अ.आ. 1(अ).—लोक प्रजतजिजधत् र् अजधजियम, 1951 की धारा 60 के खंड(ग) के उपबंधों के अिुसरण में जिर्ााचि

आयोग एतद्द्वारा जर्जिर्िाष् ट करता है दक सक्षम प्राजधकारी द्वारा प्रमाजणत कोजर्ड-19 संदिग् ध या प्रभाजर्त ऐसे व् यजि, िो

डाक मतपत्र द्वारा मतिाि करिे के जलए आर्ेिि करते हैं और िो संबंजधत ररटर्ििंग अजधकारी द्वारा उसके अिुरोध के

सत् यापि की िता के अधीि हैं, जिर्ााचिों का संचालि जियम, 1961 के भाग-IIIक, जर्जध एर्ं न् याय मंत्रालय, भारत

सरकार की अजधसूचिा का.आ.सं. 1964 (अ.) दििांक 19 िूि, 2020 के िररए यथासंिोजधत, इस जर्षय पर जिर्ााचि

आयोग द्वारा जिगात जििेिों एर्ं दििाजििेिों के साथ परित, के अिुसार लोक प्रजतजिजधत् र् अजधजियम, 1951 की धारा 30

के अंतगात अजधसूजचत होिे र्ाले केंद्र िाजसत प्रिेि लक्षद्वीप के संसिीय जिर्ााचि क्षेत्र एर्ं अरुणाचल प्रिेि, झारखंड,

तजमलिाडु, पजिम बंगाल एर्ं महाराष्ट्र के जर्धािसभा जिर्ााचि क्षेत्रों के जलए चल रहे उप जिर्ााचिों में डाक मतपत्र द्वारा

मतिाि करिे के जलए व् यजियों की एक श्रेणी होंगे।

र्ररष्ठ िागररकों, दिव्ांगििों और कोजर्ड-19 के संदिग्ध एर्ं प्रभाजर्त व्जियों की श्रेणी में अिुपजस्ट्थत मतिाताओं द्वारा

डाक मतपत्र के िररए मतिाि के जलए दििा-जििेि

1. जिर्ााचिों का संचालि (संिोधि) जियम, 2019, और जिर्ााचि आयोग के दििांक 16 िुलाई, 2020 के जिणाय के

साथ परित जिर्ााचिों का संचालि (संिोधि) जियम, 2020 के अिुसरण में अिुपजस्ट्थत मतिाताओं की

जिम्नजलजखत श्रेजणयों को डाक मतपत्र (पीबी) के माध्यम से मतिाि की सुजर्धा िी गई है:

(i)

र्ररष्ठ िागररक (80 र्षा से अजधक आयु के),

(ii)

जिर्ााचक िामार्ली में इंजगत दकए गए दिव्ांगिि, और

(iii)

कोजर्ड-19 के संदिग्ध एर्ं प्रभाजर्त व्जि।

2. अिुपजस्ट्थत मतिाताओं द्वारा डाक मतपत्र (पीबी) का आर्ेिि करिे हेतु प्रदिया

(2.1) डाक मतपत्र द्वारा मतिाि करिे के इच्छुक दकसी भी अिुपजस्ट्थत मतिाता को संबंजधत जिर्ााचि क्षेत्र के

ररटर्ििंग अजधकारी (आरओ) को सभी आर्श्यक जर्र्रण िेते हुए, प्रपत्र 12-घ में आर्ेिि करिा पड़ता है। डाक

मतपत्र की सुजर्धा की अपेक्षा र्ाला ऐसा आर्ेिि संबंजधत जिर्ााचि की अजधसूचिा की तारीख के बाि पांच दििों

के भीतर आरओ तक पहुंच िािा चाजहए।

(2.2) जिर्ााचि का संचालि जियम, 1961 के जियम 27ड. और 27-झ के तहत संिोजधत प्रार्धािों के अिुसार, अिुपजस्ट्थत

मतिाता को डाक मतपत्र िारी करिे और मतिाि के बाि मत पत्र की र्ापसी का काया आयोग द्वारा यथाजििेजित

रीजत से दकया िाएगा। तििुसार, आयोग िे र्ररष्ठ िागररक श्रेणी के अिुपजस्ट्थत मतिाताओं (एर्ीएससी),

दिव्ांगिि (पीडब्लल्यूडी) श्रेणी के अिुपजस्ट्थत मतिाताओं (एर्ीपीडी) और कोजर्ड-19 श्रेणी से संबंजधत अिुपजस्ट्थत

मतिाताओं (एर्ीसीओ) द्वारा डाक मतपत्रों के माध्यम से मतिाि की सुजर्धा के जलए जिम्नजलजखत

