सा.का.जन. 894(ऄ).—केन्द्रीय सरकार कीटनािी ऄजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा प्रदत्त

िजियों का प्रयोग करते हुए कीटनािी जनयम, 1971 का और संिोधन करने के जलए जनम्नजलजखत प्रारूप जनयम का प्रस्ट्ताव

करती है, ईि धारा की ऄपेक्षानुसार ईन सभी व्यजियों जजनकी ईससे प्रभाजवत होने की संभावना है, की जानकारी के जलए

प्रकाजित ककए जाते हैं और सूचना दी जाती है कक ईि प्रारूप जनयमों पर ईस तारीख से, जजसको भारत के राजपत्र में

यथाप्रकाजित, आस ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी जाती है, तीस कदनों की समाजि के पश्चात् जवचार

ककया जाएगा;

ऐसे अक्षेपों और सुझावों पर, जो तीस कदनों की पूवोि ऄवजध के समाि होने से पहले ईि प्रारूप जनयमों के संबंध

में, ककसी व्यजि से प्राि हो सकेंगे, केन्द्रीय सरकार द्वारा जवचार ककया जाएगा;

ईि प्रारूप जनयमों के संबंध में अक्षेपों और सुझावों को संयुि सजचव (वनस्ट्पजत संरक्षण) कृजि और ककसान

प्रारूप जनयम

1. संजक्षि नाम और प्रारंभ:- (1) आन जनयमों का संजक्षि नाम कीटनािी (नौवां संिोधन) जनयम, 2023 है।

(2) ये राजपत्र में ईनके ऄंजतम प्रकािन की तारीख को प्रवृत्त होंगे।

2. कीटनािी जनयम, 1971 में, जनयम 19 के, ईप-जनयम (1) में:-

(1) खंड (i) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत ककया जाएगा ऄथाात्: -

“लेबल एक, दो या तीन पैनल का होगा और केवल ऄंग्रेजी और हहदी भािाओं में मुकरत होगा। सभी लेबल पैनलों का

न्द्यूनतम अकार पैकेज के सम्मुख लगे अकार के ऄनुसार होगा। िुद्ध ऄंतवास्ट्तु अधार पर तीन प्रकार के लेबल होंगे:-

(i) ऄजत लघु पैकज - 1 ग्राम/जम.जल से 50 ग्राम/जम.जल.

(ii) लघु पैकज - 51 ग्राम/जम.जल से 250 ग्राम/जम.जल

(iii) वृहद पैकज - >250 ग्राम/जम.जल

लेबल पर जनम्नजलजखत जानकारी मुकरत होगी :-

(क) कीटनािक का नाम (ब्ांड नाम या व्यापार नाम जजसके तहत कीटनािक बेचा जाता है)। ब्ांड नाम और

सामान्द्य नाम को समान महत्व कदया जायेगा और आसे पैनल के मुख भाग के 20% से ऄजधक क्षेत्र पर जवस्ट्तृत नहीं

ककया जाएगा । ब्ांड नाम मोटे ऄक्षरों में होगा;

(ख) साधारण नाम, पंजीकरण सजमजत द्वारा यथा ऄनुमोकदत;

(ग) “ईपयोग से पहले पत्रक पढ़े” जनदेिों को सभी पैकेज अकारों में कम से कम ऄंग्रेजी और हहदी भािा में बडे

ऄक्षरों में लेबल के िीिा पर मुख्य स्ट्थान पर जलखा जाएगा। पररजिष्टी में, वृहद् पैक के जलए सभी क्षेत्रीय भािाओं में

जहााँ यह जवक्रय के जलए प्रस्ट्ताजवत है;

(घ) रसायन का प्रयोजन लेबल पर ईजल्लजखत ककया जाएगा, ईदाहरण के जलए:-

(i)

कृजि ईपयोग के जलए

(ii)

नािक जीव जनयंत्रण संकक्रयाओं के जलए

(iii)

