सा.का.जन. 46(अ).—केन्‍द रीय सरकार, वन्‍दय िीव (संरक्षण) अजधजनयम, 1972 की धारा 44 की उपधारा (4) के

साथ परित धारा 63 की उपधारा (1) के खंड (झ) द्वारा प्रदत्त िजियों का प्रयोग करते हुए और वन्‍दय िीव (संरक्षण)

अनुज्ञापन (जवचाराथा अजतररि जवषय) जनयम, 1983 को अजधक्ांत करते हुए, जनम् नजलजखत जनयम बनाती ह , अथाात्:-

1.

संजक्षप् त नाम और प्रारंभ.—(1) वन्‍दय िीव (संरक्षण) अनुज्ञापन (जवचाराथा अजतररि जवषय) जनयम, 2024 ह ।

(2) ये उनके रािपत्र में प्रकािन की तारीख से प्रवृत् त होंगे ।

2. अनुज्ञजि प्रदान करने हेतु जवचार-जवमिा करने के जलए अजतररि जवषय.— वन्‍दय िीव (संरक्षण) अजधजनयम, 1972

की धारा 44 की उपधारा (1) में जनर्ददष्ट अनुज्ञजि प्रदान करने के प्रयोिन के जलए, यथाजस्ट्थजत, मुख्य वन्‍दय िीव वाडान

या प्राजधकृत अजधकारी, इस धारा की उपधारा (4) के खंड (ख) में जवजनर्ददष्ट जवषयों के अजतररि जनम्नजलजखत अन्‍दय

जवषयों को ध्यान रखेंगे, अथाात् :--

(i) ऐसे कारबार के जलए सुजवधाएं, उपस्ट्कर और पररसरों की उपयुिता के संबंध में संबद्ध कारबार को संचाजलत

करने की आवेदक की क्षमता ;

(ii) वह स्रोत और रीजत, जिसमें संबद्ध कारबार के जलए पूर्तत प्राि की िाएगी ;

(iii) संबद्ध क्षेत्र में पहले से जवद्यमान सुसंगत कारोबारों के जलए अनुज्ञजि की संख्या ;

परन्‍दतु कोई ऐसी अनुज्ञजि केन्‍दरीय सरकार के पूवा परामिा के जसवाय प्रदान नहीं की िाएगी, यदद वह अजधजनयम की

अनुसूची 1 में जवजनर्ददष्ट दकसी वन्‍दय पिु से संबंजधत ह ।

NOTIFICATION

New Delhi, the 16th January, 2024

G.S.R. 46(E).—In exercise of the powers conferred by clause (i) of sub-section (1) of section 63 of the Wild

Life (Protection) Act, 1972 (53 of 1972), read with clause (b) of sub-section (4) of section 44 and on supersession of

the Wild Life (Protection) Licensing (Additional Matters for Consideration) Rules, 1983, the Central Government

hereby makes the following rules, namely:-

Short title and commencement. – (1) These rules may be called the Wild Life (Protection) Licencing

(Additional Matters for Consideration) Rules, 2024’.

(2) They shall come into force on the date of their publication in the Official Gazette.

Additional matters for consideration for grant of licence.- For the purpose of granting a licence referred to in

sub-section (1) of section 44 of the Wild Life (Protection) Act, 1972, the Chief Wild Life Warden or the

authorised officer, as the case may be, shall in addition to the matters specified in clause (b) of sub-section

(4) of that section, have regard to the following other matters, namely:-

(i) capacity of the applicant to handle the business concerned with reference to facilities, equipment and

suitability of the premises for such business;

(ii) source and the manner in which the supplies for the business concerned would be obtained;

(iii) number of licence for the relevant business already in existence in the area concerned;

(iv) implications which the grant of such licence would have on the hunting or trade of wild animals

concerned:

Provided that no such licence shall be granted if it relates to any wild animal specified in Schedule I to the

Act, except with the previous consultation of the Central Government.