प्रदिया/दििाजििेि जिधााररत दकए हैं।

(2.3) यदि जिर्ााचि के समय कोई भी जिर्ााचक कोजर्ड-19 की र्िह से राज्य के भीतर अस्ट्पताल में भती है, अथर्ा

कोजर्ड-19 की र्िह से होम/संस्ट्थागत संगरोध (क्वारंटीि) में है और पररणामस्ट्र्रूप जचदकत्सीय सलाह के अिुसार

मतिाि केंद्र में व्जिगत रूप से मत डालिे की जस्ट्थजत में िहीं है और यदि ऐसा जिर्ााचक डाक मतपत्र िारी करिे

के जलए अिुरोध करता है, तो आर्ेिि की र्ास्ट्तजर्कता के बारे में समाधाि हो िािे पर संबंजधत ररटर्ििंग अजधकारी

(आरओ), जिर्ााचक को डाक मतपत्र प्रिाि करेगा। ररटर्ििंग अजधकारी (आरओ) डाक मतपत्र पहुंचािे और जिर्ााचि

क्षेत्र में मतिाि के जलए जियत जतजथ से पहले उि जिर्ााचक से इसे र्ापस मंगर्ािे की व्र्स्ट्था करेगा। यह व्र्स्ट्था

आयोग के जििेिों पर मुख्य सजचर् द्वारा िाजमत कोजर्ड-19 के िोडल अजधकारी के समन्र्य में की िाएगी। ऐसे

जिर्ााचकों से डाक मतपत्र के जलए आर्ेिि (प्रपत्र 12-घ) के साथ सक्षम स्ट्र्ास्ट््य प्राजधकाररयों से प्रमाण-पत्र/जििेिों

की प्रजतजलजप संलग्न होिी चाजहए, जिसमें यह ििााया गया हो दक आर्ेिक कोजर्ड-19 की र्िह से राज्य में

अस्ट्पताल में भती है या राज्य के भीतर संगरोध (क्वारंटीि) (गृह या संस्ट्थागत) में है।

(2.4) डाक मतपत्र का जर्कल् प चुििे र्ाले दिव् यांग श्रेणी (एर्ीपीडी) मतिाताओं के मामले में आर्ेिि (प्ररूप 12घ) के

साथ दिव् यांगिि अजधकार अजधजियम, 2016 की धारा 2 के तहत संबंजधत प्रमाणि प्राजधकारी द्वारा प्रमाजणत

बेंचमाका अिक् तता प्रमाणपत्र (जिर्िाष् ट अिक् तता के 40% से कम िहीं) की प्रजत संलग् ि होिी चाजहए।

3. ररटर्ििंग अजधकारी द्वारा कारार्ाई-

(3.1) बीएलओ के द्वारा प्ररूप 12घ का जर्तरण:

(क) बीएलओ मतिाि केंद्र क्षेत्र में आरओ द्वारा प्रिाि दकए गए जर्र्रण के अिुसार एर्ीएससी, एर्र्ीपीडी और

एर्ीसीओ की श्रेणी में अिुपजस्ट्थत मतिाताओं के घरों का िौरा करेगा और संबंजधत जिर्ााचकों को प्ररूप 12घ

जर्तररत करेगा और उिसे पार्ती प्राप् त करेगा।

(ख) बीएलओ जिर्ााचकों से प्राप् त सभी पार्जतयां आरओ के पास िमा करेगा।

(ग) यदि कोई जिर्ााचक उपलब्ल ध िहीं है तो बीएलओ अपिा सम् पका जर्र्रण साझा करेगा और अजधसूचिा की

तारीख के बाि पांच दििों की अर्जध के भीतर उसे प्राप् त करिे के जलए दफर से िाएगा।

(घ) जिर्ााचक डाक मतपत्र को चुि सकते हैं या िहीं चुि सकता है। यदि र्ह डाक मतपत्र का जर्कल् प चुिता है तो

बीएलओ भरे हुए प्ररूप 12घ को मतिाता के घर से एकत्र करेगा और अजधसूचिा की तारीख के बाि पांच

दििों की अर्जध के भीतर आरओ के पास िमा करेगा।

(ड.) सेक् टर अजधकारी आरओ के समग्र पयार्ेक्षण में बीएलओ द्वारा प्ररूप 12घ के जर्तरण और संग्रह की प्रदिया

का पयार्ेक्षण करेगा।

(3.2) ररटर्ििंग अजधकारी (आरओ) 3 श्रेजणयों अथाात (क) 'एर्ीएससी', (ख) 'एर्ीपीडी' और (ग) 'एर्ीसीओ' में ऐसे सभी

अिुपजस्ट्थत मतिाताओं की सूची (अिुलग्नक–1 के अिुसार फामेट) तैयार करेगा, जििके आर्ेिि पत्र समय पर जमल

