सा.का.जन. 52(अ).—केन्द्रीय सरकार, खान और खजनि (जवकास और जवजनयमन) अजधजनयम, 1957 (1957 का

67) की धारा 13 द्वारा प्रित्त िजियों का प्रयोग करते हुए, खान (खजनि अंतववस्ट् तु का साक्ष्य) जनयम, 2015 में और

संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अर्ावत्:-

1. संजिप्त नाम और प्रारंभ.— (1) इन जनयमों का संजिप् त नाम खान (खजनि अंतववस्ट् तु का साक्ष्य) संिोधन जनयम,

2024 है।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत् त होंगे।

2. खान (खजनि अंतववस्ट् तु का साक्ष्य) जनयम, 2015 (जिसे इसमें इसके पश् चात् उि जनयम कहा गया है) के, जनयम 2 के,

खंड (iii) में, "खान और खजनि (जवकास और जवजनयमन) अजधजनयम, 1957" िब्िों और कोष्ठकों से पहले, “परमाणु खजनि

ररयायत जनयम, 2016 के तहत जवजनर्िवष्ट और अजधसूजचत प्रारंजभक मूल्य या उससे अजधक ग्रेड वाले” िब्ि अंत:स्ट्र्ाजपत

दकये िाएंगे।

3. उि जनयमों में, जनयम 5 में,––

(i) पार्श्व शीर्व में, "धारा 11 की उपधारा (2)" िब्ि और अंक के पश्चात, "या धारा 11घ" िब्ि, अंक और अिर

अंत:स्ट्र्ाजपत दकये िाएंगे।

अंत:स्ट्र्ाजपत दकये िाएंगे।

4. उि जनयमों में, जनयम 7 में,-

(i) उप-जनयम (1) में, "धारा 11 की उपधारा (2)" िब्ि और अंक के प्रश्चात, "या धारा 11घ" िब्ि, अंक और अिर

अंत:स्ट्र्ाजपत दकये िाएंगे;

(ii) उप-जनयम (1क) में, जनम्नजलजखत परंतुक अंत:स्ट्र्ाजपत दकया िाएगा, अर्ावत्:-

"परंतु यह दक अजधजनयम की पहली अनुसूची के भाग घ में जवजनर्िवष्ट दकसी खजनि के संबंध में, प्रस्ट्ताव केंरीय सरकार को

प्रस्ट्तुत दकया िाएगा।";

(iii) उप-जनयम (1ख) में, जनम्नजलजखत परंतुक अंत:स्ट्र्ाजपत दकया िाएगा, अर्ावत्: -

“परंतु यह दक अजधजनयम की पहली अनुसूची के भाग घ में जवजनर्िवष्ट दकसी खजनि के संबंध में, उपलब्ध भूजवज्ञान डेटा के

आधार पर दकसी ब्लॉक की खजनि िमता की पहचान करने के जलए िहां संसाधन अभी तक स्ट्र्ाजपत नहीं दकए गए हैं िैसा

दक उप-जनयम (1) के खंड (क) में जनर्िवष्ट दकया गया है, उप-जनयम (1क) के अधीन दकसी व्यजि द्वारा प्रस्ट्ताजवत दकसी

ब्लॉक में सजहत, केंरीय सरकार इसे जनम्नजलजखत सिस्ट्यों से जमलकर बनने वाली सजमजत के समि रखेगी, अर्ावत्:—

(क) अपर सजचव या संयुि सजचव, खान मंत्रालय, भारत सरकार - अध्यि;

(ख) उप महाजनिेिक, संबंजधत राज्य के भारतीय भूवैज्ञाजनक सवेिण की राज्य इकाई- सिस्ट्य;

(ग) राज्य सरकार के खनन और भूजवज्ञान जवभाग में प्रधान सजचव या सजचव (जिस भी नाम से ज्ञात हो) या उनके

प्रजतजनजध - सिस्ट्य

(घ) जनिेिक (तकनीकी), खान मंत्रालय, भारत सरकार - सिस्ट्य सजचव।";

(iv) उप-जनयम (1घ) में, िोनों स्ट्र्ानो पर आने वाले "राज्य सरकार" िब्िों के प्रश्चात, "या यर्ाजस्ट्र्त केंरीय सरकार," िब्ि

अंतस्ट्र्ावजपत दकये िाएंगे।

3. उि जनयमों में, अनुसूची III में,—

(i) "___ सरकार [राज्य सरकार का नाम’’]" िब्ि और कोष्ठक के प्रश्चात जनम्नजलजखत अंत:स्ट्र्ाजपत दकया िाएगा, अर्ावत्:—

"या

सेवा में,

जनिेिक (तकनीकी),

खान मंत्रालय,

भारत सरकार,

िास्त्री भवन, नई दिल्ली - 110001

[िो लागू न हो उसे काट िें]”;

(ii) "राज्य सरकार के जवचारार्व" िब्िों के प्रश्चात "/ केंरीय सरकार [िो लागू न हो उसे काट िें]" िब्ि, अिर और कोष्ठक

अंत:स्ट्र्ाजपत दकए िाएंगे।

NOTIFICATION

New Delhi the 21st January, 2024

G.S.R. 52(E).—In exercise of the powers conferred by section 13 of the Mines and Minerals (Development

and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend

the Minerals (Evidence of Mineral Contents) Rules, 2015, namely:—

1. Short title and commencement.— (1) These rules may be called the Minerals (Evidence of Mineral Contents)

Amendment Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Minerals (Evidence of Mineral Contents) Rules, 2015 (hereinafter referred to as the said rules), in rule 2, in

clause (iii), after the words and brackets “(67 of 1957)”, the words “having grade equal to or more than the threshold

value as specified and notified under the Atomic Minerals Concession Rules, 2016” shall be inserted.

3. In the said rules, in rule 5, —

(i) in the marginal heading, after the word and figures “section 11”, the words, figures and letter “or section 11D”

shall be inserted.

(ii) in the opening portion, after the word and figures “section 11”, the words, figures and letter “or section 11D” shall

be inserted.

4. In the said rules, in rule 7,—

(i) in sub-rule (1), after the word and figures “section 11”, the word, figures and letter “or section 11D” shall be

inserted;

(ii) in sub-rule (1A), the following proviso shall be inserted, namely:—

“Provided that in respect of any mineral specified in the Part D of the First Schedule to the Act, the proposal

shall be submitted to the Central Government.”;

(iii) in sub-rule (1B), the following proviso shall be inserted, namely:—

“Provided that in respect of any mineral specified in Part D of the First Schedule to the Act, in order to

identify mineral potentiality of a block based on the available geoscience data where resources are yet to be

established as referred in clause (a) of sub-rule (1), including in any block proposed by any person under the

sub-rule (1A), the Central Government shall place it before a committee consisting of the following members,

namely:—

(a) Additional Secretary or Joint Secretary in the Ministry of Mines, Government of India – Chairman;

(b) Deputy Director General of the State Unit of Geological Survey of India of the State concerned –

Member;

whatever name called) or his representative – Member;

(iv) in sub-rule (1D), after the words “State Government”, occurring at both the places, the words “or the Central

Government, as the case may be” shall be inserted.

3. In the said rules, in Schedule III,—

(i) after the words and brackets “Government of ___ [mention name of State Government]”, the following shall be

inserted, namely:—

“OR

To,

The Director (Technical),

Ministry of Mines,

Government of India,

Shastri Bhawan, New Delhi – 110001.

[strike-out whichever is not applicable]”;

(ii) after the words “for consideration of the State Government”, the words, letter and brackets “/ the Central

Government [strike-out whichever is not applicable]” shall be inserted.
