सा.का.जन. 770(अ).— अमोजनयम नाइरेट जनयम, 2012 का संिोधन करने के जलए जनम् नजलजखत जनयमों का

प्रारूप, जिसे केन्‍द रीय सरकार, जवस्ट् फोटक अजधजनयम, 1884 (1884 का 4) की धारा 14 के साथ परित जवस्ट् फोटक

अजधजनयम, 1884 की धारा 5 और 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट् ताव करती है, ऐसे सभी

व्यजियों की िानकारी के जलए, जिनके उससे प्रभाजवत होने की संभावना है, उक् त अजधजनयम की धारा 18 की उप-धारा

(1) की अपेक्षानुसार प्रकाजित दकया िाता है और यह सूचना िी िाती है दक उक् त प्रारूप जनयम पर उस तारीख से तीस

(30) दिन के पश् चात् जवचार दकया िाएगा जिस तारीख को इस अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब् ध

करा िी िाती हैं;

इन प्रारूप जनयमों पर आपजत्तयां अथवा सुझाव, यदि कोई हों, ऊपर जनर्िधष्ट अवजध के भीतर, जनिेिक

(जवस्ट्फोटक), उद्योग संवधधन और आंतररक व्यापार जवभाग, वाजणज्य और उद्योग मंत्रालय को कक्ष संख्या 252-ए, उद्योग

भवन, नई दिल्ली-110011 अथवा ई-मेल: [email protected]; पर भेिे िा सकते हैं;

उि प्रारूप जनयमों के संबंध में दकसी भी व्यजि से जनर्िधष्ट अवजध के भीतर प्राप्त होने वाली आपजत्तयों या सुझावों

प्रारूप जनयम

1. संजक्षप् त नाम और प्रारंभ:-(1) इन जनयमों को अमोजनयम नाइरेट (संिोधन) जनयम, 2024 कहा िाएगा।

(2) ये आजधकाररक रािपत्र में इनके अंजतम प्रकािन की तारीख को लागू होंगे।

अमोजनयम नाइरेट, 2012 (जिसे इसके बाि उक् त जनयम कहा िाएगा) के जनयम 2 में,

क.

खंड (ढ) के बाि, जनम् नजलजखत खंडों को अंत:स्ट् थाजपत दकया िाएगा, अथाधत्:-

"(ढ क) "सूक्ष् म और लघु उद्यम” से सूक्ष् म, लघु और मध् यम उद्यम जवकास अजधजनयम, 2006 की धारा 2 के खंड

(ि) और खंड (ड) में पररभाजित उद्यम अजभप्रेत है।

(ढ ख) "सूक्ष् म और लघु स्ट्टाटधअप” से उद्योग संवधधन और आंतररक व् यापार जवभाग, वाजणज् य और उद्योग

मंत्रालय में पंिीकृत तथा सा.का.जन. 127(अ) दिनांक 19 फरवरी, 2019 की रािपजत्रत अजधसूचना के

पैराग्राफ 1 के खंड (क) में यथापररभाजित जनकाय अजभप्रेत है।”

ख.

खंड (ध) के बाि, जनम् नजलजखत खंड को अंत:स्ट् थाजपत दकया िाएगा, अथाधत्:-

“(न) “मजहला उद्यमी” से मजहला के स्ट् वाजमत् व और जनयंत्रण वाला ऐसा उद्यम अजभप्रेत है जिसकी पूंिी में उनका

न्‍द यूनतम 26 प्रजतित जवत् तीय जहत िाजमल है।”

उि जनयमों के जनयम 29 के उप-जनयम (1) को, जनम् नजलजखत से प्रजतस्ट् थाजपत दकया िाएगा, अथाधत्:-

“(1) पूवध अनुमोिन, अनुज्ञजप्त िारी करने और संिोधन के जलए जनम्नजलजखत िुल्क का भुगतान करना होगा, अथाधत्:-

उपयुधि उप-जनयम 1 में उजल्लजखत िुल्क में छूट का िावा करने के प्रयोिन हेतु, आवेिक को जनम्नजलजखत

िस्ट्तावेि प्रस्ट्तुत करने होंगे, अथाधत्:-

क.

