सा.का.जन.38(अ).—िबदक मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उप-धारा (1) की

अपेक्षानुसार, केंद्रीय मोटर यान जनयमावली, 1989 में और संिोधन करने के जलए भारत सरकार के सड़क पररवहन और

रािमागग मंत्रालय की अजधसूचना संख्या सा.का.जन. 723(अ), तारीख 5 अक्टूबर, 2023 के द्वारा भारत के रािपत्र,

असाधारण, भाग-2, खंड 3, उप-खंड (i), तारीख 6 अक्टूबर, 2023 में प्ररूप जनयम प्रकाजित दकए गए थे, जिन् हें उनके

द्वारा प्रभाजवत होने की संभावना वाले सभी व्यजियों से उक् त प्रारूप जनयमों के रािपत्र में प्रकाजित होने की तारीख से

तीस दिन की अवजध समाप्त होने से पहले आपजियां और सुझाव आमंजत्रत करते हुए प्रकाजित दकया गया था, जिसको

रािपत्र में यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध कराई गई थी;

और, िबदक उक् त अजधसूचना की प्रजतयां 06 अक् टूबर, 2023 को िनता को उपलब् ध करा िी गयीं थीं;

और, िबदक उक् त प्रारूप जनयमों के सम् बन् ध में िनता से कोई आपजियां और सुझाव प्राप् त नहीं हुए थे;

अत:, अब, केन्द्रीय सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रिि िजियों का

प्रयोग करते हुए, केंद्रीय मोटर यान जनयमावली, 1989 में और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है,

अथागत्: -

1. (1) इन जनयमों का संजक्षप्त नाम केंद्रीय मोटर यान (िूसरा संिोधन) जनयमावली, 2024 है।

(2) ये जनयम रािपत्र में अपने प्रकािन की तारीख से प्रवृत् त होंगे।

2. केंद्रीय मोटर यान जनयमावली,1989 (जिसे इसमे इसके पश्चात उि जनयमावली कहा गया है) के जनयम 15 के

उप-जनयम (3) में,-

(क) खंड (क) में, िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि" िब्ि रखे

िाएंगे;

(ख) खंड (च) में, िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि" िब् ि रखे

िाएंगे;

(ग) खंड (ि) में िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि" िब् ि रखे

िाएंगे;

(घ) खंड (फ) के उप-खंड (ii) में िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि"

िब् ि रखे िाएंगे।

3. उक् त जनयमावली के जनयम 31 के, उप-जनयम (1) में, िीषगक “क. ड्राइववंग जसद्ांत-I” के सामने क्रम सं. 2 में िब्ि

"ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि" िब् ि रखे िाएंगे।

4. उक् त जनयमावली के जनयम 62 में, उप-जनयम (1) में, प्रथम परंतुक में, सारणी में क्रम सं. (6) के सामने स्ट्तम्भ 2 में िब्ि

5. उक् त जनयमावली के जनयम 93 में,

(क) उप-जनयम (1) के, खंड (ख) में,

(i) उप-खंड (i) में, िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए ररयर-व्यू जमरर या युजि" िब् ि

रखे िाएंगे;

(ii) उप-खंड (iii) में मि सं.(ख) में, स्ट्पिीकरण III के, रटप्पण में, िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष

िृजि के जलए युजि" िब् ि रखे िाएंगे;

(ख) उप-जनयम (2) के खंड (2) में, पहले स्ट्पिीकरण में, मि (क) में, उप-खंड (viii) के, पहले परंतुक में, पैरा (ख) में,

िब्ि "ररयर-व्यू जमरर" के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए युजि" िब्ि रखे िाएंगे;

(ग) उप-जनयम (3) में, िब्ि "ड्राइववंग जमरर" के स्ट्थान पर, "अप्रत्यक्ष िृजि के जलए युजि" िब्ि रखे िाएंगे;

(घ) उप-जनयम (4) में, िब्ि "ड्राइववंग जमरर" के स्ट्थान पर, "अप्रत्यक्ष िृजि के जलए युजि" िब्ि रखे िाएंगे;

6. उक् त जनयमावली के जनयम 124 में, उप-जनयम (4) में, सारणी में, क्र. सं. 8 के सामने, स्ट्तम्भ (2) में "ररयर-व्यू जमरर"

िब्िों के स्ट् थान पर "अप्रत्यक्ष िृजि के जलए युजि" िब् ि रखे िाएंगे;

7. उक् त जनयमावली के जनयम 125 के, उप-जनयम (2) में,-

(क) िब्ि "ररयर-व्यू जमरर" के स्ट्थान पर "अप्रत्यक्ष िृजि के जलए ररयर व्यू जमरर या युजि" िब्ि रखे िाएंगे;

(ख) पहले परंतुक में, -

(i) खंड (ख) के पश् चात्, जनम्नजलजखत खंड को अंत:स्ट् थाजपत दकया िाएगा, अथागत्: -

“(ख-1) केंद्रीय मोटर यान (िूसरा संिोधन) जनयमावली, 2024 के प्रारंभ होने की तारीख से बारह मास के पश्चात

