का.आ. 5462(अ).—मुजस्ट्लम लीग िम्मू कश्मीर (मसरत आलम गुट) (जिसे इसमें इसके पश्चात् एमएलिेके-एमए
के रूप में जनर्ििष्ट दकया गया है), जिसकी अध्यक्षता मसरत आलम भट करता है, अपने भारत जिरोधी और पादकस्ट्तान
समर्िक प्रचार के जलए िाना िाता है;
और, एमएलिेके-एमए का उद्देश्य िम्मू और कश्मीर को भारत से स्ट्ितंत्र करना है तादक िम्मू और कश्मीर का
पादकस्ट्तान में जिलय हो सके और िम्मू-कश्मीर में इस्ट्लामी िासन स्ट्र्ाजपत हो सके;
और, एमएलिेके-एमए के सिस्ट्य िम्मू और कश्मीर में अलगाििािी गजतजिजधयों में सजम्मजलत रहे हैं;
और, एमएलिेके-एमए के नेता और सिस्ट्य आतंकिािी गजतजिजधयों का समर्िन करने, िम्मू और कश्मीर में सुरक्षा
बलों पर जनरंतर पर्राि सजहत जिजधजिरुद्ध दियाकलापों को अंिाम िेने के जलए पादकस्ट्तान और उसके प्रॉक्सी संगठनों
सजहत जिजभन्न स्रोतों के माध्यम से धन िुटाने में सजम्मजलत रहे हैं;
और, एमएलिेके -एमए और उसके सिस्ट्य अपनी गजतजिजधयों से िेि की संिैधाजनक सत्ता और संिैधाजनक
व्यिस्ट्र्ा के प्रजत सरासर अनािर दिखाते हैं;
और, एमएलिेके -एमए और इसके नेता और सिस्ट्य, जििेष रूप से इसके अध्यक्ष मसरत आलम भट, जिजधजिरुद्ध
दियाकलापों में जलप्त रहे हैं, िो िेि की अखंडता, संप्रभुता, सुरक्षा और सांप्रिाजयक सद्भाि के जलए हाजनकारक हैं;
और, प्रजतबंजधत आतंकिािी संगठनों के सार् एमएलिेके-एमए के संबंध दिखाने िाले कई इनपुट र्े ;

और, एमएलिेके-एमए और उसके सिस्ट्य िेि में आतंक का िासन स्ट्र्ाजपत करने के इरािे से आतंकिािी
दियाकलापों का समर्िन करने में सजम्मजलत रहे हैं, जिससे राज्य की सुरक्षा और साििजनक व्यिस्ट्र्ा को खतरे में डाला
गया है, और इसके राष्ट्र जिरोधी दियाकलाप, राज्य की सांजिधाजनक सत् ता और संप्रभुता के प्रजत अनािर और अिञा ा को भी
ििािते हैं, इसजलए संगठन के जिरुद्ध तत्काल और त्िररत कारिाई की आिश्यकता है;
और, केंद्रीय सरकार की यह राय है दक यदि मुजस्ट्लम लीग िम्मू कश्मीर (मसरत आलम गुट) के जिजधजिरुद्ध
दियाकलापों पर तत्काल कोई प्रजतबन्ध नहीं लगाया गया या उसे जनयंजत्रत नहीं दकया गया, तो िह इस अिसर को
जनम्नजलजखत हेतु प्रयोग करेगी -
(i)
राष्ट्र-जिरोधी गजतजिजधयों को िारी रखने, िो िेि की क्षेत्रीय अखंडता, सुरक्षा एिं संप्रभुता के जलए
हाजनकारक हैं;
(ii)
भारत संघ में िम् मू-कश् मीर के अजधजमलन पर जििाि करते हुए इसको भारत संघ से पृर्क करने का
समर्िन िारी रखने;
(iii)
भारत के जिरुद्ध असंतोष पैिा करने और लोक व्यिस्ट्र्ा को बाजधत करने के आिय से िम्मू-कश्मीर की
िनता के बीच जमथ् या कर्न और राष्ट्र-जिरोधी भािनाओं का प्रचार िारी रखने;
और, उपयुिक्त कारणों से केंद्रीय सरकार का यह िृढ़ मत है दक मुजस्ट्लम लीग िम्मू कश्मीर (मसरत आलम गुट) की
गजतजिजधयों को ध्यान में रखते हुए, मुजस्ट्लम लीग िम्मू कश्मीर (मसरत आलम गुट) को तत्काल प्रभाि से ‘ जिजधजिरुद्ध
संगम ’घोजषत करना आिश्यक है;
अब, इसीजलए, केंद्रीय सरकार, जिजधजिरुद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) की धारा
3 की उप-धारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए मुजस्ट्लम लीग िम्मू कश्मीर (मसरत आलम गुट) को एक
'जिजधजिरुद्ध संगम' घोजषत करती है।
और, उपरोक्त पररजस्ट्र्जतयों को ध्यान में रखते हुए, केंद्रीय सरकार का यह िृढ़ मत है दक मुजस्ट्लम लीग िम्मू
कश्मीर (मसरत आलम गुट) को तत्काल प्रभाि से एक 'जिजधजिरुद्ध संगम' घोजषत करना आिश्यक है और तिनुसार, केंद्रीय
सरकार, उक्त अजधजनयम की धारा 3 की उप-धारा (3) के परंतुक द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, जनिेि िेती है
दक यह अजधसूचना, उक्त अजधजनयम की धारा 4 के अधीन दकए गए दकसी आिेि के अध्याधीन, रािपत्र में इसके प्रकािन
की तारीख से पांच िषि की अिजध के जलए प्रभािी होगी।