गए हैं और पूरी तरह से िीक हैं।

(3.3) जिर्ााचि के जलए िामजििेिि करिे की अंजतम तारीख को उस जिर्ााचि जर्िेष के जलए जिर्ााचक िामार्ली जस्ट्थर

(फ्रोिि) कर िी िाती है और जिर्ााचि पूरा होिे तक उस िामार्ली में और िाम िोड़िे अथर्ा हटािे संबंधी कोई

काया िहीं दकया िाता है। इस चरण पर, ररटर्ििंग अजधकारी(आरओ) यह सत्याजपत और सुजिजित करेगा दक डाक

मतपत्र र्ाले आर्ेिक जिर्ााचक के रूप में पंिीकृत हों तथा प्रपत्र 12–घ में उिके जिर्ााचि संबंधी जर्र्रण मौिूिा

जिर्ााचक िामार्ली के संिभाािुसार सही हों। जिर्ााचक िामार्ली के संिभाािुसार सही जर्र्रण पाए िािे र्ाले सभी

जिर्ााचकों को एर्ीएससी और एर्ीपीडी की श्रेणी में अिुपजस्ट्थत मतिाताओं के रुप में डाक मतपत्र िारी दकए

िाएंगे। यदि अिुपजस्ट्थत मतिाता कोजर्ड-19 (एर्ीसीओ) की श्रेणी से संबंजधत हों, तो डाक मतपत्र के जलए प्रपत्र

12घ अिुमोदित करिे से पहले ररटर्ििंग अजधकारी राज्य सरकार/संघ राज्य क्षेत्र प्रिासि द्वारा जर्जधर्त जियुि

दकए गए सक्षम प्राजधकारी के प्रमाणपत्र की इस आिय से िांच करेगा दक जिर्ााचक कोजर्ड–19 की र्िह से गृह

संगरोध (होम क्वारंटीि) अथर्ा संस्ट्थागत संगरोध(क्वारंटीि) में हो।

(3.4) ररटर्ििंग अजधकारी (आरओ) ऐसे जिर्ााचकों के िामों के सामिे जिर्ााचक िामार्ली की जचजनित प्रजत में यह ििाािे

के जलए प्रजर्जि 'पीबी' भी करेगा दक उन्हें एक डाक मतपत्र िारी कर दिया गया है, परंतु उसमें र्ह उन्हें िारी दकए

गए मत पत्र की िम संख्या ििा िहीं करेगा।

(3.5) ररटर्ििंग अजधकारी(आरओ) यह भी सुजिजित करेगा दक ऐसे जिर्ााचक, जिन्हें डाक मतपत्र िारी कर दिए गए हैं, र्े

मतिाि केंद्र पर मतिाि करिे हेतु अिुमत्य िहीं है।

(3.6) इसके अलार्ा, आरओ मान् यताप्राप् त राििैजतक िलों के जिर्ााचि लड़िे र्ाले अभ् यर्थायों के साथ मुदद्रत हाडाकॉपी में

ऐसे सभी दिव् यांग और 80+ जिर्ााचकों की सूची साझा करेगा जििके डाक मतपत्र सुजर्धा का लाभ उिािे के जलए

प्ररूप 12घ में आर्ेिि उसके द्वारा अिुमोदित दकए गए हैं।

4. डाक मत पत्र का प्ररूप और जडिाइि

अिुपजस्ट्थत मतिाताओं के जलए डाक मतपत्र का प्ररुप और भाषा र्ैसी ही होगी िैसी जिर्ााचि ड्यूटी पर

मतिाताओं के जलए डाक मतपत्र की होती है। इस संिभा में, जिर्ााचि ड्यूटी पर मतिाताओं के जलए डाक मतपत्र के प्रपत्र के

संबंध में आयोग के दििांक 18 जसतंबर, 2015 के दििाजििेि सं. 52/2015/एसडीआर/खंड 1 और दििांक 24 फरर्री,

2016 के दििाजििेि सं. 52/2016/एसडीआर/खंड 1 का अर्लोकि करें।

5. मतिाि पिाजधकाररयों का िौरा, जिर्ााचकों को िािकारी िेिा और जचजनित मतपत्रों को एकत्र करिााः-

(5.1) इस प्रयोििाथा मतिाि अजधकाररयों की अलग टीमों की जियुजि की िािी चाजहए, जििमें िो पिाजधकारी

िाजमल होंगे और इसमें से कम से कम एक पिाजधकारी, राज्य में मतिाि केंद्र के जलए मतिाि अजधकारी के रूप में

जियुि दकए गए पिाजधकारी के रैंक/स्ट्तर से कम ि हो। मतिाि अजधकाररयों की टीम के साथ एक माइिो प्रेक्षक

भी िाएंगे।

(5.2) जियुि दकए िािे र्ाले मतिाि पिाजधकाररयों की टीमों की संख्या जिर्ााचि-क्षेत्र में उि अिुपजस्ट्थत मतिाताओं