जनर्मगत बॉडी वकग सजहत एल 5 श्रेणी (तीन पजहया वाहन) के जलए अप्रत्यक्ष िृजि के जलए युजि जवजनिेि और संस्ट्थापन

आवश्यकताएं क्रमिः एआईएस -001 (भाग 1) (संिोधन 2): 2023 और एआईएस -002 (भाग 1) (संिोधन 2): 2023

मानक में जनर्िगि होंगी, िैसा दक समय-समय पर संिोजधत दकया गया है, िब तक दक भारतीय मानक ब्यूरो अजधजनयम,

2016 (2016 का 11) के अधीन संबंजधत बीआईएस जवजनिेिों को अजधसूजचत नहीं दकया िाता है”;

(ii) खंड (ग) के पश् चात्, जनम्नजलजखत खंड को अंत:स्ट् थाजपत िाएगा, अथागत्: -

“(ग-1) केंद्रीय मोटर यान (िूसरा संिोधन) जनयमावली, 2024 के प्रारंभ होने की तारीख से बारह मास के पश्चात

जवजनर्मगत एम और एन श्रेणी के यानों के जलए, अप्रत्यक्ष िृजि के जलए युजि जवजनिेि और संस्ट्थापन आवश्यकताएं क्रमिः

एआईएस -001 (भाग 1) (संिोधन 2): 2023 और एआईएस -002 (भाग 1) (संिोधन 2): 2023 मानक में जनर्िगि होंगी,

िैसा दक समय-समय पर संिोजधत दकया गया है, िब तक दक भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) के

अधीन संबंजधत बीआईएस जवजनिेिों को अजधसूजचत नहीं दकया िाता है”;

(ग) जद्वतीय परंतुक के पश्चात, जनम्नजलजखत परंतुक को अंत:स्ट् थाजपत दकया िाएगा, अथागत्: -

“ परंतु यह और दक, केंद्रीय मोटर यान (िूसरा संिोधन) जनयमावली, 2024 के प्रारंभ होने की तारीख से बारह मास

के पश्चात जवजनर्मगत एल 7 श्रेणी के यानों के जलए, अप्रत्यक्ष िृजि के जलए युजि जवजनिेि और संस्ट्थापन आवश्यकताएं

क्रमिः एआईएस -001 (भाग 1) (संिोधन 2): 2023 और एआईएस -002 (भाग 1) (संिोधन 2): 2023 मानक में

जनर्िगि होंगी, िैसा दक समय-समय पर संिोजधत दकया गया है, िब तक दक भारतीय मानक ब्यूरो अजधजनयम, 2016

(2016 का 11) के अधीन संबंजधत बीआईएस जवजनिेिों को अजधसूजचत नहीं दकया िाता है:”;

(घ) चतुथग परंतुक के पश् चात्, जनम्नजलजखत परंतुक को अंत:स्ट् थाजपत दकया िाएगा, अथागत्: -

“परंतु यह भी दक केंद्रीय मोटर यान (िूसरा संिोधन) जनयमावली, 2024 के प्रारंभ होने की तारीख से बारह मास के पश्चात

जवजनर्मगत कृजष रैक्टरों के जलए अप्रत्यक्ष िृजि के जलए युजि जवजनिेिों और संस्ट्थापन आवश्यकताएं क्रमिः एआईएस -001

(भाग 1) (संिोधन 2): 2023 और एआईएस: 114-2009 मानकों के अनुरूप होंगे, िब तक दक संबंजधत बीआईएस

जवजनिेिों को भारतीय मानक ब्यूरो अजधजनयम 2016 (2016 का 11) के अधीन अजधसूजचत नहीं दकया िाता है:”;

8. उक् त जनयमावली के जनयम 125-क में, िब्ि "ररयर व्यू जमरर" के स्ट्थान पर, िोनों स्ट्थानों पर िहां वे आते हैं, "अप्रत्यक्ष

िृजि के जलए ररयर व्यू जमरर या युजि" िब्ि रखे िाएंगे।

9. उि जनयमावली के जनयम 125ग में, उप-जनयम (3) में, सारणी 1 में, क्रम सं. 22 के सामने, स्ट्तम्भ (2) में, िब्ि "ररयर

व्यू जमरर" के स्ट्थान पर "अप्रत्यक्ष िृजि के जलए ररयर व्यू जमरर या युजि" िब् ि रखे िाएंगे।

10. उि जनयमावली के जनयम 128 में, उप-जनयम (13) के, खंड (i) में, िब्ि "ररयर-व्यू जमरर" के स्ट्थान पर "अप्रत्यक्ष िृजि

के जलए ररयर व्यू जमरर या युजि" िब्ि रखे िाएंगे। .

