सा.का.जन. 3(अ).—केंद्रीय सरकार, भारत-जतब्बत सीमा पुजलस बल अजधजनयम, 1992 (1992 का 35) की

धारा 156 की उप-धारा (2) के खंड (ख) द्वारा प्रित्त िजियों का प्रयोग करते हुए और भारत-जतब्बत सीमा पुजलस बल,

उप कमांडेंट (कायाालय) और उप कमांडेंट (प्रधान जनिी सजचव), समूह ‘क’ पि भती जनयम, 2011 को, उन बातों के जसवाय

अजधक्ांत करते हुए जिन् हें से अजधक्मण से पहले दकया गया है, या करने का लोप दकया गया है, गृह मंत्रालय के भारत-

जतब् बत सीमा पुजलस बल में उप कमांडेंट (कायाालय) और उप कमांडेंट (प्रधान जनिी सजचव), समूह ‘क’ पिों पर भती की

पद्धजत का जवजनयमन करने के जलए जनम् नजलजखत जनयम बनाते हैं, अर्ाात् :-

1.

संजिप् त नाम और प्रारंभ.—(1) इन जनयमों का संजिप् त नाम गृह मंत्रालय, भारत-जतब्बत सीमा पुजलस बल,

उप कमांडेंट (कायाालय) और उप कमांडेंट (प्रधान जनिी सजचव), समूह ‘क’ पि भती जनयम, 2023 है।

(2) ये रािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे।

2.

पिों की संख् या, वगीकरण और वेतन मैट्ररक्स में स्ट्तर.—उक् त पिों की संख्या, उनका वगीकरण और उससे संलग् न

वेतन मैट्ररक्स में उनका स्ट्तर या वेतनमान वे होंगे, िो इन जनयमों से उपाबद्ध अनुसूची के स्ट् तंभ (2) से स्ट् तंभ (4) में

जवजनर्िाष्ट हैं ।

भती की पद्धजत, आयु-सीमा, अहाताएं आदि.—उक् त पिों पर भती की पद्धजत, आयु-सीमा, अहाताएँ और उनसे

संबंजधत अन्य बातें वे होंगी िो उक् त अनुसूची के स्ट् तंभ (5) से (13) में जवजनर्िाष्ट हैं।

4.

जनरहाता.—वह व्यजि--

(क)

जिसने से व्यजि से जिसका पजत या जिसकी पत् नी िीजवत है, जववाह दकया है या जववाह की संजविा की

है; या

(ख)

जिसने अपने पजत या अपनी पत् नी के िीजवत रहते हुए दकसी व्यजि से जववाह दकया है या जववाह की संजविा

की है,

उि पिों में से दकसी पर जनयुजि का पात्र नहीं होगा:

परन् तु यदि केंद्रीय सरकार का यह समाधान हो िाता है दक सा जववाह से व् यजि और जववाह के अन् य पिकार को

लागू स्ट् वीय जवजध के अधीन अनुञेयेय है और सा करने के जलए अन् य आधार हैं तो वह दकसी व् यजि को इस जनयम के प्रवतान

से छूट िे सकेगी ।

5.

जचदकत् सक िृष् टया योग् यता.—इन जनयमों में दकसी बात के होते हुए भी, वे व् यजि, िो केन् द्रीय सिस्ट् त्र पुजलस बल में

स्ट् वास्ट् ् य िेख-रेख प्रणाली में यर्ाजवजनर्िाष् ट जचदकत् सा प्रवगा िेप-1 में है, इन जनयमों के उपबंधों के अधीन प्रोन् नजत के जलए

पात्र होंगे।

6.

जिजर्ल करने की िजि.—िहाँ केन् द्रीय सरकार की यह राय हैं दक सा करना आवश् यक या समीचीन है, वहां वह

उसके जलए िो कारण हैं उन् हें लेखबद्ध करके इन जनयमों के दकसी उपबंध को दकसी वगा या प्रवगा के व् यजियों की बाबत,

आिेि द्वारा जिजर्ल कर सकेगी।

7.

अजधवर्षाता.— उप कमांडेंट (कायाालय) और उप कमांडेंट (प्रधान जनिी सजचव) का पि धारण करने वाले अजधकारी,

उस मास के, जिसमें वह साठ वषा की आयु प्राप् त करता है, अंजतम दिन के अपराह्न में सेवाजनवृत्त होगा:

परन् तु यह दक वह व् यजि, जिसके िन्म की तारीख दकसी मास की पहली तारीख होगी, साठ वषा की आयु प्राप् त करने

के पूवावती मास के अंजतम दिन के अपराह्न में सेवाजनवृत्त होगा।

8.

