उपधारा (3) द्वारा प्रित् त िज‍ तर्ों का प्रर्ोग करते हुए और तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना

सं. का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 (जिसे इसमें इसके पश् चात् उ‍ त अजधसूचना कहा गर्ा है) के अनुसरण में

िािरा और नागर हवेली तथा िमण और िीव संघ राज्र्क्षेत्र के जलए पर्ाावरण समाघात जनधाारण प्राजधकरण (जिसे इसमें

इसके पश् चात् प्राजधकरण कहा गर्ा है) का गठन करती है, जिसमें जनम् नजलजखत सिस्ट् र् होंगे, अथाात् :-

प्राजधकरण के अध्र्क्ष और सिस्ट्र् रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वर्ा की अवजध के जलए

पि धारण करेंगे ।

प्राजधकरण ऐसी िजिर्ों का प्रर्ोग करेगा और ऐसी प्रदिर्ा का अनुसरण करेगा िो उि अजधसूचना में

जवजनर्िाष् ट हैं ।

प्राजधकरण, अपना जवजनश्चर् पैरा 6 के अधीन गरठत संघ राज्र्क्षेत्र स्ट्तरीर् जविेर्ज्ञ मूल्र्ांकन सजमजत की

जसिाररिों के आधार पर करेगा ।

5. प्राजधकरण के सभी जवजनश्चर् बैठक में दकए िाएंगे और साधारणतर्ा एकमत होंगे :

परंतु बहुमत द्वारा जलए गए जवजनश्चर् की ििा में, इसके समथान में और इसके जवरुद्ध िृजिकोणों के ब्र्ौरे कार्ावृत्त

में स्ट्पि रूप से अजभलेखबद्ध दकए िाएंगे तथा उसकी एक प्रजत केंरीर् सरकार को भेिी िाएगी ।

केन्‍दरीर् सरकार, प्राजधकरण की सहार्ता के प्रर्ोिन के जलए िािरा और नागर हवेली तथा िमण और िीव संघ

राज्र्क्षेत्र के परामिा से िािरा और नागर हवेली तथा िमण और िीव संघ राज्र्क्षेत्र स्ट्तरीर् जविेर्ज्ञ मूल्र्ांकन सजमजत

(जिसे इसमें इसके पश् चात् सजमजत कहा गर्ा है) का गठन करती है जिसमें जनम्नजलजखत व् र्ज‍ त होंगे, अथाात् :--

सजमजत के अध्र्क्ष और सिस्ट्र् इस अजधसूचना के रािपत्र में प्रकािन की तारीख से तीन वर्ा की अवजध के जलए

पि धारण करेंगे ।

सजमजत ऐसी िजिर्ों का प्रर्ोग करेगी और ऐसी प्रदिर्ाओं का पालन करेगी, िो उि अजधसूचना में जवजनर्िाष् ट हैं।

सजमजत सामूजहक उत्तरिाजर्त्व के जसद्धांत पर काम करेगी और अध्र्क्ष प्रत्र्ेक मामले में सवासम् मजत पर पहुंचने का

प्रर्ास करेगा और र्दि सवासम् मजत पर नहीं पहुंचा िा सकता है तो बहुमत का मत अजभभावी होगा ।

10. जहतों के टकराव से बचने के जलए-

(i) प्राजधकरण के अध्र्क्ष और सिस्ट्र् और सजमजत के अध्र्क्ष और सिस्ट्र्-

(क) र्ह घोजर्त करेंगे दक वे दकस परामिा संगठन और पररर्ोिना के प्रस्ट्तावक से िुडे हैं ;

(ख) दकसी पररर्ोिना के जलए पर्ाावरणीर् समाघात जनधाारण और पर्ाावरण प्रबंधन र्ोिना की

तैर्ारी के जलए कोई परामिा नहीं िेगें र्ा सहर्ोग नहीं करेंगे, िो उनके कार्ाकाल के िौरान

प्राजधकरण द्वारा जवजनजश् चत र्ा सजमजत द्वारा मूल्र्ांदकत की िानी है ; तथा

(ii) र्दि जपछले पांच वर्ों में, अध्र्क्ष र्ा प्राजधकरण और सजमजत के दकसी भी सिस्ट्र् ने दकसी पररर्ोिना

प्रस्ट्तावक के जलए परामिा सेवाएं प्रिान की हैं र्ा पर्ाावरणीर् समाघात जनधाारण अध्र्र्न संचाजलत दकर्ा

