का.अ. 339(ऄ).—भारत सरकार ने पेरोजलयम और खजनज पाआपलाआन (भूजम में ईपयोग के ऄजधकार का ऄजजन)

ऄजधजनयम, 1962 (1962 का 50) (जजसे आसमें आसके पश्चात् ईक्त ऄजधजनयम कहा गया है) की धारा 3 की ईपधारा (1) के

ऄधीन जारी भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का.अ. 299(ऄ) तारीख

17.01.2022 जो भारत के ऄसाधारण राजपत्र तारीख 24.01.2022, में प्रकाजित की गयी थी, द्वारा ईस ऄजधसूचना से

संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में गेल (आजण्डया) जलजमटेड द्वारा महाराष्ट्र राज्य में ईरण – ईसर प्रोपेन पाआपलाआन के

माध्यम से प्राकृजतक गैस के पररवहन के जलए पाआपलाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार का ऄजजन करने

के ऄपने अिय की घोषणा की थी;

और ईक्त राजपत्र ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी गइ थी;

और सक्षम प्राजधकारी ने जनता से प्राप्त अक्षेपों को परीक्षण के ईपरांत जनपटान कर ददया है;

और सक्षम प्राजधकारी ने, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन भारत सरकार को ऄपनी ररपोटज

दे दी है;

और भारत सरकार ने, ईक्त ररपोटज पर जवचार करने के पश्चात् और यह संतुष्ट हो जाने पर दक ईक्त भूजम

पाआपलाआन जबछाने के जलए ऄपेजक्षत है, ईस में ईपयोग के ऄजधकार का ऄजजन करने का जवजनश्चय दकया है;

ऄतः ऄब, भारत सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत्त्त िजक्तयों का प्रयोग करते हुए,

यह घोषणा करती है दक आस ऄजधसूचना से संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में पाआपलाआन जबछाने के जलए ईपयोग के

ऄजधकार का ऄजजन दकया जाता है;

और, भारत सरकार, ईक्त ऄजधजनयम की धारा 6 दक ईपधारा (4) द्वारा प्रदत्त्त िजक्तयों का प्रयोग करते हुए,

जनदेि देती है दक पाआपलाआन जबछाने के जलए भूजम में ईपयोग का ऄजधकार, आस घोषणा के प्रकािन की तारीख से, भारत

सरकार में जनजहत होने के बजाए, सभी जवल्लंगमों से मुक्त होकर, गेल (आजण्डया) जलजमटेड में जनजहत होगा।

NOTIFICATION

New Delhi, the 19th January, 2023

S.O. 339(E).— Whereas by Notification of Government of India, in Ministry of Petroleum & Natural Gas

vide S.O.No 299 (E) dated 17.01.2022; issued under sub - section (1) of section 3 of the Petroleum & Minerals

Pipelines (Acquisition of right of users in land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act),

published in the Extra Ordinary Gazette of India dated 24.01.202, the Government of India declared its intention to

acquire the right of user in the lands specified in the Schedule appended to that notification for the purpose of laying

Pipeline for transportation of natural gas through Uran – Usar Propane pipeline in the State of Maharashtra by GAIL

(India) Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the objections received from the public to the laying of the pipeline have been considered of by

the Competent Authority;

And whereas the Competent Authority has, under sub-section (1) of section (6) of the said Act, submitted its

report to Government of India;

And whereas Government of India after considering the said report and on being satisfied that the said land is

required for laying the pipeline, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by sub section (1) of section (6) of the said Act, the

Government of India hereby declares that the Right of User in the said lands specified in the Schedule appended to

this notification is hereby acquired for laying the pipeline;

And, further, in exercise of powers conferred by sub section (4) of the Section (6) of the said Act,

Government of India hereby directs the Right of User in the land for laying the pipeline shall, instead of vesting in

Government of India, vest, on the this date of the publication of the declaration, in the GAIL (India) Limited, free

from all encumbrances.
