दस्ट्तावेज़ सं. ईडीबी/एचओ/एचआरडी/984/2024-25.—इलाकाई देहाती बैंक अधिधियम, 1976 (1976 का

21) की िारा 17 की उपिारा (1) के साथ पठित िारा 30 द्वारा प्रदत्त शधियों का प्रयोग करते हुए, इलाकाई देहाती बैंक

का धिदेशक मंडल, प्रायोजक बैंक होिे के िाते भारतीय स्टेट बैंक और राष्ट्रीय कृधि और ग्रामीण धिकास बैंक के साथ परामशश

करिे के बाद तथा केंद्र सरकार की पूिश मंजूरी के साथ, एतद्द्वारा इलाकाई देहाती बैंक के (अधिकारी और कमशचारी) सेिा

धिधियमािली, 2010 में और अधिक संशोिि करिे के धलए धिम्नधलधित धिधियम बिाता है, यथा:-

1. (1) इि धिधियमों को इलाकाई देहाती बैंक (अधिकारी और कमशचारी) सेिा (संशोिि) धिधियम, 2024 कहा जाएगा.

(2) ये संशोिि, इिके सरकारी राजपत्र में प्रकाधशत होिे की धतधथ से लागू हो जाएंगे.

2. इलाकाई देहाती बैंक (अधिकारी और कमशचारी) सेिा धिधियम, 2010 (धजन्‍हें इसके बाद उि धिधियम कहा जाएगा)

में, धिधियम 61 के उप-धिधियमि (4) के धलए, धिम्नधलधित उप-धिधियमि प्रधतस्थाधपत ककया जाएगा, यथा:-

“(4) धिशेिाधिकार अिकाश 270 कदिों से अधिक तक का िहीं जमा ककया जा सकता है, धसिाय इसके कक जहां

छुट्टी के धलए आिेदि ककया गया हो और उसे अस्िीकार कर कदया गया हो:

बशते कक धिशेिाधिकार अिकाश का िकदीकरण अधिकतम 240 कदि के धलए ही ककया जा सकेगा.”

3. उि धिधियमों के धिधियम 67 के,-

क)

दूसरे प्राििाि में,‍“बैंक की सेिा से सेिाधििृत्त” शब्दों के बाद,‍“धिधियमि 11 के प्राििािों के अंतगशत” शब्द

सधममधलत ककए जाएंगे;

ि)

तीसरे प्राििाि के स्थाि पर धिम्नधलधित प्राििाि शाधमल ककया जाएगा, यथा:-

“यह भी प्राििाि ककया जाता है कक उस कमशचारी के संबंि में धजसकी सेिाएं छंटिी के कारण समाप्त कर दी

जाती हैं, िह धिशेिाधिकार अिकाश की अिधि के धलए पठरलधब्ियों के बराबर की राधश का भुगताि प्राप्‍त

करिे के धलए पात्र होगा, जो उसिे धिधियमि 61 के उप-धिधियमि (4) के अिीि जमा कर रिा था.”

ग)

तीसरे प्राििाि के बाद, धिम्नधलधित प्राििाि सधममधलत ककए जाएंगे, यथा,-

“यह भी प्राििाि ककया जाता है कक जहां कोई अधिकारी अथिा कमशचारी, इलाकाई देहाती बैंक (कमशचारी ) पेंशि

धिधियम, 2018 के धिधियमि 27 के उप-धिधियम (1) और (2) के तहत धिधिित् िोठटस देिे के बाद अपिी स्िेच्छा से

कदिांक 01 अप्रैल 2018 को या उसके बाद सेिा से सेिाधििृत्त होता है, तो िह अपिे द्वारा धिधियम 61 के उप-धिधियम (4)

के अिीि संधचत धिशेिाधिकार अिकाश की अिधि के धलए पठरलधब्ियों के बराबर की राधश का भुगताि प्राप्‍त करिे के धलए

पात्र होगा I

यह भी प्राििाि ककया जाता है कक जहां ककसी अधिकारी या कमशचारी को, अधििायश रूप से सेिाधििृत्त कर कदया

गया हो, धजसमें दंड भी शाधमल है, िह धिधियमि 61 के उप-धिियम (4) के अिीि, ककसी भी अिधि की पठरलधब्ियों के

बराबर की राधश का भुगताि प्राप्‍त करिे के धलए पात्र होगा.

यह भी प्राििाि ककया जाता है कक जहां कोई अधिकारी या कमशचारी सेिा छोड़ देता है या काम पर आिा बंद कर

देता है या धिधियम 10 के उप-धिधियमि (1) के प्राििािों के तहत पदत्याग कर देता है, तो िह सेिा की समाधप्त की धतधथ

को उसके िाते में जमा धिशेिाधिकार छुट्टी की आिी अिधि की पठरलधब्ियों के बराबर की राधश का भुगताि प्राप्‍त करिे के

धलए पात्र होगा, यह अिधि अधिकतम 120 कदि तक की ही हो सकती है I”

था और बाद में कदिांक 05 कदसंबर, 2018 की अधिसूचिा संख्या ईडीबी/1016/सेिा(संशोिि)धिधियम 2018 द्वारा

ELLAQUAI DEHATI BANK

NOTIFICATION

Srinagar, the 20th December, 2024

F. No. EDB/HO/HRD/984/2024-25.—In exercise of the powers conferred by Section 30 read with sub-section

(1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of ELLAQUAI DEHATI

BANK after consultation with State Bank of India, being the Sponsor Bank and the National Bank for Agriculture and

Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations

to further amend the Ellaquai Dehati Bank (Officers & Employees)Service Regulations, 2010, namely:-

1. (1) These Regulations may be called Ellaquai Dehati Bank (Officers & Employees) Service (Amendment)

Regulations, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

In the Ellaquai Dehati Bank (Officers and Employees) Service Regulations, 2010 (hereinafter referred to as

said regulations), in the regulations 61 for sub-regulation (4), the following sub-regulation shall be substituted, namely:-

"(4) Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied

for and it has been refused:

Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days."

In the said regulations, in regulation 67,-

(a)

In second proviso, after the words "retires from the service of the Bank", the words "under the provisions

of regulation 11" shall be inserted;

(b)

For third Proviso, the following proviso shall be substituted, namely:-

"Provided also that in respect of the employee where his services are terminated owing to retrenchment,

he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he

had accumulated subject to sub-regulation(4) of regulation 61.

(c)

After third proviso, the following provisos shall be inserted, namely,-

"Provided also that where an officer or employee voluntarily retires from service on or after the 1^stof

April 2018, after giving due notice under sub- regulations (1) and (2) of regulation 27 of the Ellaquai

Dehati Bank (Employees’) Pension Regulations, 2018, he shall be eligible to be paid a sum equivalent

to the emoluments for the period of privilege leave he had accumulated, subject to sub-regulation (4) of

regulation 61.

Provided also that where an officer or employee has been compulsorily retired including as a measure of

punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub-regulation

(4) of regulation 61.

Provided also that where an officer or employee leaves or discontinues from service or resigns under the

provisions of sub-regulation (1) of regulation 10, he shall be eligible to be paid a sum equivalent to the emoluments in

respect of privilege leave to the extent of half of such leave to his credit on the date of cessation of service,

subject to a maximum of 120 days."
