सा.का.जन. 874(अ).—अजखल भारतीय सेिा अजधजनयम, 1951 (1951 का 61) की धारा 3 की उप धारा (1)

और 1(क) द्वारा प्रित् त िजियों का प्रयोग करते हुए, केन्‍द र सरकार, भारतीय पुजलस सेिा (िेतन) जनयमिली, 2016 में आगे

और संिोधन करने के जलए एतिद्वारा जनम् नजलजखत जनयम बनाती है, अथाित्:-

1. (1) इन जनयमों को भारतीय पुजलस सेिा (िेतन) संिोधन जनयमािली, 2023 कहा िाएगा।

(2) इन्‍दहें 1 िनिरी 2016 से प्रभािी हुआ माना िाएगा।

2. भारतीय पुजलस सेिा (िेतन) जनयमािली, 2016 के जनयम 5 में उप जनयम (9) के जलए जनम् नजलजखत उप जनयम

प्रजतस्ट् थाजपत दकए िाएंगे; अथाित्:-

“(9) सेिा में एक ग्रेड से िूसरे ग्रेड में पिोन्नजत होने पर सेिा के सिस्ट्य के पास उच्च पि के िेतन स्ट्तर में अपनी

पिोन्नजत की जतजथ से या उपरोि संगत उप-जनयम में दिए गए प्रािधान के अनुसार जनचले स्ट्केल में जिस जतजथ

को िह िेतन िृजि (इन्‍दरीमेंट) अर्िित करता है उस जतजथ से अपने िेतन को जनयत करिाने का जिकल्प होगा; बाि

के मामले में, पिोन्नजत की तारीख पर सेिा के सिस्ट्य को उस स्ट्तर में अगले उच्चतर सेल में रखा िाएगा जिसमें

संगत उप-जनयम में दिए गए प्रािधानों के अनुसार दकए िाने िाले अगले पुनः जनयतन के साथ उसे

पिोन्नत दकया िाता है।

व्याख्यात्मक ज्ञापन:

केंर सरकार ने भारतीय पुजलस सेिा (िेतन) जनयमािली 2016 के जनयम 5 के उप-जनयम 9 में संिोधन करने का

जनणिय जलया है िो भा.पु.से के अजधकाररयों के उनके एक ग्रेड से िूसरे में पिोन्नजत पर िेतन जनयतन का उपबंध करता है।

तद्नुसार भारतीय पुजलस सेिा (िेतन) जनयमािली, 2016 को 01 िनिरी, 2016 से संिोजधत दकया िा रहा है।

यह प्रमाजणत दकया िाता है दक भारतीय पुजलस सेिा का कोई सिस्ट्य इन जनयमों के भूतलक्षी प्रभाि से प्रजतकूल

रूप में प्रभाजित नहीं होने िा रहा है।

रटप्पणी: प्रधान जनयमािली को भारत के रािपत्र, असाधारण में दिनांक 23 जसतम्बर, 2016 की अजधसूचना संख्या सा

का जन 910 (अ) के माध्यम से प्रकाजित दकया गया था और अंजतम संिोधन 30 दिसंबर, 2021 की

अजधसूचना संख्या सा.का.जन. 915(अ) के माध्यम से दकया गया था।

NOTIFICATION

New Delhi, the 5th December, 2023

G.S.R. 874(E).—In exercise of the powers conferred by sub-sections (1) and (1A) of section 3 of the All

India Services Act, 1951 (61 of 1951), the Central Government hereby makes the following rules further to amend the

Indian Police Service (Pay) Rules, 2016, namely: ─

1. (i) These rules may be called the Indian Police Service (Pay) Amendment Rules, 2023.

(ii) They shall be deemed to have come into force on the 1^st day of January, 2016.

In the Indian Police Service (Pay) Rules, 2016, in rule 5, for sub-rule (9), the following sub-rule shall be

substituted, namely:-

“(9) On promotion from one grade to another in the Service, a member of the Service shall have an option

to get his pay fixed in the Level of the higher post either from the date of his promotion or from the date

on which he subsequently earns an increment in the lower scale in the manner provided in the relevant

sub-rule above; in the latter case, on the date of promotion, a member of Service shall be placed at the

next higher cell in the Level to which he or she is promoted with further re-fixation to be done in the

manner provided in relevant sub-rule above with effect from the 1st day of January or the 1st day of July,

the date of accrual of the next increment in the lower scale.”

Explanatory Memorandum:

The Central Government has decided to amend sub-rule 9 of rule 5 of the Indian Police Service (Pay) Rules,

2016 which provides for the fixation of pay of IPS officers on their promotion from one grade to another. The Indian

Police Service (Pay) Rules, 2016 are being amended accordingly with effect from the 1^st January, 2016.

It is certified that no member of the Indian Police Service is likely to be adversely affected by giving

retrospective effect to these rules.

Note: The principal rules were published in the Gazette of India, Extraordinary, vide notification number

GSR 910 (E) dated the 23^rd September, 2016 and last amended vide notification number GSR 915(E) dated

the 30^th December, 2021.
