का.आ. 5065(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का

अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 उप धारा

(1) के अधीन िारी की गई, भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना का.आ. 6049 (अ)

तारीख 22.12.2022 जिसका प्रकािन भारत के रािपत्र संख्या 5806, भाग II, खण्ड 3, उप खण्ड (II) तारीख

26.12.2022में दकया गया है। इस अजधसूचना में संलग्न अनुसूचीमें केन्द्र सरकार ने आयल एंड नेचुरल गैस कारपोरेिन

जलजमटेड द्वारा जबछाए िाने वाले िजिणी कावेरी एसेट पाइपलाइन नेटवकज के प्राकृजतक गैस उत्पाि के पररवहन के जलए

पाइपलाइन जबछाने के प्रयोिना के अजधकार का अिजन करने के जलए अपने आिय की घोषणा की थी:

और उक्त रािपत्र अजधसूचना की प्रजतयााँ िनता को उपलब्ध करा िी गई थीं।और उक्त अजधजनयम की धारा 6 की

उपधारा (1) के अनुसरण में सिम प्राजधकारी नें केन्द्रीय सरकार को अपनी ररपोटज िे िी है।

और केन्द्रीय सरकार ने उक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम

पाइपलाइन जबछाने के जलए अपेजित है, उसमें उपयोग के अजधकार का अिजन करने का जवजनष्चय दकया है:

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए

एति् द्वारा घोषणा करती है दक इस अजधसूचना से संलग्न अनुसूजच में जवजनर्िजष्ट भूजम में पाइपलाइन जबछाने के उपयोग का

अजधकार अर्िजत दकया िाए:

और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह

जनिेि िेती है दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के

बिाए सभी जबल्लंगमों से मुक्त होकर आयल एंड नेचुरल गैस कारपोरेिन जलजमटेड में जनजहत होगा।

आयल एंड नेचुरल गैस कारपोरेिन जलजमटेड, पी एंड एमपी अजधजनयम, 1962 की धारा 10 के अनुसार दकसी भी

मुआविे के जलए जविेष रूप से उत्तरिायी होगा। धारा 13 के अनुसार, पाइपलाइन से संबंजधत दकसी भी मामले के जलए

केंर सरकार, सिम प्राजधकारी या दकसी राज्य सरकार या जनगम के जखलाफ कोई मुकिमा या अन्द्य कानूनी कायजवाही नहीं

होगी।

NOTIFICATION

New Delhi, the 28th November, 2023

S.O. 5065(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and

Natural Gas, S.ONo. 6049(E) dated the 22^nd Dec 2022, issued under sub-section (1) of section 3 of the Petroleum and

Minerals Pipeline (Acquisition of Right of User in Land) Act, 1962 (50 of 1962),(hereinafter referred to as the said

Act),published in the Extra Ordinary Gazette of India dated the 26th Dec 2022, the Central Government declared its

intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose

of laying pipeline for transportation of Natural Gas Product , of Southern Cauvery Asset Pipeline Network Should be

laid by Oil and Natural Gas Corporation Limited.

And whereas the copies of the Gazette were made available to the public. And whereas the Competent

Authority has under Sub-section (1) of Section 6 of the said Act, has submitted his report of Central Government.

And whereas, the Central Government after considering the said report and on being satisfied that the said

land is required for laying the pipeline, has decided to acquire right of the user therein;

Now, therefore, in exercise of the powers conferred by Sub-section (1) of Section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the Central

Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of vesting in the

Central Government, vests on the date of publication of the declaration, in India Oil Corporation Limited, free from all

encumbrances.

Oil and Natural Gas Corporation Limited, shall be exclusively liable for any compensation in terms of

Section 10 of the P&MP Act, 1962. According to Section13,no suit, or other legal proceeding would lie against the

Central Government, Competent Authority or any State Government or Corporation for any matter relating to the

pipeline.