NOTIFICATION
New Delhi, the 27th December, 2023
S.O. 5462(E).—Whereas, the Muslim League Jammu Kashmir (Masarat Alam faction) (hereinafter referred
to as the MLJK-MA), chaired by Masarat Alam Bhat is known for its anti-India and pro-Pakistan propaganda;
And, whereas, the objectives of MLJK-MA are to get freedom of Jammu and Kashmir from India so as to
realize the merger of Jammu and Kashmir with Pakistan and establish Islamic rule in Jammu and Kashmir;
And, whereas, the members of the MLJK-MA have been indulging in the secessionist activities in the
Jammu and Kashmir;
And, whereas, the leaders and members of the MLJK-MA have been involved in raising funds through
various sources including Pakistan and its proxy organisations for perpetrating unlawful activities, including
supporting terrorist activities, sustained stone-pelting on Security Forces in Jammu and Kashmir;
And, whereas, the MLJK-MA and its members by their activities show sheer disrespect towards the
constitutional authority and constitutional set up of the country;
And, whereas, the MLJK-MA and its leaders and members, particularly its Chairman Masarat Alam Bhat,
have been indulging in unlawful activities, which are prejudicial to the integrity, sovereignty, security and communal
harmony of the country;

And, whereas, there had been a number of inputs showing linkages of the MLJK-MA with banned terrorist
organisations;
And, whereas, the MLJK-MA and its members have been involved in supporting terrorist activities with an
intent to create a reign of terror in the country, thereby endangering the security and public order of the State, and its
anti-national activities also show disrespect and disregard to the constitutional authority and sovereignty of the State,
hence an immediate and prompt action is required against the organisation;
And, whereas, the Central Government is of the opinion that if there is no immediate curb or control of
unlawful activities of the Muslim League Jammu Kashmir (Masarat Alam faction), it will use this opportunity to –
(i)
continue with the anti-national activities which are detrimental to the territorial integrity, security
and sovereignty of the country;
(ii)
continue advocating the secession of Jammu and Kashmir form the Union of India while disputing
its accession to the Union of India; and
(iii)
continue propagating false narrative and anti-national sentiments among the people of Jammu and
Kashmir with the intention to cause disaffection against India and disrupt public order;
And, whereas, the Central Government for the above-mentioned reasons is firmly of the opinion that having
regard to the activities of the Muslim League Jammu Kashmir (Masarat Alam faction), it is necessary to declare the
Muslim League Jammu Kashmir (Masarat Alam faction) as an ‘unlawful association’ with immediate effect;
Now, Therefore, in exercise of the powers conferred by sub-section (1) of the section 3 of the Unlawful
Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Muslim League Jammu
Kashmir (Masarat Alam faction) as an unlawful association;
The Central Government, having regard to the above circumstances, is of firm opinion that it is necessary to
declare the Muslim League Jammu Kashmir (Masarat Alam faction) as an ‘unlawful association’ with immediate
effect, and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said
Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under
section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette.