है, तो उस जस्ट्थजत में वे स्ट्वर्ं को ऐसे प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत दकसी भी पररर्ोिना के मूल्र्ांकन की

प्रदिर्ा में प्राजधकरण और सजमजत की बैठक से बचाव करेंगे ।

िािरा और नागर हवेली तथा िमण और िीव संघ राज्र्क्षेत्र प्रिासन, प्राजधकरण और सजमजत के जलए सजचवालर्

के रूप में कार्ा करने के जलए दकसी अजभकरण को जवजनर्िाि करेगा और सभी सजचवालर् जवत्तीर् और संभार तंत्र संबंधी

सहार्ता, जिसके अंतगात वास-सुजवधा, पररवहन और उि अजधसूचना के अधीन उनके कृत्र्ों के संबंध में ऐसी अन्‍दर्

सुजवधाएं भी हैं, उपलब्ध कराएगा ।

12. प्राजधकरण तथा सजमजत के अध्र्क्ष और सिस्ट्र्ों की बैठक की िीस, र्ात्रा भत्ता और मंहगाई भत्ता संघ राज्र्क्षेत्र

प्रिासन के सुसंगत जनर्मों के उपबंधों के अनुसार संित्त दकए िाएंगे ।

NOTIFICATION

New Delhi, the 18th December, 2024

S.O. 5464(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment

(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile

Ministry of Environment and Forests, number S.O. 1533(E), dated the 14^th September, 2006 (hereinafter referred to as

the said notification), the Central Government hereby constitutes the Union territory Level Environment Impact

Assessment Authority for the Union territory of Dadra and Nagar Haveli and Daman and Diu (hereinafter referred to

as the Authority) comprising of the following Members, namely: -

(a) Shri Manmohan Singh Negi,

Doon Officers Enclave,

Wildlife Institute Road, Chandrabani,

Post Office-Mohabbewala,

Dehradun, Uttarakhand-248002

Chairman;

(b) Dr. Panchagnula Venkata Subba Rao,

H.No.58, Saket Bhusattva, Gowdavalli Village,

Hyderabad-501401

Member;

Union territory of Dadra and Nagar Haveli and Daman and Diu

Member Secretary.

2. The Chairman and Members of the Authority, shall hold office for a period of three years from the date of

publication of this notification in the Official Gazette.

3. The Authority shall exercise such powers and follow such procedures as specified in the said notification.

4. The Authority shall take its decision on the recommendations of the Union territory Level Expert Appraisal

Committee constituted under paragraph 6.

5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous:

Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly

recorded in the minutes and a copy thereof sent to the Central Government.

6. The Central Government, in consultation with the Union territory of Dadra and Nagar Haveli and Daman and

Diu, for the purpose of assisting the Authority, hereby constitutes the Union territory Level Expert Appraisal

Committee for Union territory of Dadra and Nagar Haveli and Daman and Diu (hereinafter referred to as the

Committee), comprising of the following Members, namely: -

(a)

Shri Sujeetkumar Mariappa Dongre,

F2 Nadkarni Manor, Defence Colony,

Phase II, Alto Porvorim,

Bardez Goa-403521

Chairman;

(b)

Shri Bidhu Bhushan Barman,

201, MS Block, Bapudham, SP Marg,

Chanakyapuri, New Delhi-110021

Member;

(c)

Conservator of Forest,

Union territory of Dadra and Nagar Haveli and Daman and Diu.

Member- Secretary.

7. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of

publication of this notification in the Official Gazette.

8. The Committee shall exercise such powers and follow such procedures as specified in the said notification.

9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to

reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

10. In order to avoid any conflict of interest,-

(i) the Chairman and Members of the Authority and the Chairman and Member of the Committee shall,⸺

(a) declare to which consulting organisation they have been associated with and also the project proponents; and

(b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment

and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the

Committee during their tenure; and

(ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or

conducted Environment Impact Assessment studies for any project proponent during the preceding five years, in that

event they shall recuse themselves from the meetings of the Authority or the Committee in the process of appraisal of

any project proposed by such proponents.

11. The administration of Union territory of Dadra and Nagar Haveli and Daman and Diu shall specify an agency

to act as Secretariat of the Authority and the Committee and the Secretariat shall provide financial and logistic support

including accommodation, transportation and such other facilities in respect of their functions under the said

notification.

12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority

and the Committee, shall be paid in accordance with the provisions of relevant rules of the Union territory

administration.
