयजमत

सेवा तथा समूह ‘क’ में 15 वषों की जनयजमत सेवा पूणव कर ली हो तथा दकसी मान्‍द यता प्राप् त जवश् वजवद्यालय

या समकि से जवजध स्ट् नातक हो तथा समूह ‘ क’ में 15 वषों की जनयजमत सेवा पूणव कर ली हो ।

रटप्पण 1: प्रजतजनयुजि की अवजध, जिसके अंतवगत केंरीय सरकार के उसी या दकसी अन्‍दय संगठन या जवभाग में इस जनयुजि

से ठीक पहले धाररत दकसी अन्‍दय काडर बाह्य पि पर प्रजतजनयुजि की अवजध है साधारणतया 5 वषव से अजधक नहीं होगी।

रटप्पण 2: प्रजतजनयुजि पर जनयुजि के जलए अजधकतम आयु सीमा आवेिन प्राप्त करने की अंजतम तारीख को 56 वषव से

अजधक नहीं होगी।

रटप्पण 3: प्रजतजनयुजि पर जनयुजि के जलए फीडर श्रेणी के ऐसे जवभागीय अजधकारी पात्र नहीं होंगे, जिनकी पिोन्‍द नजत होने

वाली है।

भूतपूवव सैजनको के जलए: प्रजतजनयुजि और पुनर्नवयोिन

सिस्ट् त्र बल के ऐसे कार्मवकों के संबंध में भी जवचार दकया िाएगा िो एक वषव की अवजध के भीतर सेवाजनवृत्त होने वाले

हैं या ररिवव में स्ट् थानांतररत दकए िाने वाले हैं और जिनके पास अपेजित अनुभव और जवजहत अहवताएं हैं।

परन्‍दतु ऐसे व्यजियों को उस तारीख तक प्रजतजनयुजि के जनबंधनों पर रखा िाएगा, जिस तारीख से उन्‍दहें सिस्त्र बलों से

जनमुवि दकया िाना है, तत्पश्चात उन्‍दहें पुनर्नवयोिन पर बने रहने दिया िा सकता है।

यदि जवभागीय प्रोन्‍द नजत सजमजत है, तो उसकी संरचना।

भती करने में दकन पररजस्ट्थजतयों में

NOTIFICATION

New Delhi, the 19th January, 2023

G.S.R. 32(E).—In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the

Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), and in supersession of the Indo-Tibetan Border Police

Force, Judge Attorney General, Additional Judge Attorney General, Deputy Judge Attorney General andJudge

Attorney Group ‘A’ Posts Recruitment and Conditions of Service Rules, 2019 in so far as it relates to the post of

Additional Judge Attorney General (Commandant), except as respects things done or omitted to be done before such

supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the

posts of Additional Judge Attorney General (Commandant), Senior Deputy Judge Attorney General (Second-in-

Command), Group ‘A’ posts in the Indo-Tibetan Border Police Force, under the Ministry of Home Affairs, namely :-

Short title and commencement.— (1) These rules may be called the Indo-Tibetan Border Police Force,

Additional Judge Attorney General (Commandant), Senior Deputy Judge Attorney General (Second-in-Command),

Group ‘A’ Posts, Recruitment Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

Application.- These rules shall apply to the posts specified in Column (1) of the Schedule annexed to these

rules.

Number of posts, classification and level in the pay matrix.— The number of said post, its classification

and the pay matrix or pay scale and level in the pay matrix attached thereto, shall be as specified in Columns (2) to (4)

of the Schedule annexed to these rules.

Method of recruitment, age limit and other qualifications, etc.- The method of recruitment, age limit,

qualifications and other matters relating thereto, shall be as specified in Columns (5) to (13) of the aforesaid Schedule.

Medical Fitness.- Notwithstanding anything contained in these rules, only those persons who are in medical

category SHAPE-I, as specified in Health Care System in Central Armed Police Forces, shall be eligible for

appointment and promotion including appointment by deputation or re-employment under the provisions of these

rules.

Seniority.-The seniority shall be determined in accordance with the following principles, namely:-

(i)

an officer appointed in a substantive capacity shall be senior an officer appointed in an officiating

capacity ;

(ii)

seniority of officers appointed to any post in a substantive capacity shall be determined in

accordance with the date of appointment to that post in a substantive capacity and where two or

more officers are appointed in a substantive capacity on the same date, their seniority shall be

determined in accordance with their seniority while holding such posts in an officiating capacity ;

and

(iii)

no weightage is to be given for service rendered on ad-hoc/officiating basis for the purpose of

determination of seniority and seniority is to be counted from the date of substantive appointment.