की संख्या पर जिभार करेगी, जिन्हें डाक मतपत्र िारी दकए गए हैं।

(5.3) मतिाि पिाजधकाररयों की टीम जिर्ााचकों द्वारा प्रपत्र 12घ में अपिे आर्ेिि पत्रों में उजल्लजखत पते पर जिर्ााचकों

से जमलेगी, तादक उन्हें डाक मतपत्र द्वारा मतिाि करिे में सुजर्धा प्रिाि की िा सके।

(5.4) जिर्ााचकों को मतिाि पिाजधकाररयों के िौरे की तारीख और अिुमाजित समय के बारे में पहले से ही सूजचत दकया

िाएगा। ऐसी सूचिा प्रपत्र 12घ में आर्ेिि पत्र में उजल्लजखत दकए गए मोबाइल फोि, यदि उपलब्लध करर्ाया

गया हो, पर एसएमएस के िररए िी िाए। अन्य मामलों में, डाक द्वारा और/अथर्ा बीएलओ के माध्यम से सूचिा

िी िाए।

(5.5) यदि प्रथम िौरे के समय जिर्ााचक प्रपत्र में दिए गए पते पर मौिूि िहीं जमलता है, तो टीम अपिे िूसरे िौरे के

समय के बारे में सूचिा िेते हुए अपिा िूसरा िौरा करेगी। यदि जिर्ााचक िूसरे िौरे के समय भी मौिूि िहीं

जमलता है, तो उसके मामले में आगे कोई भी कारार्ाई अथर्ा िौरा अपेजक्षत िहीं होगा।

(5.6) अभ्यर्थायों को इस श्रेणी के डाक मतपत्र िेिे और एकजत्रत दकए िािे के जलए िौरे के कायािम की सूचिा िी िाएगी।

यदि र्े चाहें, तो प्रदिया पर िज़र रखिे के जलए ररटर्ििंग अजधकारी को पूर्ा सूचिा िेकर अपिे प्राजधकृत

प्रजतजिजधयों (बीएलए सजहत) को प्रजतजियुि कर सकते हैं।

(5.7) एर्ीएससी, एर्ीपीडी और एर्ीसीओ जिर्ााचकों की सूची जिर्ााचि अजधकाररयों के जर्जभन्न टीमों में जर्तररत दकए

िािे हेतु इस तरह से बांटी िाएगी दक प्रत्येक टीम को सुगरित भौगोजलक क्षेत्र में व् यजक् तयों की सूची जमले।

(5.8) िौरे पर िािे र्ाले मतिाि अजधकारी डाक मतपत्र िारी करिे से पहले जिर्ााचक की पहचाि सुजिजित करेंगे।

(5.9) जिर्ााचक का िाम और पहचाि के जलए प्रस्ट्तुत िस्ट्तार्ेि की प्रजर्जि इस प्रयोिि के जलए बिाए गए एक रजिस्ट्टर

(अिुबंध-2 के रूप में संलग्न) में भी ििा की िाएगी और उसमें जिर्ााचक के हस्ट्ताक्षर/अंगूिे का जििाि जलया

िाएगा।

इसके अलार्ा, यह ििाािे के जलए दक व्जि िे र्ोट िे दिया है, एर्ीएससी, एर्ीपीडी और एर्ीसीओ की सूची में

जिर्ााचक के िाम के सामिे सही का जििाि लगाया िाएगा। जर्जधर्त भरी गई जिर्ााचक की िम संख्या और भाग

संख् या सजहत काउन् टरफॉइल को अलग दकया िाएगा और टीम द्वारा सुरजक्षत रखा िाएगा।

(5.10) मतिाि अजधकाररयों के प्रत्येक टीम की यह जिम्मेिारी होगी दक (क) र्े उन्हें जिर्िाि प्रत्येक अिुपजस्ट्थत मतिाताओं

के जलए डाक मतपत्र िारी करें, (ख) डाक मतपत्र के द्वारा मतिाि करिे के जलए अपिाई िािे र्ाली प्रदिया के

बारे में जिर्ााचक को बताएं, (ग) यह सुजिजित करिा दक जिर्ााचक को अपिी पसंि से मतिाि करिे में कोई

प्रभाजर्त ि करे, और और संबंजधत जिर्ााचक के पते पर सभी गजतजर्जधयों में मतिाि की गोपिीयता सुजिजित

रहे। तथाजप, यदि कोई जिर्ााचक िृजिहीिता या िारीररक जिबालताओं के कारण अपिा मत िेिे में समथा िहीं है

तो मतिाि करिे के जलए उसे दकसी र्यस्ट् क व् यजि की सहायता लेिे की अिुमजत िी िाएगी। इस मामले में