घरेलू ईपयोग के जलए

(iv) लोक स्ट्वास्ट््य के जलए

(v)

ऄन्द्य (जवजनर्ददष्ट);

(ङ) कीटनािी के प्रत्येक ऄनुप्रयोग के पश्चात् संभाजवत पुनः प्रवेि की ऄवजध पंजीकरण सजमजत द्वारा यथा

ऄनुमोकदत;

(च) जवजनर्ममजत की संरचना या कीटनािक;

(छ) ईपयोग के जलए जनदेिों के जववरण हेतु कृपया पत्रक देखें; ईपयोग का तरीका और समय; फसलों या लक्ष्य क्षेत्र

और कीटों की व्यापक श्रेणी की सूची जजस पर आसे प्रयुि करने के जलए पंजीकृत ककया गया है; मात्रा (जजसके ऄंतगात

ग्राम संकक्रय संघटक, जवजनर्ममजत और तनुकरण लीटर और क्षेत्रफल में); पंजीकरण सजमजत द्वारा ऄनुमोकदत सुरक्षा

सावधाजनयां; जविािता के लक्षण और प्राथजमक ईपचार;

(ज)

प्रजतकारक कथन;

(झ) जवजनमााता का नाम;

(ञ)

अयातकताा और पुनः पैककताा (जहााँ भी लागू हो);

(ट)

जवपणनकताा;

(ठ)

कीटनािक की पंजीकरण संख्या;

(ड)

जवजनमााण ऄनुज्ञजि संख्या;

(ढ)

बैच संख्या;

(ण)

जवजनमााण की जतजथ;

(त)

ऄवसान की जतजथ;

(थ)

ऄजधकतम खुदरा मूल्य (ऄ.खु.मू.) सभी करों सजहत;

(द)

िुद्ध ऄन्द्तवास्ट्तु का भार या अयतन (मीररक प्रणाली में);

रटप्पण-1 : जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 के प्रावधान ईपखंड (त) (थ) और (द) के जलए

लागू होंगे।

(ध)

सावधाजनयां कथन:-

(i)

लेबल और पत्रक पर जो ऄजभदत्त है, ईससे जभन्न ऄन्द्य ईद्देश्य के जलए ईपयोग नहीं ककया जाना

चाजहए;

(ii)

पत्रकों के जनदेिानुसार ईपयोग के पश्चात् कंटेनर को नष्ट करें; और

(iii)

पंजीकरण सजमजत द्वारा यथा ऄनुमोकदत कोइ ऄन्द्य चेतावनी या सावधाजनयां कथन।

(न)

ग्राहक संपका ब्यौरे जैसे कंपनी का नाम, क्यू अर कोड, इ-मेल अइ डी और ग्राहक संपका संख्या।

परंतु क्यूअर कोड समुजचत स्ट्थान पर खुदरा पैक (प्राथजमक या जद्वतीय पैक, जैसी भी जस्ट्थजत हो) के ऐसे स्ट्थान

पर रखा जाएगा जहां क्यूअर कोड स्ट्कैहनग ईपकरण जैसे मोबाआल फोन में स्ट्कैन करने पर, वेबहलक या हलक

जवजनमााता कंपनी के यूअरएल खोलने के जलए प्रदर्मित होगा, जजस पर जक्लक करने से ईपयोगकताा लेबल और पत्रक

की संपूणा जवजिष्ट सूचना प्राि करेगा और क्यूअर कोड में कम से कम जनम्नजलजखत सूचना ऄंतर्मवष्ट होगी:

(क) जवजिष्ट पहचानकताा या जीटीअइएन;

(ख) बैच संख्या;

(ग) जवजनमााण की तारीख;

(घ) ऄवसान की तारीख;

(ङ) वेब हलक या यूअरएल।

रटप्पण-2: ईपखंड (न) के प्रावधान जवजधक माप जवज्ञान (पैकेज में रखी वस्ट्तुएं) जनयम, 2011 के ऄजतररि हैंI

