का.आ. 5595(अ).— केन्द्रीय सिकाि ने, िाष्ट्रीय िाजमार्ग अधिधनयम, 1956 (1956 का 48) (धजसे इसमें इसके

पश्चात् उक्त अधिधनयम कहा र्या है) की िािा 3क की उपिािा (1) के अिीन जािी की र्ई भाित सिकाि के सड़क

परिवहन औि िाजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 54 तािीख 03/01/2024, जो भाित के िाजपत्र,

असािािण, भार् II, खण्ड 3, उपखंड (ii) में प्रकाधित की र्ई थी, द्वािा धिहाि िाज्य के धिवहि धजले में NH104 के

कक.मी. 40 से कक.मी.48 (धिवहि से सीतामढ़ी) तक के भूखण्ड पि टोल प्लाजा के धनमागण, अनुिक्षण, प्रिंिन औि प्रचालन

के धलए उस अधिसूचना से उपािद्ध अनुसूची में धवधनर्दगष्ट भूधम का अजगन किने के अपने आिय की घोषणा की थी ;

औि उक्त अधिसूचना का साि उक्त अधिधनयम की िािा 3क की उपिािा (3) के अिीन तािीख "02.07.2024

एवम 03.07.2024 " को क्रमि: "िाष्ट्रीय सहािा " औि "दैधनक जार्िण" दोनों में प्रकाधित ककया र्या था ;

जिकक सक्षम प्राधिकािी को िािा 3-र् के तहत दायि आपधि प्राप्त हुई है, धजस पि धवचाि ककया र्या है औि

उसका उधचत रूप से धनपटान ककया र्या;

औि सक्षम प्राधिकािी ने उक्त अधिधनयम की िािा 3घ की उपिािा (1) के अनुसिण में, केन्द्रीय सिकाि को अपनी रिपोटग दे

दी है ;

अतः अि, केन्द्रीय सिकाि, सक्षम प्राधिकािी की उक्त रिपोटग प्राप्त हो जाने पि औि उक्त अधिधनयम की िािा 3घ

की उपिािा (1) द्वािा प्रदि िधक्तयों का प्रयोर् किते हुए, यह घोषणा किती है कक उक्त अनुसूची में धवधनर्दगष्ट भूधम का

पूवोक्त प्रयोजन के धलए अजगन ककया जाना चाधहए ;

औि अि, केन्द्रीय सिकाि, उक्त अधिधनयम की िािा 3घ की उपिािा (2) के अनुसिण में यह घोषणा किती है कक

इस अधिसूचना के िाजपत्र में प्रकािन पि, उक्त अनुसूची में धवधनर्दगष्ट भूधम सभी धवल्लंर्मों से मुक्त होकि आत्यधन्द्तक रूप

से केन्द्रीय सिकाि में धनधहत हो जाएर्ी ।

NOTIFICATION

New Delhi, the 27th December, 2024

S.O. 5595(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport

and Highways, 54 Dated:03/01/2024 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section

(ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to

as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to

the said notification for construction of Toll Plaza Maintenance, management and operation of NH104 in the stretch of

land from Km. 40 to Km. 48 (Sheohar to Sitamarhi) in the district of SHEOHAR in the state of BIHAR

And whereas the substance of the said notification has been published in “Dainik Jagran” and “Rashtriya

Sahara” dated 03.07.2024 and 02.07.2024 respectively; under sub-section (3) of section 3A of the said Act;

And whereas the Competent Authority has received objections filed under Section 3-C, considered and settled the

same appropriately;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has

submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers

conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land

specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares

that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest

absolutely in the Central Government, free from all encumbrances.