जिर्ााचि संचालि जियम, 1961 के जियम 49ढ़ के सभी प्रार्धाि लागू होंगे। साथी को आयोग द्वारा जिधााररत

प्रपत्र में घोषणा िेिी होगी और मतिाि अजधकारी ऐसे मामलों का ररकॉडा प्रपत्र 14क में रखेंगे, मतिाि दिया की

सहायता में एिेंटों या उम् मीिर्ारों या जिजषद्ध पार्टायों को िहीं जलया िा सकता है। साथी को र्ोट गुप् त रखिा

होगा और र्ह केर्ल एक जिर्ााचक के साथी के रूप में काया कर सकता है।

(5.11) मतिाि अजधकारी जिर्ााचकों को उिके द्वारा मतिाि की प्रदिया तथा उिके द्वारा जिभाई िािे र्ाली

औपचाररकताओं के संबंध में बताते समय उन्हें जिम्नजलजखत बबंिुओं की स्ट्पि रूप से व्ाख्या करेंगे:

(क) फामा 13क में घोषणा करिा और उसे स्ट्र्यं मतिाि अजधकारी द्वारा अजधप्रमाजणत करर्ािा,

(ख) फामा 13क और छोटे जलफाफे (फामा 13ख), िोिों पर डाक मतपत्र की िम संख्या डालिा,

(ग) मतिाि करिे का तरीका, अथाात पसंि के अभ्यथी के िाम के सामिे िॉस अथर्ा सही का जचनि लगािा,

(घ) जचजनित बैलट को मोड़ कर उसे छोटे जलफाफे में रखिा और जलफाफे को बंि करिा,

(ड.) जर्जधर्त भरे हुए, हस्ट्ताक्षररत तथा अजधप्रमाजणत फामा 13क में की गई घोषणा को बड़े जलफाफे (फामा 13ग)

के भीतर मतिाि दकए गए मतपत्र र्ाले बंि जलफाफे (फामा 13ख) के साथ रखिा,

(च) बड़े जलफाफे को बंि करिा और उसे मतिाि अजधकारी को सौंपिा।

(5.12) मतिाि अजधकारी एर्ीएससी, एर्ीपीडी और एर्ीसीओ जिर्ााचकों के मामले में फामा 13क में की गई घोषणा को

अजधप्रमाजणत करिे के जलए प्राजधकृत हैं। घोषणा को अजधप्रमाजणत करते समय मतिाि अजधकारी अपिा पूरा

िाम तथा पििाम “’मतिाि अजधकारी’” भी जलखेंगे। अस्ट्पताल में उपचाराधीि कोजर्ड ग्रस्ट्त व्जि के मामले में

उस व्जि की िेख-रेख कर रहे जचदकत्सा अजधकारी भी अजधप्रमाजणत करिे के जलए प्राजधकृत हैं।

(5.13) िब डाक मतपत्र पर र्ोट डाल दिया िाता है और फामा 13ग में जलफाफा तैयार कर दिया िाता है तो मतिाि

अजधकारी उसे इकट्ठा करेंगे।

(5.14) मतिाि अजधकाररयों की प्रत्येक टीम को एर्ीएससी, एर्ीपीडी और एर्ीसीओ जिर्ााचकों की सूची प्रिाि करिे के

साथ-साथ उन्हें पयााप्त संख्या में डाक मत-पत्र, जलफाफे, कलम, इंकपैड (िहााँ कहीं अपेजक्षत हो, र्हााँ अंगूिे के

जििाि के जलए), जलफाफों को बंि करिे के जलए ग्लू जस्ट्टक, मतिाि दकए गए मतपत्रों के जलफाफों और उिके

काउंटरफॉइल को सुरजक्षत रखिे के जलए एक पयााप्त बड़ा कैिर्ास थैला और अन्य अजिर्ाया स्ट्टेििरी के सामाि,

िो आर्श्यक समझे िाएं, प्रिाि दकए िािे चाजहए।

(5.15) मतिाि अजधकाररयों को उिकी यात्राओं के िौराि पुजलस सुरक्षा कर्र प्रिाि की िािी चाजहए।

एर्ीएससी/एर्ीपीडी/एर्ीसीओ जिर्ााचकों के पते पर कायार्ाजहयों की र्ीजडयोग्राफी के प्रबंध भी दकए िािे

चाजहए। इस प्रयोिि के जलए मतिाि अजधकाररयों के साथ एक र्ीजडयोग्राफर को भी ले िाया िािा चाजहए। यह

सुजिजित दकया िाएगा दक र्ीजडयोग्राफी की कायार्ाही करते समय मत की गोपिीयता भंग ि हो।

(5.16) एर्ीएससी, एर्ीपीडी और एर्ीसीओ जिर्ााचकों के पते पर मतिाि अजधकाररयों के िौरों की योििा इस प्रकार से