पंजीकरण सजमजत द्वारा ऄनुमोदन के पश्चात् लेबल पर ऄजतररजि जानकारी जोडी जा सकती है।

न्द्यूनतम अकार के लेबल के संबंध में लेबल के नीचे की ओर एक वगा सेंटीमीटर से ऄन्द्यून अकार के सभी संबंजधत

सुरक्षा जचत्र जलजप (तीसरी ऄनुसूची में जचत्र 1 में जनर्ददष्ट) होगी । बडे अकार के लेबलों के संबंध में अनुपाजतक बडी

जचत्र जलजप पैनल के दाजहनी ओर नीचे की ओर होगी। छोटे लेबलों के जलए प्राथजमक पैक पर जचत्र जलजप प्राथजमक या

जद्वतीयक पैक पर मुकरत ककए जाएंगे। ऄजत लघु लेबलों के जलए जचत्र जलजप पत्रक पर मुकरत की जायेंगी।”

(2) खंड (iii) के जलए जनम्नजलजखत प्रजतस्ट्थाजपत ककया जाएगा ऄथाात्: -

“(क) ऄजत लघु या लघु पैकेजों को भी एक जद्वतीयक पैक में पैक ककया जाएगा जजसके लेबल पर, जनयम 19 के ईप-

जनयम (1) के खंड (i) की सभी ऄंतवास्ट्तुए ऄजमट स्ट्याही से मुकरत होंगी।

परन्द्तु यह कक ऄजत लघु या लघु पैकेजों, जजनके प्राथजमक पैक के लेबल में जनयम 19 के ईप-जनयम (1) के खंड

(i) की सभी ऄंतवास्ट्तुए फॉन्द्ट अकार में ऄजमट स्ट्याही के साथ जनधााररत अकार से कम न हो, के जलए जद्वतीयक पैक

की अवश्यकता न हो।

परन्द्तु यह कक ऄजत-लघु पैक के जलए, ऄनेक प्राथजमक पैक को एक जद्वतीयक पैक में पैक ककया जा सकता है और

जवजनमााता यह सुजनजश्चत करेगा कक ईन्द्हें एक जद्वतीयक पैक में पैक करने से पूवा प्रत्येक प्राथजमक पैक के साथ पत्रक

और क्यूअर कोड सुरजक्षत रूप से संलग्न ककया जाए।

(ख) वृहद् पैकेज का लेबल जनयम 19 के ईप-जनयम (1) के खंड (i) की सभी सामग्री को प्रदर्मित करने वाली ऄजमट

स्ट्याही से मुकरत ककया जाएगा। वृहद पैकेज को जद्वतीयक पैक में भी पैक ककया जा सकता है।”

(3) खंड (iv) में, जनम्नजलजखत परंतुक डाला जाएगा, ऄथाात्: -

“परन्द्तु यह कक ऄजत लघु पैक के मामले में, जवजनर्ममजत या कीटनािक की संरचना को संक्षेप में ‘सकक्रय घटक और ऄन्द्य

ऄवयवों का प्रजतित’ के रूप में प्रदर्मित ककया जाए और पूरी संरचना पत्रक पर मुकरत की जाएगी। जवजनमााता का नाम और

पता लेबल पर संक्षेप में मुकरत ककया जाए और पूरा नाम और पता पत्रक पर मुकरत होना चाजहए।”

3. ईि जनयमों में, ईप-जनयम (3) के बाद, पहले परंतुक को जनम्नजलजखत िब्दों से प्रजतस्ट्थाजपत ककया जाएगा:

“परन्द्तु यह कक ऄजत-लघु पैक के जलए, ईि वगा का अयाम 1 वगा सेंटीमीटर (1.0 सेमी x1.0 सेमी) से कम न हो।”

4. ईप-जनयम (3) के बाद, जनम्नजलजखत स्ट्पष्टीकरण जोडा जाएगा, ऄथाात्:

स्ट्पष्टीकरण: ईप-जनयम (1) और ईप-जनयम (3) के प्रयोजनों के जलए, यह स्ट्पष्ट ककया जाता है कक,

(i) कोइ भी पंजीकरण प्रमाणपत्र धारक ककसी ऐसे लेबल या पत्रक, जो कीटनािी (नौवां संसोधन) जनयम, 2023 के

ईपबंधों के ऄनुसार न हो, का ईपयोग, कीटनािी (नौवां संसोधन) जनयम के प्रवत्त होने की तारीख से छह माह के

पश्चात नहीं करेगा।

(ii) ऐसे लेबल या पत्रक लगे ककसी कीटनािक या आसका पैकेज जोकक कीटनािी (नौवां संसोधन) जनयम, 2023 के

ऄनुसार न हो, जनयम के प्रवत्त होने की तारीख से दो विा या ईसके ऄवसान की तारीख जो भी पहले हो. की

समाजि के पश्चात, जवतररत, बेचें जबक्री ऄथवा भण्डारण हेतू प्रदर्मित नहीं ककया जायेगा, और जब तक ऄन्द्यथा

जनदेि न कदया जाए, ईि ऄवजध की समाजि के बाद यह स्ट्पष्टीकरण ऄजस्ट्तत्व में नहीं रहेगा।

5. ईपजनयम (7) में “ऄन्द्यथा कजथत के जसवा” िब्द हटा कदए जाएंगे।

NOTIFICATION

New Delhi, the 13th December, 2023

G.S.R. 894(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central

Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of

1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby;

and notice is hereby given that the said draft rule shall be taken into consideration after the expiry of thirty days from

the date on which copies of this notification as published in the Gazette of India are made available to the public;

Objections or suggestions which may be received from any person in respect of the said draft rule before the

expiry of the aforesaid period of thirty days will be considered by the Central Government;

Objections and suggestions in respect to the said draft rule may be forwarded to the Joint Secretary (Plant

Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi

Bhawan, New Delhi-110 001 or through email at [email protected].

Draft Rules

1. Short title and Commencement:- (1) These rules may be called the Insecticides (Ninth Amendment)

Rules, 2023.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Insecticides Rules, 1971, in sub-rule (1) of Rule 19 :-

(1) For clause (i) following shall be substituted namely:-

“The label shall have either one, two or three panels and shall be printed only in English and Hindi

languages. The minimum size of all the label panels shall be according to the size affixed on the face of the

package. There shall be three types of labels depending on the net content:

I. Ultra small package -1gm or ml to 50 gm or ml

II. Small package -51 gm or ml to 250 gm or ml

III. Big package- >250 gm or ml

The following information shall be printed on the label :-

(a) name of insecticide (brand name or trade name under which the insecticide is sold). Equal prominence shall be

given to the Brand name and Common name and it should occupy not more than 20% of area of the face of the

panel. The brand name shall be in bold;

(b) common name as approved by Registration Committee;

least in English and Hindi languages in all package sizes. In addition, for big pack size in all such regional

languages where it is proposed for sale;

(d) purpose of the chemical shall be mentioned on the label, for example:-

(i) for Agricultural Use

(ii) for Pest Control Operators

(iii) for House Hold Use

(iv) for Public Health

(v) others(specify);

(e) optimal re-entry period after each application of insecticide as approved by the Registration Committee;

(f) composition of the formulation or insecticides;

(g) Please refer leaflet for details of directions for use; manner and time of application; list of crops or target area

and broad category of pests on which it is registered to apply; dosage (include gram active ingredient, formulation

and dilution in litres and area); safety precautions as approved by Registration Committee; symptoms of poisoning

and first aid

(h) antidote statement;

(i) name of the manufacturer;

(j) imported and re-packed by (wherever applicable);

(k) marketed by;

(l) registration number of the insecticide;

(m) manufacturing license number;

(n) batch number;

(o) manufacturing date;

(p) expiry date;

(q) Maximum Retail Price (MRP) Inclusive of all taxes;

(r) net content weight or volume (in metric system);

Note I: The provisions of the Legal Metrology (Packaged Commodities) Rules 2011 shall be applicable for

sub-clauses (p), (q) and (r).