Other conditions of Service.-The conditions of service of the Additional Judge Attorney General

(Commandant) and Senior Deputy Judge Attorney General (Second-in-Command) in respect of matters for which no

provision or insufficient provision has been made under these rules, shall, unless the Central Government, by an order

in writing, otherwise directs, be the same as are applicable from time to time to other officers of the Indo-Tibetan

Border Police Force holding the corresponding ranks or status.

Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt

any person from the operation of this rule.

Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

10.

Ineligibility of non-citizens of India.- No person who is not a citizen of India shall, except with the prior

permission of the Central Government in writing, be appointed under these rules:

Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal

or Bhutan in the Force.

11.

Superannuation.- Officers holding the rank of Additional Judge Attorney General (Commandant) and Senior

Deputy Judge Attorney General (Second-in-Command) shall retire from service in the afternoon of the last day of the

month in which they attain the age of sixty years.

Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon

of the last day of the preceding month on attaining the age of superannuation i.e. sixty years.

12.

Saving.- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-

servicemen and other special categories of persons, in accordance with the orders issued by the Central Government.

From amongst Senior Deputy Judge Attorney General (Second-in-Command) of Indo-Tibetan Border Police

Force in level-12 (Rs. 78800-209200) in the pay matrix having five years regular service in the grade, with fifteen

years Group 'A' service and having minimum fifteen years experience in dealing with legal matters or court cases and

having successfully completed the pre-promotional courses specified by the Central Government.

Note 1:- The requirement of fifteen years of Group 'A' service, in the case of directly appointed Deputy Judge

Attorney General (Deputy Commandant) shall be ten years.

(since five years of notional service in Group 'A' is added to the service of such officers, on the date of their

appointment)

Note 2:- Where juniors who have completed their qualifying or eligibility service are being considered for promotion,

their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by

more than half of such qualifying or eligibility service of two years, whichever is less and have successfully

completed their probation period for promotion to the next higher level in the pay matrix along with their juniors who

have already completed such qualifying or eligibility service.

By Deputation:

A person who -

(i) is serving in Central Armed Police Force and holding post of Commandant or equivalent in level-13 (Rs.

123100-215900) in the pay matrix with degree in Law from a recognised University or equivalent and having

fifteen years experience in dealing with legal matters or Court cases; or

(ii) is an officer of the rank of Colonel or equivalent in the Department of Judge Advocate General in Army or

Navy or Air Force; or an officer of the rank of Lieutenant Colonel or equivalent in the Department of Judge

Advocate General in Army or Navy or Air Force with minimum fifteen years of commissioned service; or

(iii) is serving in Central Armed Police Force and holding post of Second-in-Command or equivalent in level-

12 (Rs. 78800-209200) in the pay matrix with five years regular service in the grade with minimum fifteen

years of regular Group 'A' service and having degree in law from a recognised University or equivalent and

having fifteen years experience in dealing with legal matters and Court cases; or

(iv) is a member of Central or of the State Judicial Service in Level-12 (Rs. 78800-209200) in the pay matrix

with five years regular service in the grade and having degree in law from a recognised University or

equivalent with minimum fifteen years of regular Group 'A' service.

Note 1:- The period of deputation including the period of deputation in another ex-cadre post held immediately

preceding this appointment in the same or some other organisation/ department of the Central Government

shall ordinarily not exceed five years.

Note 2:- The maximum age limit for eligibility for deputation shall not be exceeding fifty-six year on the date

of receipt of application.

Note 3:- The departmental officers in the feeder category who are in the direct line of promotion shall not be

eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for

consideration for appointment by promotion.

For Ex-serviceman deputation/re-employment

The Armed Forces personnel due to retire or who are to be transferred to reserve with in a period of one year

and having requisite experience and qualifications prescribed for deputationists shall also be considered.

Provided that such persons would be given deputation terms up to the date on which they are due to be released from

Armed Forces and thereafter they may be continued on re-employment.

If a departmental Promotion Committee exists, what is its composition Circumstances in which the Union

Public Service Commission is to be

consulted in making recruitment.