बिाई िािी चाजहए दक यह जिर्ााचि क्षेत्र में मतिाि के जलए तय तारीख से एक दिि पहले पूरा कर जलया िाए।

उिाहरण के जलए, यदि मतिाि महीिे की 10 तारीख को तय है तो एर्ीएससी, एर्ीपीडी और एर्ीसीओ

जिर्ााचकों के जलए डाक मतिाि का काम उस महीिे की 09 तारीख पूरा कर जलया िािा चाजहए।

(5.17) एर्ीसीओ जिर्ााचकों के जलए जियुि मतिाि अजधकारी हेतु पीपीई दकट सजहत उपयुि सुरक्षा उपकरण उपलब्लध

कराया िाएगा। ऐसा एर्ीसीओ जिर्ााचकों के जलए िोडल स्ट्र्ास्ट्थ अजधकारी से परामिा करके दकया िािा चाजहए।

6.

मतिाि दकए गए मतपत्रों और काउंटरफॉइल र्ाले जलफाफों को सौंपिा

एर्ीएससी/एर्ीपीडी/एर्ीसीओ जिर्ााचकों के पते पर मतिाि अजधकाररयों के िौरे के प्रत्येक दिि के अंत में डाक

मतपत्र आदि र्ाले फामा 12ग के जलफाफों और जिर्ााचकों के हस्ट्ताक्षर/ अंगूिे के जििाि र्ाले मतपत्रों के काउंटरफॉइल तथा

अन्य जर्र्रणों को अिुपजस्ट्थत रहिे र्ाले मतिाताओं द्वारा डाक मतिाि करािे हेतु िाजमत सहायक ररटर्ििंग अजधकारी

द्वारा एकजत्रत दकया िाएगा। सहायक ररटर्ििंग अजधकारी द्वारा उन्हें सुरजक्षत रूप से रखिे के जलए उन्हें ररटर्ििंग अजधकारी

के मुख्यालय भेििे का प्रबंध दकया िाएगा। सहायक ररटर्ििंग अजधकारी प्रत्येक दिि भेिे गए मत-पत्रों की संख्या ििाािे

र्ाले ररकॉडा रखेंगे। इसे ररटर्ििंग अजधकारी के साथ भी िैजिक आधार पर साझा दकया िािा चाजहए।

7.

O.N. 1(E).—In pursuance of the provisions of clause (c) of Section-60 of the Representation of the People

Act, 1951, the Election Commission hereby specifies that the Covid-19 suspect or affected person, certified by

competent authority, who applies for voting by postal ballot paper, and subject to verification of his request by the

Returning Officer concerned, would be a class of persons to give his vote by postal ballot in the ongoing Bye

Elections to the Parliamentary Constituency of UT of Lakshadweep and Assembly Constituencies of

Arunachal Pradesh, Jharkhand, Tamil Nadu, West Bengal and Maharashtra, to be notified under Section 30 of

the Representation of the People Act, 1951, as per the provisions in Part-III A of the Conduct of Elections Rules,

1961, as amended vide Ministry of Law & Justice, Govt. of India, Notification SO No. 1964(E), dated 19^th June, 2020

read with the directions and guidelines issued by the Election Commission on the subject.

Guidelines for Voting through postal ballot by Absentee Voters in the category of Senior Citizens, PwDs and

Covid-19 suspect or affected persons

1.

In pursuance of the Conduct of Elections (Amendment) Rules, 2019, and the Conduct of Elections

(Amendment) Rules, 2020 read with the Election Commission’s decision dated 16^th July, 2020 following categories of

Absentee votershave been given the facility of voting through postal ballot (PB)paper:

(i) Senior citizens (above 80 years of age),

(ii) Persons with disability flagged in the database for electoral rolland,

(iii) COVID 19 suspect or affected persons.

2.

Process for applying PB by absentee voters.

(2.1) An Absentee Voter wishing to vote by postal ballot has to make application to the Returning Officer

(RO) of the constituency concerned, in Form-12D, giving all requisite particulars. Such application seeking

postal ballot facility should reach to the RO from date of announcement of election to five days following

the date of notification of the election concerned.

(2.2)

As per the amended provisions under Rule 27E and 27-I of CER, 1961 the issue of Postal ballot paper

to the absentee voter and return of the ballot paper after voting shall be in such manner as the

Commission may direct. Accordingly, the Commission has laid down the following

procedure/guidelines for facilitating voting through postal ballot by the absentee voters of senior citizen

category (AVSC), absentee voters belonging to PWD category (AVPD) and absentee voters belonging

to COVID 19 category (AVCO)

(2.3)

If any elector at the time of election is hospitalized on account of COVID-19, in a hospital within the

State or is in Home/ Institutional Quarantine on account of COVID-19 and hence not be in a position to

cast vote personally at the polling station as per medical advice and if such elector makes request for

issue of Postal Ballot, the RO concerned, on being satisfied about the genuineness of the application,

shall provide the postal ballot to the elector. The RO shall make arrangement to deliver Postal Ballot

and to get the same collected back from the said elector before the date fixed for poll in the

Constituency. This arrangement shall be made in coordination with the Nodal Officer for COVID-19,

designated by the Chief Secretary, on the directions of the Commission. Application for postal ballot

paper from such electors (Form 12D) should be accompanied by copy of certificate/ instructions from

competent health authorities which show that the applicant is hospitalized in the State or is in

quarantinewithin the State (Home or Institutional) on account of COVID 19.

