रेल अजधजनयम, 1989 की धारा 20ड़ के अंतगडत सूचना
का.आ. 144(अ).—केन्द्रीय सरकार ने रेल अजधजनयम, 1989 (1989 का 24) (जिसके पश्चात अजधजनयम कहा गया है) की
धारा 20क की उप धारा (1) के अधीन िारी, भारत के रािपत्र, असाधारण, भाग II खण्ड 3, उप खण्ड (ii) तारीख 22 नवम्बर 2023
में प्रकाजित, भारत सरकार के रेल मंत्रालय (पूवड मध्य रेलवे) की अजधसूचना संख्या का आ. 5027 (अ) 22 नवम्बर 2023 द्वारा उक्त
अजधसूचना से उपाबद्ध अनुसूची में जवजनर्िडष्ट को जबहार राज्य के औरंगाबाि जिले में जविेष रेल पररयोिना, बगहा जबिुनपुर से जचराला
पोथु स्ट्टेिन के मध्य सोननगर बाईपास रेलवे लाइन (10 दक.मी.) के जनष्पािन, अनुरक्षन, प्रबंध और प्रचालन के प्रयोिन के जलए अर्िडत
करने के अपने आिय की घोषणा की थी.
और उक्त अजधसूचना का सार, उक्त अजधजनयम की धारा 20क की उपधारा (4) के अधीन िैजनक स्ट्थानीय समाचार पत्रों,
अथाडत ि टाइम्स आफ इंजडया (पटना संस्ट्करण) तारीख 01 दिसंबर 2023 एवं हहंिुस्ट्तान (गया संस्ट्करण) तारीख 01 दिसंबर 2023 को
प्रकाजित दकया गया था।
और सक्षम प्राजधकारी को आक्षेप प्राप्त हुए थे, सक्षम अजधकारी द्वारा उन आक्षेपों की सुनवाई की गयी एंव उक्त अजधजनयम की
धारा 20घ के अनुसरण में आिेि पाररत कर दिये गए है I
और सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 20ड़ की उपधारा (1) के अनुसरण में अपनी ररपोटड सौंप िी है।

अतः अब, केन्द्रीय सरकार, सक्षम प्राजधकारी से ररपोटड प्राप्त होने पर और उक्त अजधजनयम की धारा 20 ड़ की उपधारा (1)
द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह घोषणा करती है दक उपाबद्ध अनुसूची भूजम जवजनर्िडष्ट भूजम पुवोक्त प्रयोिन के जलए अर्िडत
की िाएगी।
अतः यह दक केन्द्रीय सरकार उक्त अजधजनयम की धारा 20 ड़ की उपधारा (2) के अनुसरण में यह घोषणा करती है दक इस
अजधसूचना में रािपत्र में प्रकाजित होने पर इस से उपाबद्ध अनुसूची में जवजनर्िडष्ट भूजम सभी जवल्लंगमों से मुक्त हो कर केन्द्रीय सरकार
में आत्यंजतक रूप से जनजहत हो िाएगी।

NOTIFICATION
New Delhi, the 5th January, 2024
Notice under Section 20E of the Railway Act, 1989
S.O. 144(E).—Whereas, by the notification of the Government of India in the Ministry of Railways (East
Central Railway), number S.O 5027(E), dated the 22 November, 2023 published in the Gazette of India,
Extraordinary, Part-ii, section 3, Sub-section (2), dated the 22 November, 2023 and issued under sub-section (1) of
section 20A of the Railways Act, 1989 (24 of 1989) (here in after referred as the said Act), the Central Government
declared its intention to acquire the land in the schedule annexed to the said notification for the purpose of execution,
maintenance, management and operation of the Special Railway Project namely "Sonenagar Byepass between
Chiraila Pouthu and Bagahabishunpur station (10 KM) Rail Project" in Aurangabad District in the State of Bihar.

And whereas, the substance of the said notification has been published in the daily local newspapers, namely,
Times of India (Patna Edition) of dated 01 December, 2023 and Hindustan (Gaya Edition) of dated 01 December,
2023 under sub-section (4) of section 20A of the said Act,
And whereas, objections were received; Competent Authority has heard the objections and orders have been
passed in terms of section 20 D of the said act;
And whereas, in pursuance of sub-section (1) of section 20E of the said Act, the Competent Authority has
submitted its report to the Central Government.
Now therefore, upon receipt of the report of the Competent Authority and in exercise of the powers conferred
by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the land specified in
the Schedule annexed hereto shall be acquired for the aforesaid purpose.
And further, in the pursuance of sub-section (2) of section 20E of the said Act, the Central Govt. hereby
declares that on publication of the notification in the Official Gazette, the land specified in the Schedule annexed
hereto shall vest absolutely in the Central Government free from all encumbrances.

Brief description of the land to be acquired, with or without structures for the Special Railway Project
