का.आ. 5655(अ).— यह 21.10.2024 को हुई सुनवाई और बाद में इस कायाालय के पर ददनांक 14.11.2024
के माध्यम से अग्रेजित कायावाही के ररकॉडा के अनुसार है।
उपयुाक्त कारावाई के ररकॉडा के अनुसार, िूट जमल कंपनी को न्यायजनणायन प्राजधकारी के समक्ष जिकायत में
िाजमल तकनीकी मुद्दों को स्ट्पष्ट करते हुए कोई भी जलजखत तका दायर करने की स्ट्वतंरता दे दी गयी । तत्पश्चात्, जमल
कंपनी ने ददनांक 21.11.2024 को िून्य सं. के तहत जलजखत तका प्रस्ट्तुत दकए हैं िो इस प्रकार हैं –
"1. ददनांक 04.09.2024 को संयुक्त जनरीक्षण (िेआई) दकया गया था। मूल रूप से ददनांक 21.04.2024 को जनरीक्षण की
गई जवियाधीन गांठें, और िुष्क मौसम के लगभग 5 महीने के अंतराल के बाद, बैग 8% (21.04.2024 को) से 8.21%
(04.09.2024 को) तक नमी कैसे प्राप्त कर सकते हैं।

2. हमने संयुक्त जनरीक्षण के दौरान उपयोग में लाए गए नमी मीटर की संभाजवत गलती को इंजगत दकया है िो नमी की
मारा को 8% से नीचे ररकॉडा नहीं कर सकता है (संयुक्त जनरीक्षण के दौरान 73% बैगों में 8% एमआर पाया गया)।
3. मूल जिकायत सं. PBPGK170424HMS31033/COMP01, ददनांक 22.07.2024 जिसमें कहा गया है, "बैग
आईएस जवजनदेिों के अनुसार नहीं है। बैग की लंबाई, चौडाई, जसरे, उँचाई, विन, जसलाई, बैग खराब, प्रमुख और मामूली
दोि आदद जवजनदेि के अनुसार नहीं पाए गए हैं। हालांदक, ददनांक 04.09.2024 के संयुक्त जनरीक्षण (िेआई) ररपोटा में बैग
के सही द्रव्यमान को छोडकर ऐसी कोई खराबी नहीं बताई गई थी, जिसका संयुक्त जनरीक्षण के दौरान उपयोग दकए गए
नमी मीटर के रेंि प्रजतबंधों के कारण उजचत रूप से जहसाब नहीं ददया गया था।
उपरोक्त के संबंध में, हम आपसे अनुरोध करेंगे दक मामले पर उजचत पररप्रेक्ष्य में पुनर्वाचार करें और हमें
आरोपों से मुक्त करें क्योंदक हम दकसी भी अनुजचत काया में िाजमल नहीं हैं।”
पूवोक्त जमल कंपनी का प्रस्ट्तुजतकरण ररकाडा में रखा गया है। जवभाग से कहा गया था दक वह मामले में उजचत
जनणाय लेने के जलए फाइल मेरे समक्ष रखे। नमी का मुद्दा एक वैज्ञाजनक मामला है िो संयुक्त जनरीक्षण में की गई है जिसमें
जमल के प्रजतजनजध भी उपजस्ट्थत थे।
अतः यह जनदेि ददया िाता है दक 48 अस्ट्वीकृत गांठों को इस आदेि के िारी होने की तारीख से 30 ददनों के
अंदर जमल द्वारा अपने िोजखम और लागत पर प्रजतस्ट्थाजपत दकया िाना है और परेजिती द्वारा गाठों की स्ट्वीकृजत के
दस्ट्तावेिी प्रमाण सजहत जवभाग को तुरंत एक अनुपालन ररपोटा प्रस्ट्तुत करनी होगी, अन्यथा जमल कंपनी से संबंजधत
भुगतान के जलए लंजबत जबलों से अस्ट्वीकृत गांठों की समान लागत की आवश्यक वसूली होगी िो दक जवभाग द्वारा िुरू
दकया िाएगा।
इस आदेि को सभी पक्षों को तत्काल पररचाजलत दकया िाए।

ORDER
Kolkata, the 18th December, 2024
S.O. 5655(E).— This is pursuant to the hearing held on 21.10.2024 and subsequently Record of Proceedings
forwarded vide this office letter dated 14.11.2024.
Vide aforementioned Record of Proceedings, the jute mill coy. was given liberty to file any written argument
clarifying the technical issues involved in the complaint before this adjudicating authority. Subsequently, the mill coy.
vide letter under Ref. No. Nil dated 21.11.2024 has submitted their written arguments, which are as follows –
“1. The Joint Inspection (JI) was carried out on 04.09.2024. The subject bales which were originally inspected on
21.04.2024, and after a gap of nearly 5 months of dry season, how can bags regain moisture from 8%
(on 21.04.2024) to 8.21% (on 04.09.2024).
2. We have pointed out the potential fault of moisture meter used in the JI which cannot record moisture content
below 8% (73% of bags found with 8% MR during JI).
3. Original Complaint No. PBPGK170424HMS31033/COMP01, dated 22.07.2024 which state, "Bag is not as per
I.S. specifications. Bag's length, width, ends, picks, weight, stitch, bag defective, major and minor defects, etc., are

not as per specification."However, no such defects were reported in the Joint Inspection (J.I) report
dated04.09.2024 except corrected mass of the bag which was not properly accounted for due to range restrictions of
moisture meter used during JI.
In light of the above, we would request you to re-consider the matter in proper perspective and exonerate us from
the allegations as we did not indulge into any unfair practice.”
The aforesaid submission of mill coy. has been kept on record. The department was asked to place the file
before me for taking appropriate decision in the matter. The issue of moisture is a scientific observation which has
been made in the Joint Inspection, where the mill representative was also present.
It is therefore directed that 48 rejected bales have to be replaced by the mill at their own risk and cost within
30 days from the date of issue of this order and submit a compliance report to the department forthwith including
documentary proof of acceptance of the goods by the consignee, failing which necessary recovery of equivalent cost
of rejected bales from the pending bills for payment pertaining to the mill coy. shall be initiated by the department.
Let this Order be circulated to all the parties' forthwith.
