सा.का.जन. 67(अ).—राष्ट्रपजत, संजवधान के अनुच्छेि 309 के परन्तुक द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए

और भारतीर् वनस्ट्पजत सवेक्षण (वगा III) भती जनर्म, 1964 िहां तक उनका संबंध फोटोग्राफर से है, उन बातों के जसवार्

अजधक्ांत करते हुए, जिन्हें उि जनर्मों के अजधक्मण से पूवा दकर्ा गर्ा है र्ा करने का लोप दकर्ा गर्ा है, पर्ाावरण, वन

और िलवार्ु पररवतान मंत्रालर्, भारतीर् वनस्ट्पजत सवेक्षण में फोटोग्राफर श्रेणी II के पि पर भती पद्धजत का जवजनर्मर्

करने के जलए जनम्नजलजखत जनर्म बनाती हैं अर्ाात :-

(1) संजक्षप्त नाम और प्रारंभ-(1) इन जनर्मों का संजक्षप्त नाम पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्,

भारतीर् वनस्ट्पजत सवेक्षण (फोटोग्राफर श्रेणी II) भती जनर्म, 2023 है।

(2) र्े रािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे।

2. पि-संख्र्ा, वगीकरण और वेतन मैररक्स में स्ट्तर -उि पिों की संख्र्ा, उनका वगीकरण और इससे संलग्न वेतन

मैररक्स में स्ट्तर वे होंगे, िो इन जनर्मों से उपाबद्ध अनुसूची के स्ट्तंभ (2) से स्ट्तंभ (4) में जवजनर्िाष्ट हैं।

3. भती की पद्धजत, आर्ु सीमा, अहाताएं, आदि-भती की पद्धजत, आर्ु-सीमा, अहाताएं और उससे संबंजधत अन्र् बातें वे

होंगी िो पूवोि अनुसूची के स्ट्तंभ (5) से स्ट्तंभ (13) में जवजनर्िाष्ट हैं।

4. जनरहाता-वह व्यजि -

(क) जिसने ऐसे व्यजि से, जिसका पजत र्ा जिसकी पत्नी िीजवत है, जववाह दकर्ा है र्ा जववाह की संजविा की है, र्ा

(ख) जिसने अपने पजत र्ा अपनी पत्नी के िीजवत रहते हुए दकसी व्यजि से जववाह दकर्ा है र्ा जववाह की संजविा की है,

उि पि पर जनर्ुजि का पात्र नहीं होगा/होगी :

परन्तु र्दि केन्रीर् सरकार का र्ह समाधान हो िाता है दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्र् पक्षकार को

लागू स्ट्वीर् जवजध के अधीन अनुज्ञेर् है और ऐसा करने के जलए अन्र् आधार हैं तो वह दकसी व्यजि को इस जनर्म के प्रवतान

से छूट िे सकेगी।

5. जिजर्ल करने की िजि-िहां केन्रीर् सरकार की र्ह रार् है दक ऐसा करना आवश्र्क र्ा समीचीन है, वहां वह

उसके जलए िो कारण हैं उन्हें लेखबद्ध करके, इन जनर्मों के दकसी उपबंध को दकसी वगा र्ा प्रवगा के व्यजिर्ों की

बाबत, आिेि द्वारा जिजर्ल कर सकेगी।

6. व्यावृजत्त-इन जनर्मों की कोई बात, ऐसे आरक्षण, आर्ु-सीमा में छूट और अन्र् ररर्ार्तों पर प्रभाव नहीं डालेगी,

जिनका केन्रीर् सरकार द्वारा इस संबंध में समर्-समर् पर िारी दकए गए आिेिों के अनुसार अनुसूजचत िाजतर्ों,

अनुसूजचत िनिाजतर्ों, अन्र् जपछडे वगों, भूतपूवा सैजनकों और अन्र् जविेष प्रवगा के व्यजिर्ों के जलए उपबंध करना

अपेजक्षत है।

NOTIFICATION

New Delhi, the 24th January, 2024

G.S.R. 67(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Botanical Survey of India (Class III) Recruitment Rules, 1964, in so far as they relate to the post of

Photographer, except as respects things done or omitted to be done before such supersession, the President hereby

makes the following rules regulating the method of recruitment to the post of Photographer Grade-II in the Botanical

Survey of India under the Ministry of Environment, Forest and Climate Change, namely:-

1. Short title and commencement.–(1) These rules may be called the Botanical Survey of India (Photographer

Grade-II), Recruitment Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix.-The number of the said post, its classification and

level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to

these rules.

3. Method of recruitment, age-limit, qualifications, etc.–The method of recruitment, age- limit, qualifications

and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.– No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so doing,

exempt any person from the operation of this rule.

5. Power to relax.–Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect

to any class or category of persons.

6. Saving.–Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required

to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-

servicemen and other special categories of persons in accordance with the orders issued by the Central

Government from time to time in this regard.