सूक्ष्म और लघु उद्यम- सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय द्वारा िारी प्रमाण-पत्र।

बिते दक उपयुधि उि छूट, केवल सूक्ष्म और लघु उद्यम पर लागू होगी और यह मध्यम उद्यम पर लागू

नहीं होगी।

(ख)

सूक्ष्म और लघु स्ट्टाटधअप-उद्योग संवधधन और आंतररक व्यापार जवभाग, वाजणज्य और उद्योग मंत्रालय में

पंिीकरण का िस्ट्तावेिी साक्ष्य।

बिते दक उपयुधि उि छूट केवल सूक्ष्म और लघु स्ट्टाटधअप पर लागू होगी और यह मध्यम स्ट्टाटधअप पर लागू नहीं

होगी।

(ग) मजहला उद्यमी- फमध या कंपनी के स्ट्वामी अथवा जनिेिक का िस्ट्तावेिी साक्ष्य।

(1ख) ऐसे मामले में िहां, सूक्ष्म और लघु उद्यम या सूक्ष्म और लघु स्ट्टाटधअप का स्ट्वाजमत्व या जनयंत्रण मजहला द्वारा दकया

िाता है, तो िो भी िुल्क कम होगा, वह लागू होगा।

बिते दक यदि आवेिक द्वारा प्रस्ट्तुत की गई िानकारी, दकसी भी स्ट्तर पर गलत या भ्रामक पायी िाती है, तो ऐसे

अनुमोिन या अनुज्ञजप्त को जनरस्ट्त कर दिया िाएगा।

NOTIFICATION

New Delhi, the 11th December, 2024

G.S.R. 770(E).— The draft of the following rules to amend the Ammonium Nitrate Rules, 2012, which

Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act,

1884 read with section 14 of the Explosives Act, 1884 (4 of 1884) is hereby published as required by sub-section (1)

of section 18 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that

the said draft shall be taken into consideration after the expiry of a period of thirty (30) days from the date on which

the copies of the Gazette of India containing this notification are made available to the public.

Objections or suggestions if any, to these draft rules may be sent to the Director (Explosives), Department

for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 252-A, Udyog Bhavan,

New Delhi – 110011 or Email: [email protected]; within the period specified above.

The objections or suggestions which may be received from any person with respect to the said draft rules

within the period above so specified will be taken into consideration by the Central Government.

DRAFT RULE

1. Short titled and commencement:-

(1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2024.

2. They shall come into force on the date of their final publication

in the Official Gazette.

3. In rule 2 of the Ammonium Nitrate Rules, 2012 (herein after referred to as said rules),

after clause (n), the following clauses shall be inserted namely:-

“(na) “Micro and Small Enterprises” means an enterprise defined in clause (h) and clause (m) of

section 2 of the Micro, Small and Medium Enterprises Development Act, 2006.

(nb) “Micro & Small Startup” means an entity registered with Department for Promotion of

Industry and Internal Trade, Ministry of Commerce and Industry and as defined in clause (a) of

paragraph 1 of the Gazette Notification having G.S.R. 127(E) dated 19th February, 2019”.

b. after clause (s), the following clause shall be inserted namely:-

“(t) “Women Entrepreneur” means an enterprise owned and controlled by a woman having a

minimum financial interest of 26% of the capital”.

3. For sub-rule (1) of the rule 29 of the said rules, the following shall be substituted, namely:-

(1A) For the purpose of claiming relaxation in fees as mentioned in sub-rule (1) above, the applicant shall

submit the following documents, namely:-

(a)

Micro and Small Enterprises - Certificate issued by Ministry of Micro, Small and Medium

Enterprises.

Provided that, above said relaxation shall only be applicable to Micro and Small

Enterprises and not for Medium Enterprises.

(b) Micro and Small Startup - Documentary evidence towards registration with Department for

Promotion of Industry and Internal Trade, Ministry of Commerce and Industry

Provided that, above said relaxation shall only be applicable to Micro and Small Startup

and not for Medium Startup.

(1B) In case where Micro and Small Enterprises or Micro and Small Startup owned and controlled by a

woman, the fees whichever is lower shall be applicable.

Provided that if information submitted by the applicant, is found to be false or misleading

at any stage, the approval or license shall be liable to be cancelled”.
