का.आ. 286(अ).—केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अिजन और जवकास) अजधजनयम, 1957 (1957 का
20) (जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया है) की धारा 4 की उपधारा (1) के अधीन भारत सरकार में
कोयला मंत्रालय के द्वारा िारी की गई अजधसूचना संख्या का. आ. 122, तारीख 05 फरवरी, 2022 िो भारत के रािपत्र,
असाधारण, भाग II, खंड 3, उपखंड (ii), तारीख 05 फरवरी, 2022 में प्रकाजित की गई थी, उस अजधसूचना से उपाबद्ध
अनुसूची में जवजनर्िजष्ट पररक्षेत्र की भूजम में जिसका माप 975.741 हेक्टर (लगभग) या 2411.05 एकड़ (लगभग) है,
कोयले का पूवेक्षण करने के अपने आिय की नोरटस िी थी|
और केन्द्रीय सरकार को यह समाधान हो गया है दक इस अजधसूचना से उपाबद्ध अनुसूची में जवजनर्िजष्ट की गई उक्त भूजम
के भाग में कोयला अजभप्राप्य है ;
अत, अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए इससे
संलग्न अनुसूची में वर्णजत उक् त भूजम में से 607.118 हेक्टर

रटप्पण 2: पूवोक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता है, जिसमे जनम्नजलजखत उपबंध है: -
“8. अिजन की बाबत् आपज तयॉ.- (1) कोई व् यजक् त िो दकसी भूजम में, जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी
की गई है, जहतबद्ध है, अजधसूचना के िारी दकए िाने से तीस दिन के भीतर सम् पूणज भूजम या उसके दकसी भाग या ऐसी
भूजम में या उस पर के दकन्द् हीं अजधकारों का अिजन दकए िाने के बारे में आपज त कर सकेगा ।
स्ट्पष्टीकरण:- इस धारा के अन्द्तगजत यह आपजत्त नहीं मानी िाएगी, दक कोई व्यजक्त दकसी भूजम में कोयला उपािन के जलए
स्ट्वयं खनन संदियाएं करना चाहता है और ऐसी संदियाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए।
(2) उपधारा (1) के अधीन प्रयेक आपजत्त सक्षम अजधकारी को जलजखत रूप में की िाएगी और सक्षम अजधकारी,
आपजत्तकताज को स्ट्वयं सुने िाने का या जवजध व्यवसायी द्वारा सुनवाई का अवसर िेगा और ऐसी सभी आपजत्तयों को
सुनने के पश्चात् और ऐसी अजतररक्त िााँच, यदि कोई हो, करने के पश्चात, िो यह आवश्यक समझता है, वह या तो
धारा 7 की उप-धारा (1) के अधीन अजधसूजचत भूजम का या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक
ररपोटज या ऐसी भूजम के जवजभन्न टुकड़े या ऐसी भूजम में या उस पर के अजधकारों के संबंध में आपजत्तयों पर अपनी
जसफाररिों और उसके द्वारा की गई कायजवाही के अजभलेख सजहत जवजभन्न ररपोटज केन्द्रीय सरकार को उसके
जवजनश्चय के जलए िेगा ।
(3) इस धारा के प्रयोिनों के जलए वह व्यजक्त दकसी भूजम में जहतबद्ध समझा िाएगा िो प्रजतकर में जहत का िावा
करने का हकिार होगा, यदि भूजम या दकसी ऐसी भूजम में या उस पर के अजधकार इस अजधजनयम के अधीन अर्िजत
कर जलए िाते है”।

NOTIFICATION
New Delhi, the 15th January, 2025
S.O. 286(E).—Whereas by the notification of the Government of India in the Ministry of Coal number
S.O.122, dated 05th Febuary 2022 published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 05th
Febuary 2022 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act,
1957 (20 or 1957), (hereinafter referred to as the said Act), the Central Government gave notice of its intention to
prospect for coal in 975.741 hectares (approximately) or 2411.05 acres (approximately) of the land in the locality
specified in the Schedule annexed to that notification;
And whereas the Central Government is satisfied that coal is obtainable in a part of the said land specified in
the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the
Central Government hereby gives notice of its intention to acquire the land measuring 607.118 hectares
(approximately) or 1500.19 acres (approximately) and all rights in or over the said land specified in the Schedule
appended hereto:
Note 1: The plan bearing number SECL/BSP/GM(L&R)/Land/18 dated the 29th November, 2024 of the area covered

Note 2: Attention is hereby invited to the provisions of section 8 of the aforesaid Act which provides as follows: -
“8. Objection to Acquisition: (1) Any person interested in any land in respect of which a notification under section 7
has been Issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any
part of the land or of any rights in or over such land.
Explanation: - It shall not be an objection within the meaning of this section for any person to say that he himself
desires to undertake mining operations in the land for the production of coal and that such operations should not be
undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the Competent
authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall,
after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a
report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such
land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the
Central Government, containing his recommendations on the objections, together with the record of the proceedings
held by him, for the decision of the Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim
an interest in compensation if the land or any rights in or over such land were acquired under this Act.”
Note 3: The Coal Controller, Coal Controller’s Organization, Ministry of Coal, Scope Minar, 5th Floor, Core II,
Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent authority under section
3 of the said Act, vide notification number S.O. 905, dated the 20th March, 1987, published in Part II, Section 3, sub-
section (ii) of the Gazette of India, dated the 4 April, 1987.