2.4

In case of absentee voters belonging to PWD category (AVPD),who opt for postal ballot,

application (Form 12D) should be accompanied by a copy of benchmark disability certificate (not

less than 40% of a specified disability)as certified by the concerned certifying authority, under

Section 2 of the Rights of Persons with Disabilities Act, 2016.

Action by RO-

(3.1)

a) BLO will visit to the houses of the absentee voters in category of AVSC, AVPD and AVCO, as per

details provided by the RO, in the Polling Station area and deliver Form 12D to the concerned

electors and obtain acknowledgements from them.

b) BLO shall deposit all the Acknowledgements obtained from the electors with the RO.

c) If an elector is not available, BLO will share his/her contact details and revisit to collect it within

period of five days following the date of the notification.

d) The elector mayor may not opt for Postal Ballot. If he/she opts for Postal Ballot, then the BLO

will collect the filled-in-Form 12D from the house of the elector and deposit with the RO

forthwithwithin period of five days following the date of the notification.

e) Sector Officer shall supervise the process of distribution and collection of Form 12D by BLOs

under the overall supervision of RO.

(3.2) The RO will draw a list (format as annexure-1) of all Absentee Voters in the 3 categories, i.e. (a)

‘AVSC’, (b) ‘AVPD’ and (c) AVCO, whose applications have been received in time and are in order.

(3.3) On the last date for making nominations for the election, the electoral roll is frozen for that election and

no further addition or deletion can be carried out in the roll till the completion of the election. At this

stage, RO shall verify and ensure that the applicants for postal ballots are registered as elector and their

electoral particulars given in Form 12-D are correct with reference to the existing electoral roll. Form

12D of all the electors, whose particulars with reference to the electoral roll have been found to be

correct, shall be approved for issue of postal ballot paper as Absentee Voters in the category of AVSC

and AVPD. In case of Absentee Voters belonging to the category of COVID-19 (AVCO), before

approving FORM 12D,for postal ballot the RO shall check certificate of competent authority, duly

appointed by the State Government/UT administration to the effect that the elector is under home

quarantine or institutional quarantine due to COVID-19.

(3.4) The RO shall indicate entry ‘PB’ in the marked copy of the electoral roll against the names of such

electors, to show that a postal ballot paper has been issued to them, without however recording therein

the sl. no. of the ballot papers issued to them.

(3.5) The RO shall also ensure that elector who has been issued postal ballot is not allowed to vote at a polling

station.

(3.6) Further, the RO shall share list of all such PwD and 80+ electors, whose applications in Form 12D

for availing Postal Ballot facility have been approved by him, with the Contesting Candidates of

recognized political parties in printed hardcopy.

4.

Form and design of Postal ballot paper

The postal ballot paper for Absentee Voters shall be of the same Form and language as the postal ballot paper

for the voters on election duty. In this connection, reference is invited to the Commission’s Directions

No. 52/2015/SDR/Vol.1 dated 18^th September, 2015 and 52/2016/SDR/Vol.1 dated 24^th February, 2016,

regarding the Form of postal ballot paper for voters on election duty.

5.

Visits of Polling Officials, briefing of electors and collection of marked ballot papers:-

(5.1)

Separate teams of poll officers, comprising two officials out of which at least one should be not below

the rank/level of the official appointed as polling officer for Polling Station in the State, should be

appointed for the purpose. A micro observer should also accompany the teams of Poll officers.

(5.2)

Number of teams of Poll Officers to be appointed would depend on the number of Absentee Voters in

the constituency to whom postal ballot papers have been issued.

(5.3)

The team of poll officers shall visit the electors at the address mentioned in their application in Form

12D for facilitating their voting by postal ballot paper.

(5.4)

The electors will be intimated, in advance, about the date and approximate time of visit of poll

officers. Such intimation may be given through SMS on the mobile phone number wherever the same

has been mentioned in the application in Form-12D. In other cases, the intimation may be given by

post and /or through the BLO.

(5.5)

If the elector is not present at the given address at the first visit, the team shall pay a second visit after

leaving intimation about the time of second visit. If the elector is not present even at the second visit,

no further visit or action is required in his/her case.

