का. आ. 5385(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का

अिजन), अजधजनयम 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) दक धारा 3 की उप

धारा-(1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ.

668 (अ) दिनांक 15 फरवरी, 2022 और भूल का .आ .1990 (अ) दिनांक 28 अप्रैल, 2022 िो भारत के साप्ताजहक

रािपत्र अजधसूचना संख्या का. आ. 649, 15 फरवरी, 2022 और भूल रािपत्र संख्या 1890, 29 अप्रैल, 2022 में

प्रकाजित की गई थी द्वारा उस अजधसूचना से संलग्न अनुसूची में जवजनर्िजष्ट भूजम में कृष्णापटनम एस.पी.एस.आर नेल्लोर,

आंध्र प्रिेि से हैिराबाि, तेलंगाना राज्य तक पेरोजलयम उत्पािों के पररवहन के जलए कृष्णापटनम- हैिराबाि पाइपलाइन

पररयोिना के माध्यम से भारत पेरोजलयम कॉपोरेिन द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार

का अिजन के अपने आिय की घोषणा की थी;

और उक्त रािपत्र अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थी;

और सक्षम प्राजधकारी ने, उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन केन्द्रीय सरकार को अपनी

ररपोटज िे िी है;

और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात् और यह समाधान हो िाने पर दक उक्त भूजम

पाइपलाइन जबछाने के जलये अपेजक्षत है, उसमें उपयोग के अजधकार का अिजन करने का जवजनजश्चय दकया है;

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए

यह घोषणा करती है दक इस अजधसूचना से संलग्न अनुसूची में जवजनर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए उपयोग के

अजधकार का अिजन दकया िाए;

और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह

जनिेि िेती है दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की दिनांक से केन्द्रीय सरकार में जनजहत होने

की बिाए, सभी जवल्लंगमों से मुक्त होकर भारत पेरोजलयम कॉपोरेिन जलजमटेड में जनजहत होगी।

पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए भारत

पेरोजलयम कॉपोरेिन जलजमटेड पूणजतया उत्तरिायी होगा और पाइपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय

सरकार के जवरूद्ध कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी।

NOTIFICATION

New Delhi, the 19th December, 2023

S.O.5385(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and

Natural Gas S.O. NO.668(E) dated the 15^thFebruary, 2022 and Erratum S.O.1990(E), dt.28^th April, 2022 issued under

sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962

(50 of 1962) (hereinafter referred to as the said Act), published in the weekly Gazette of India Extraordinary

No.649,15^thFebruary, 2022 and Erratum 1890 dt.29^th April, 2022 the Central Government declared its intention to

acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying

Krishnapatnam - Hyderabad Pipeline for transportation of Petroleum products from Krishnapatnam (SPSR Nellore,

Andhra Pradesh) to Madharam near Hyderabad (Ranga Reddy, Telangana) by Bharat Petroleum Corporation Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted report

to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said

land is required for laying the pipeline, has decided to acquire the right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the

Central Government hereby declares that the right of user in the land, specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the Central

Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the

Central Government, vest on the date of the publication of the declaration, in Bharat Petroleum Corporation Limited,

free from all encumbrances.

Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section

10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any

matter relating to the pipeline.
