का.अ. 60(ऄ).—केन्द्रीय सरकार द्वारा पैरोजलयम और खजनज पाआपलाआंस (भूजम में ईपयोग के ऄजधकार का
ऄजजन) ऄजधजनयम, 1962 (1962 का 50) (जजसे आसमें आसके पश्चात ईक् त ऄजधजनयम कहा गया है) की धारा 3 की
ईपधारा (1) के ऄधीन, भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का.अ. 3700(ऄ),
ददनांक 31 ऄगस्ट्त, 2021, भारत के राजपत्र सं. 3388 ददनांक 13 जसतम् बर, 2021, में प्रकाजित की गइ थी, आस
ऄजधसूचना से संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में कृष्णपट्नम – हैदराबाद पैरोजलयम पाआपलाआन पररयोजाना हेतु
तहसील-मुनुगोड, जजला-नलगोंडा, राज्य-तेलंगणा मे पेरोजलयम के पररवहन हेतु भारत पैरोजलयम कापोरेिन जलजमटेड
द्वारा पाआपलाआन जबछाने के प्रयोजन के जलए ईपयोग के ऄजधकार के ऄजजन हेतु ऄपने अिय की घोषणा की थी ;
और ईक् त राजपत्र ऄजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को ददनांक- 30.11.2021 तक ईपलब्ध करा दी
गइ थी ;
और श्री एम. नारायण राव सक्षम प्राजधकारी ने, ईक् त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय
सरकार को ररपोटज दे दी है ;
और केन्द्रीय सरकार ने, ईक् त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो जाने पर दक ईक् त भूजम में
पाआपलाआन जबछाने के जलये ऄपेजक्षत है, ईसमें ईपयोग के ऄजधकार का ऄजजन करने का जवजनश्चय दकया है ;

ऄतः ऄब, केन्द्रीय सरकार, ईक् त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए
एतदद्वारा यह घोषणा करती है दक आस ऄजधसूचना से संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में पाआपलाआन जबछाने के जलए
ईपयोग के ऄजधकार का ऄजजन दकया जाता है ;
और केन्द्रीय सरकार ईक् त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, यह
जनदेि देती है दक ईक् त भूजम में ईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने
की बजाए, सभी जवल्लंगमों से मुि होकर भारत पेरोजलयम कापोरािन जलजमटेड में जनजहत होगी ;
पेरोजलयम और खजनज पाआपलाआन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए भारत
पेरोजलयम कापोरािन जलजमटेड पूणजतया ईत्तरदायी होगा और पाआपलाआन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय
सरकार के जवरूद्ध कोइ वाद, दावा या कानूनी कायजवाही नहीं हो सकेगी ।

MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New Delhi, the 3rd January, 2024
S.O. 60(E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum and
Natural Gas vide S.O. No. 3700(E) Dated-31 August, 2021 published in the Gazette of the India Gazette No. 3388
dated-13th-2021 under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of
User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared its
intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose
of laying “Krishnapatnam - Hyderabad Petroleum Pipeline” for the transportation of Petroleum products in Tehsil-
Munugode, District-Nalgonda in the state of Telangana by Bharat Petroleum Corporation Limited;
And whereas copies of the said Gazette notification were made available to the public up to 30.11.2021and
whereas Shri M. Narayan Rao Competent Authority has under sub-section (1) of section 6 of the said Act submitted
report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall instead of vesting in the
Central Government, vests on the date of publication of this declaration in Bharat Petroleum Corporation Limited, free
from all encumbrances;
Bharat Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of Section
10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would be against the Central Government on any
matter relating to the pipeline.