(5.6)

The candidates shall be informed about the schedule of visit for the delivery and collection of postal

ballots for this category. They may, if desired, depute their authorized representatives (including

BLAs), with prior intimation to the Returning Officer, to watch the process.

(5.7)

The list of AVSCs, AVPDs and AVCOs shall be divided for distribution among the different teams of

Poll Officers in such manner that each team gets a list of persons in geographically compact area.

(5.8)

The visiting poll officers shall ascertain the identity of the elector before issuing postal ballot paper.

(5.9)

Name of elector and the document produced for identification shall also be entered in a register

(annexed as annexure-2) to be maintained for the purpose, and signature/thumb impression of the

elector obtained therein. Further, a tick mark shall be placed against the name of the elector in the list

of AVSC, AVPD and AVCO to indicate that the person has voted. The counterfoil with the serial

number and part number of elector duly filled up shall be got detached and kept in safe custody by the

team.

(5.10)

It shall be the responsibility of each team of pollofficers to (a) issue postal ballot to each of the

Absentee Voters assigned to it, (b) brief the elector about the procedure to be followed for voting

through postal ballot, (c) make sure that the elector votes without anyone influencing his/her choice,

and ensuring the secrecy of voting, all activities at the address of the elector concerned. However, if

any elector is not able to cast vote by himself due to blindness or physical infirmity, he/she shall be

allowed to take the assistance of any adult person for casting vote. In this matter, all the provisions of

Rule 49N of Conduct of Elections Rules,1961 will be applicable the companion has to give

declaration in the Form prescribed by the Commission and Poll officers shall keep a record of such

cases in Form 14A,assistance of polling agents or candidates or prohibited parties may not be taken.

The companion should keep the vote secret and he/she can be acted as the companion of only one

elector.

(5.11) While briefing the electors about the procedure of voting and formalities to be observed on their part,

the polling official shall clearly explain the following points to them:-

(a)

making the declaration in Form 13A and getting it attested by the poll officer himself,

(b)

entering the serial number of postal ballot paper, both on Form 13A and on the smaller envelope

(Form 13B),

(c)

manner of marking vote, i.e by placing either cross mark or tick mark against the name of the

candidate of choice,

(d)

folding and placing the marked ballot in the smaller envelope and closing the envelope,

(e)

Placing the declaration in Form 13A, duly filled up, signed and attested along with closed envelope

(Form 13B) containing the marked ballot paper inside the larger envelope (Form 13C),

(f)

Closing the larger envelope and handing over the same to the poll officer.

(5.12) Poll officer is authorized to attest the declaration in Form 13A in the case of AVSC, AVPD and

AVCO. While attesting the declaration, the poll officer shall write his full name and also the

designation ‘poll officer’. In the case of a COVID affected person on treatment in Hospital, the

Medical Officer attending to the person also authorised to attest the declaration.

(5.13) After vote is cast on postal ballot and the envelope in Form 13C is ready, the Poll Officers will collect

the same.

(5.14) Each team of poll officers should be provided with the list of AVSC, AVPD and AVCO electors,

adequate number of postal ballot papers, envelopes, pen, ink-pad (for thumb impression wherever

required), glue stick for closing the envelopes, a sufficiently big canvas bag for keeping the envelopes

of polled ballots and the counterfoils safely and other essential stationeries that may be considered

necessary.

(5.15) Police Security cover shall be provided to the poll officers for their visits. Arrangement for

videography of the proceedings at the address of AVSC/ AVPD/AVCO should also be made. For this

purpose, a videographer should accompany the poll officers. It shall be ensured that the secrecy of

vote is not violated while carrying out the videography exercise.

(5.16) Visits by teams of poll officers to the address of AVSC, AVPD and AVCO electors should be

planned in such a way that the same is completed one day prior to the date fixed for poll in the

constituency. For instance, if poll is scheduled for 10^th of Month, the postal voting for AVSC, AVPD

and AVCO should be completed by 9^th of that Month.

(5.17) For the poll officers deputed to AVCO electors appropriate protection equipment including PPE kit

shall be provided. This should be done in consultation with the Nodal Health Officer for AVCOs.

6.

Deposit of envelopes containing marked ballot papers and counterfoils

At the end of each day of visit by poll officers to the address of AVSC/AVPD/AVCO electors, the envelopes

in Form-13C containing postal ballot paper etc. and the counterfoils of ballot papers containing the signature/thumb

impression of electors and other particulars, shall be collected by the ARO designated of postal voting by the absentee

voters. The ARO shall make arrangements to have the same delivered at the headquarters of the RO for keeping them

in safe custody. The ARO shall maintain the record indicating the number of ballots sent on each day. This should also

be shared with the RO on a daily basis.

7.

Contesting candidates will be duly informed about the Election Commission’s above guidelines.
