का.अ. 76(ऄ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाआपलाआन (भूजम मे ईपयोग के ऄजधकार का ऄिजन)

ऄजधजनयम, 1962 (1962 का 50) (जिसे आसमें आसके पश्चात ईक्त ऄजधजनयम कहा गया है) की धारा 3 की ईपधारा (1) के

ऄधीन िारी की गइ भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना संख्या का॰ अ॰ 3262(ऄ),

ददनांक-20 िुलाइ-2023, भारत के रािपत्र सं०-3129 ददनांक-21 िुलाइ-2023, में प्रकाजित की गइ थी, आस

ऄजधसूचना से संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में ईत्तर प्रदेि राज्य में “कांडला-गोरखपुर एल.पी.िी पाआपलाआन

पररयोिना हेतु तहसील-सदर, जिला-वाराणसी, राज्य-ईत्तर प्रदेि में एल.पी.िी के पररवहन हेतु अइ.एच.बी.जलजमटेड

द्वारा पाआपलाआन जबनाने के प्रयोिन के जलए ईपयोग के ऄजधकार के ऄिजन के ऄपने अिय की घोाणा की थी

और ईक्त रािपत्र ऄजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को ददनांक-31 िुलाइ-2023 तक ईपलब्ध करा दी

गइ थी,

और श्री राकेि कुमार सक्षम प्राजधकारी ने ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) के ऄधीन केन्द्रीय सरकार

को ररपोटज दे दी है,

और केन्द्रीय सरकार ने, ईक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िाने पर दक ईक्त भूजम

पाआपलाआन जबनाने के जलए ऄपेजक्षत है, ईसमे ईपयोग के ऄजधकार के ऄिजन करने का जवजनश्चय दकया है;

ऄतः ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए

एतद द्वारा यह घोाणा करती है दक आस ऄजधसूचना से संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में पाआपलाआन जबनाने के जलए

ईपयोग के ऄजधकार का ऄिजन दकया िाए,

और केन्द्रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (4) द्वारा प्रदत िजक्तयों का प्रयोग करते हुए, यह

जनदेि देती है दक ईक्त भूजम में ईपयोग के ऄजधकार आस घोाणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के

बिाए, सभी जवल्लंगमो से मुक्त होकर अइ.एच.बी.जलजमटेड में जनजहत होगी,

पेरोजलयम और खजनि पाआपलाआन ऄजधजनयम,1962 की धारा 10 के ऄधीन दकसी भी क्षजतपूर्तत के जलए

अइ.एच.बी. जलजमटेड पूणजतया ईत्तरदायी होगा और पाआपलाआन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के

जवरुद्ध कोइ वाद, दावा या कानूनी कायजवाही नहीं हो सकेगी

NOTIFICATION

New Delhi, the 3rd January, 2024

S.O.76(E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum and

Natural Gas vide S.O. No. 3262(E) Dated-20 July-2023 published in the Gazette of the India Gazette No.3129

dated-21 July-2023 under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right

of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared

its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the

purpose of laying “Kandla-Gorakhpur LPG Pipeline Project” for the transportation of LPG in Tehsil- Sadar,

District-Varanasi in the state of Uttar Pradesh by IHB Limited.

And whereas copies of the said Gazette notification were made available to the public up to 31 July -2023

and whereas the Shri Rakesh Kumar Competent Authority has under sub-section (1) of section 6 of the said Act

submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said

land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline.

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central

Government hereby directs that the right of user in the said land for laying the pipeline shall instead of vesting in

the Central Government, vests on the date of publication of this declaration in IHB Limited, free from all

encumbrances.

IHB Limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act,

1962 and no suit, claim or legal proceeding would be against the Central Government on any matter relating to the

pipeline.
