का.आ. 5448(अ).— केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिधनयम, 1956 (1956 का 48) (धजसे इसमें इसके

पश्चात् उक्त अधिधनयम कहा र्या है) की िारा 3क की उपिारा (1) के अिीन जारी की र्ई भारत सरकार के सड़क

पररवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1901(E) तारीख 25/04/2023, जो भारत के राजपत्र,

असािारण, भार् II, खण्ड 3, उपखंड (ii) में प्रकाधित की र्ई थी, द्वारा कनागटक राज्य के धिवमोग्र्ा धजले में NH206 के

कक.मी. 207.800 से कक.मी. 208.250 (तुमकुर - होन्नावर खंड) के धनमागण (चौड़ीकरण/पेव्ड िोल्डर सधहत 2-लेन/4-लेन

का बनाना आकि), अनुरक्षण, प्रबंिन और प्रचालन के धलए उस अधिसूचना से उपाबद्ध अनुसूची में धवधनर्िगष्ट भूधम का अजगन

करने के अपने आिय की घोषणा की थी ;

और उक्त अधिसूचना का सार उक्त अधिधनयम की िारा 3क की उपिारा (3) के अिीन तारीख "19-07-2023 "

को "प्रजावाणी" और "टाइम्स ऑफ इंधडया" िोनों में प्रकाधित ककया र्या था ;

जबकक सक्षम प्राधिकारी को िारा 3-र् के तहत िायर आपधि प्राप्त हुई है, धजस पर धवचार ककया र्या है और

उसका उधचत रूप से धनपटान ककया र्या;

और सक्षम प्राधिकारी ने उक्त अधिधनयम की िारा 3घ की उपिारा (1) के अनुसरण में, केन्द्रीय सरकार को अपनी

ररपोटग िे िी है ;

अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त ररपोटग प्राप्त हो जाने पर और उक्त अधिधनयम की िारा 3घ

की उपिारा (1) द्वारा प्रिि िधक्तयों का प्रयोर् करते हुए, यह घोषणा करती है कक उक्त अनुसूची में धवधनर्िगष्ट भूधम का

पूवोक्त प्रयोजन के धलए अजगन ककया जाना चाधहए ;

और अब, केन्द्रीय सरकार, उक्त अधिधनयम की िारा 3घ की उपिारा (2) के अनुसरण में यह घोषणा करती है कक

इस अधिसूचना के राजपत्र में प्रकािन पर, उक्त अनुसूची में धवधनर्िगष्ट भूधम सभी धवल्लंर्मों से मुक्त होकर आत्यधन्द्तक रूप

से केन्द्रीय सरकार में धनधहत हो जाएर्ी ।

NOTIFICATION

New Delhi, the 22nd December, 2023

S.O. 5448(E).— Whereas by the notification of the Government of India in the Ministry of Road Transport

and Highways, 1901(E) Dated:25/04/2023 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-

section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter

referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule

annexed to the said notification for building (widening/two lane with paved shoulder/four laning etc.,),Maintenance,

management and operation of NH206 in the stretch of land from Km. 207.800 to Km. 208.250 (Tumkur - Honnavar

Section) in the district of SHIVAMOGGA in the state of KARNATAKA

And whereas the substance of the said notification has been published in “Prajavani” and “Times of India”

both dated 19-07-2023; under sub-section (3) of section 3A of the said Act;

And whereas the Competent Authority has received objections filed under Section 3-C, considered and

settled the same appropriately;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has

submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers

conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land

specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby

declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall

vest absolutely in the Central Government, free from all encumbrances.
