का.आ. 95(अ).—केंद्रीय सरकार, संयुक्त राष्ट्र (सुरक्षा पररषद) अजधजनयम, 1947 (1947 का 43) की धारा 2

द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए कांगो के लोकतांजत्रक गणराज्य संबंधी संकल्पों के दियान्ियन आदेि, 2016 संयुक्त

राष्ट्र सुरक्षा पररषद में संिोधन करने के जलए जनम्नजलजखत आदेि देती है, अर्ाात्:-

1. संजक्षप्त नाम और प्रारंभ- (1) इस आदेि का संजक्षप्त नाम संयुक्त राष्ट्र सुरक्षा पररषद् के कांगो के लोकतांजत्रक गणराज्य

संबंधी संकल्पों का दियान्ियन (संिोधन) आदेि, 2024 है।

(1) यह रािपत्र में प्रकािन की तारीख से प्रिृत्त होगा।

संयुक्त राष्ट्र सुरक्षा पररषद् के कांगो के लोकतांजत्रक गणराज्य संबंधी संकल्पों के दियान्ियन आदेि, 2016 की

अनुसूची में अनुबंध 2 में, िीषाक “क व्यजक्त” के अधीन, प्रजिजि सीडीआई.036 के पश्चात जनम्नजलजखत प्रजिजियााँ रखी

िाएंगी, अर्ाात्:

अस्ट्पतालों पर हमले भी िाजमल हैं"; और "दकसी अजभजहत व्यजक्त या इकाई की ओर से या उसके जनदेि पर काया करना, या

दकसी अजभजहत व्यजक्त या इकाई के स्ट्िाजमत्ि या जनयंत्रण िाली इकाई की ओर से या उसके जनदेि पर काया करना" के रूप

में सूचीबद्ध, िैसा दक संकल्प 2688 (2023) के पैरा 2 द्वारा पुनः पुजि की गई है। एफडीएलआर (सीडीई.005) के सरगना

के रूप में, उसके पास दल के लडाकों पर प्रभािी कमान और जनयंत्रण है;

व्यजक्त या इकाई के स्ट्िाजमत्ि या जनयंत्रण िाली इकाई की ओर से या उसके जनदेि पर काया करना", के रूप में सूचीबद्ध,

िैसा दक संकल्प 2688 (2023) के पैरा 2 में पुनः पुजि की गई है। एम23 (सीडीई.006) के सरगना के रूप में, िह सिस्त्र

समूह की गजतजिजधयों का प्रचार और समर्ान करने में संजलप्त है। उसे िनिरी, 2023 में कांगो की ररिोल्यूिनरी आमी,

एम23 सिस्त्र िाखा का जिगेजडयर बनाया गया र्ा। उसके बाद उसे सुल्तानी माकेंगा (सीडीआई.008) का चीफ ऑफ स्ट्टाफ

और जडप्टी बनाया गया, और तब से इसने डीआरसी में प्रत्येक एम23 ऑपरेिन के जलए योिना को अंजतम रूप ददया है।

उसकी जगरफ्तारी के जलए कांगो के प्राजधकाररयों द्वारा िारंट िारी दकया गया है।''

S.O. 95(E).— In exercise of the powers conferred by section 2 of the United Nations (Security Council) Act,

1947 (43 of 1947), the Central Government hereby makes the following Order to amend the Implementation of the

United Nations Security Council Resolutions on Democratic Republic of Congo Order, 2016, namely:

1. Short title and commencement.– (1) This Order may be called the Implementation of the United Nations Security

Council Resolutions on Democratic Republic of Congo (Amendment) Order, 2024.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In the Implementation of the United Nations Security Council Resolution on Democratic Republic of Congo Order,

2016, in the Schedule, in Annexure 2, under the heading “A Individuals”, after the entry CDi. 036, the following

entries shall be inserted, namely:

paragraph 2 of resolution 2688 (2023). As a leader of M23 (CDe.006), he is involved in promulgating and supporting

the armed group’s activities. He was promoted in January 2023 to Brigadier for the Congolese Revolutionary Army,

the M23 armed branch. He was then appointed chief of staff and deputy to SULTANI MAKENGA (CDi.008), and has

validated the planning for every M23 operations in DRC since then. A warrant has been issued by Congolese

authorities for his arrest.”.