व् यावृजत्त.—इन जनयमों की कोई बात, से आरिण, आयु-सीमा में छूट और अन्य ट्ररयायतों पर प्रभाव नहीं डालेगी,

जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जनकाले गए आिेिों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत

िनिाजतयों, अन्य जपछडा वगा, भूतपूवा सैजनकों और अन्य जविेष प्रवगा के व्यजियों के जलए उपबंध करना अपेजित है।

प्रोन्नजत या प्रजतजनयुजि या आमेलन द्वारा भती की ििा में वे श्रेजणयां जिनसे प्रोन् नजत या प्रजतजनयुजि या आमेलन दकया

िाएगा

प्रोन् नजत द्वारा :

वेतन मैट्ररक् स के स्ट् तर-10 (56100-177500/-रू) में भारत-जतब् बत सीमा पुजलस बल के से सहायक कमांडेंट (कायाालय)

में से जिन् होंने उस स्ट् तर में पांच वषा की जनयजमत सेवा की है और जिन् होंने यर्ाजवजहत प्रोन् नजत-पूवा पाठ्यक्म सफलतापूवाक

पूरा दकया हो।

ट्रटप् पण 1: िहां से कजनष् ठ व् यजियों के संबंध में, जिन् होंने अपनी अहाक या पात्रता सेवा पूरी कर ली है, प्रोन् नजत के जलए

जवचार दकया िा रहा हो, वहां उनके ज् येष् ठ व् यजियों के संबंध में भी जवचार दकया िाएगा परंतु यह तब िब दक उनके द्वारा

की गई सी अहाक या पात्रता सेवा, अपेजित अहाक या पात्रता सेवा के आधे से अजधक से या िो वषा से, इनमें से िो भी कम

हो, कम न हो और उन् होंने अपने से कजनष् ठ व् यजियों सजहत जिन् होंने सी अहाक या पात्रता सेवा पहले ही पूरी कर ली है

अगली उच् चतर श्रेणी में प्रोन् नजत के जलए अपनी पट्ररवीिा की अवजध सफलतापूवाक पूरी कर ली हो।

यदि जवभागीय प्रोन् नजत सजमजत है, तो उसकी संरचना

भती करने में दकन पट्ररजस्ट्र्जतयों

में संघ लोक सेवा आयोग से

परामिा दकया िाएगा

जवचार दकया िा रहा हो, वहां उनके ज् येष् ठ व् यजियों के संबंध में भी जवचार दकया िाएगा परंतु यह तब िब दक उनके

द्वारा की गई सी अहाक या पात्रता सेवा, अपेजित अहाक या पात्रता सेवा के आधे से अजधक से या िो वषा से, इनमें से िो

भी कम हो, कम न हो और उन् होंने अपने से कजनष् ठ व् यजियों सजहत जिन् होंने सी अहाक या पात्रता सेवा पहले ही पूरी

कर ली है अगली उच् चतर श्रेणी में प्रोन् नजत के जलए अपनी पट्ररवीिा की अवजध सफलतापूवाक पूरी कर ली हो।

NOTIFICATION

New Delhi, the 29th December, 2023

G.S.R. 3(E).—In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the

Indo-Tibetan Border Police Force Act, 1992 (35 of 1992) and in supersession of the Indo-Tibetan Border Police

Force, Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary), Group ‘A’ Posts,

Recruitment Rules, 2011, except as respects things done or omitted to be done before such supersession, the Central

Government hereby makes the following rules regulating the method of recruitment to the posts of Deputy

Commandant (Office) and Deputy Commandant (Principal Private Secretary) in the Indo-Tibetan Border Police

Force, Ministry of Home Affairs, namely :-

1.

Short title and commencement.—(1) These rules may be called the Ministry of Home Affairs, Indo-

Tibetan Border Police Force, Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary),

Group ‘A’ Posts, Recruitment Rules, 2023.

They shall come into force on the date of their publication in the Official Gazette.

2.

Number of post, classification and level in the pay matrix.—The number of the said posts, their

classifications and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule.

3.

Method of recruitment, age-limit and other qualifications, etc..—The method of recruitment, age-limit,

qualifications and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the said

Schedule.

4.

Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so doing,

exempt any person from the operation of this rule.

5.

Medical fitness.—Notwithstanding anything contained in these rules, those persons who are in medical

category SHAPE-I, as specified in Health Care System in the Central Armed Police Forces, shall be eligible for

promotion under the provisions of these rules.

6.

Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do,

it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any

class or category of persons.

7.

Superannuation.—Officers holding the post of Deputy Commandant (Office) and Deputy Commandant

(Principal Private Secretary) shall retire from service on the afternoon of the last day of the month in which they

attain the age of sixty years:

Provided that an officer whose date of birth is on the first day of a month shall retire from service on the

afternoon of the last day of the preceding month on attaining the age of sixty years.

8.

Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, other backward classes, the Ex-servicemen

and other special categories of persons in accordance with the orders issued by the Central Government from time to

time in this regard.

Note 1: Where juniors who have completed their qualifying or eligibility service are being considered for

promotion, their seniors would also be considered provided they are not short of the requisite qualifying or

eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and

have successfully completed their probation period for promotion to the next higher grade along with their juniors

who have already completed such qualifying or eligibility service.