11. उि जनयमावली के प्ररूप 22ख में भाग क के क्र.सं. 6.22 में, िब्ि "ररयर व्यू जमरर" के स्ट्थान पर "अप्रत्यक्ष िृजि के

जलए ररयर व्यू जमरर या युजि" िब्ि रखे िाएंगे।

12. मोटर यान (ड्राइववंग) जवजनयमन, 2017 में "ररयर व्यू जमरर" िब्ि, िहां भी वे आते हैं, के स्ट्थान पर "अप्रत्यक्ष िृजि के

जलए ररयर व्यू जमरर या युजि" िब्ि रखे िाएंगे।

NOTIFICATION

New Delhi, the 15th January, 2024

G.S.R.38(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were

published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide

notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 723(E), dated

the 5^th October, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), dated the 6^th October,

2023 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period

of thirty days from the date on which copies of the Gazette containing the said notification were made available to the

public;

And whereas copies of the said notification were made available to the public on the 6^th October, 2023;

And whereas no objections and suggestions were received from the public in respect of the said draft rules;

Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of

1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules,

1989, namely:-

1. (1) These rules may be called the Central Motor Vehicles (Second Amendment) Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989(hereinafter referred to as the said rules), in rule 15, in sub-rule(3),-

(a) in clause (a), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision "

shall be substituted;

(b) in clause (f), for the words "rear-view mirror", the words " rear-view mirror or device for indirect vision "

shall be substituted;

(d) in clause (v), in sub-clause (ii), for the words "rear-view mirror", the words " rear-view mirror or device for

indirect vision " shall be substituted.

3. In rule 31 of the said rules, in sub-rule (1), under the heading “A. DRIVING THEORY-I”, against serial

number 2, for the words "Rear-view mirror", the words "Rear-view mirror or device for indirect vision " shall be

substituted.

4. In rule 62 of the said rules, in sub-rule (1), in the first proviso, in Table, against serial number (6), in column 2, for

the words "Rear View Mirror", the words " Rear view mirror or device for indirect vision " shall be substituted.

5. In rule 93 of the said rules,-

(a) in sub-rule (1), in clause B,-

(i) in sub-clause (i), for the words "rear-view mirror", the words " rear view mirror or device for indirect

vision " shall be substituted;

(ii) in sub-clause (iii), in item number (b), in Explanation III, in Note, for the words "Rear view mirrors", the

words " device for indirect vision " shall be substituted;

(b) in sub-rule (2), in clause (2), in first Explanation, in item (A), in sub-item(viii), in first proviso, in

paragraph (b), for the words "rear view mirror", the words " device for indirect vision " shall be substituted;

(d) in sub-rule (4), for the words " a driving mirror ", the words " device for indirect vision" shall be substituted.

6. In rule 124 of the said rules, in sub-rule (4), in Table, against serial number 8, in column (2), for the words "Rear

view mirror", the words "device for indirect vision" shall be substituted.

7. In rule 125 of the said rules, in sub-rule(2),-

(a) for the words “with rear view mirror”, the words "with rear view mirror or device for indirect vision " shall

be substituted;

(b) in the first proviso,-

(i) after clause (b), the following clause shall be inserted, namely:-

“(b-1) for L5 category (three wheeled vehicles) with body work manufactured on and after the twelve months

from the date of commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the device for

indirect vision specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and

AIS-002 (Part 1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS

specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016);”;

(ii) after clause (c), the following clause shall be inserted, namely:-

“(c-1) for M and N category vehicles manufactured on and after the twelve months from the date of

commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision

specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part

1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications

are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016):”;

“Provided further that, for L7 category vehicles manufactured on and after the twelve months from the date of

commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision

specification and installation requirements shall be as specified in AIS-001 (Part 1) (Rev. 2): 2023 and AIS-002 (Part

1) (Rev.2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications

are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016):”;

(d) after the fourth proviso, the following proviso shall be inserted, namely:-

“Provided also that for agricultural tractors manufactured on and after the twelve months from the date of

commencement of the Central Motor Vehicles (Second Amendment) Rules, 2024, the devices for indirect vision

specifications and installation requirements shall conform to AIS-001(Part 1) (Rev.2): 2023 and AIS:114-2009

standards respectively as amended from time to time, till the corresponding BIS specifications are notified under the

Bureau of Indian Standards Act, 2016 (11 of 2016):”.

8. In rule 125A of the said rules, for the words “rear view mirror”, in both the places where they occur, the words,

“rear view mirror or device for indirect vision” shall be substituted.

9. In rule 125C of the said rules, in sub-rule (3), in TABLE 1, against serial number 22, in column (2), for the words

"Rear view mirror", the words " Rear view mirror or device for indirect vision " shall be substituted.

10. In rule 128 of the said rules, in clause (13), in sub-clause (i), for the words "rear-view mirrors", the words "rear

view mirror or device for indirect vision " shall be substituted.

11. In Form 22B of the said rules, in PART A, against serial number 6.22, for the words "rear view mirrors", the

words "rear view mirror or device for indirect vision " shall be substituted.

12. In Motor Vehicles (Driving) Regulations, 2017 for the words “rear view mirror”, wherever they occur, the words

“rear view mirror or devices for indirect vision” shall be substituted.