(s) cautionary statement :-

(i) Not to be used for any purpose other than those subscribed on label and leaflets;

(ii) Destroy the container after use as directed on leaflet; and

(iii) Any other warning or cautionary statement as approved by Registration Committee;

(t) Customer care details such as Company's name, QR Code, e-mail id and customer care numbers.

Provided that QR Code shall be placed on retail pack (Primary or Secondary pack as the case may be) at

suitable place where on scanning the QR code by scanning equipment like mobile phone, a web link or link for

opening the URL of the Manufacturing company will appear, which on pressing or clicking, will take the user to

the entire unique information of label and leaflet and the QR code shall contain at least the following

information:

(a) Unique Identifier or GTIN;

(b) Batch Number;

(d) Date of Expiry:

(e) Web link or URL.

Note II : The provisions of (t) are in addition to the Legal Metrology(Packaged Commodities) Rules 2011

Additional information can be added to the Label after approval by the Registration Committee.

All relevant safety pictograms (refer picture I in the THIRD SCHEDULE) of size not less than one square

centimetre at the bottom of the label in respect of labels of minimum size. Pictograms shall be proportionately

bigger in respect of labels of bigger size at the bottom of the right side panel. They shall be printed only once on

the label. For small labels the pictograms on the primary pack shall be printed on primary or the secondary pack.

For ultra small labels the pictograms shall be printed on leaflet.”

(2) For clause (iii) following shall be substituted namely :-

“(a) The ultra small or small packages shall also be packed in a secondary pack whose label shall be printed with

indelible ink displaying all contents of clause (i) of sub-rule (1) of rule 19.

Provided that secondary packs may not be required for ultra or small packages whose label of primary pack

have all contents of clause (i) of sub-rule (1) of rule 19 with indelible ink in the font sizes not less than size

prescribed.

Provided that for ultra-small packs, multiple primary packs may be packed in one secondary pack and the

manufacturer shall ensure leaflet and QR code be securely attached with each primary pack before packing them in

one secondary pack.

(b) The label of the big package shall be printed with indelible ink displaying all contents of clause (i) of sub-rule

(1) of rule 19. The big package may also be packed in a secondary pack.”

(3) in clause (iv), the following proviso shall be inserted, namely:-

“Provided that in case of ultra small packs, composition of the formulation or insecticide may be displayed in

short as “percentage of active ingredient and other ingredients” and the complete composition shall be printed on

leaflet. Name and address of the manufacturer may be printed in short on label and complete address shall be

printed on leaflet.”

3. In the said rules, after sub-rule (3), first proviso shall be replaced with words:

“Provided that for ultra-small packs, the dimensions of the said square shall be not less than 1 square centimeter (1.0

cm x1.0 cm).”

4. After sub-rule (3), the following Explanation shall be inserted, namely:

Explanation: For the purposes sub-rule (1) and sub-rule (3), it is hereby clarified that,

(i) no registration certificate holder shall use a label or leaflet, which is not in accordance with the provisions of the

Insecticides (Ninth Amendment) Rules, 2023, after a period of six months from the date of commencement of the

Insecticides (Ninth Amendment) Rules, 2023.

(ii) no insecticides or its package bearing a label or leaflet, which is not in accordance with the provisions of the

Insecticides (Ninth Amendment) Rules, 2023, shall be distributed, sold, exhibited for sale or stocked, after expiry of

two years from the date of commencement of the Insecticides (Ninth Amendment) Rules, 2023 or its expiry date,

whichever is earlier and this explanation shall cease to exist after expiry of the said period, unless otherwise

directed.

5. in sub-rule (7) the words “ unless stated otherwise” shall be omitted.
