का.आ. 5755(अ).— केन्द्रीय सिकाि ने, िाष्ट्रीय िाजमार्ग अधिधनयम, 1956 (1956 का 48) (धजसे इसमें इसके

पश्चात् उक्त अधिधनयम कहा र्या है) की िािा 3क की उपिािा (1) के अिीन जािी की र्ई भाित सिकाि के सड़क

परिवहन औि िाजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 5414 तािीख 13/12/2024, जो भाित के िाजपत्र,

असािािण, भार् II, खण्ड 3, उपखंड (ii) में प्रकाधित की र्ई थी, द्वािा पधश्चम बंर्ाल िाज्य के अलीपुिद्वाि धजले में

NH31D के कक.मी. 83.34 से कक.मी. 113.2 तक के िाष्ट्रीय िाजमार्ग के धनमागण (चौड़ाकिने / चाि लेन का बनाने, आकि),

अनुिक्षण, प्रबंिन औि प्रचालन के धलए उस अधिसूचना से उपाबद्ध अनुसूची में धवधनर्िगष्ट भूधम का अजगन किने के अपने

आिय की घोषणा की थी ;

औि उक्त अधिसूचना का साि उक्त अधिधनयम की िािा 3क की उपिािा (3) के अिीन तािीख 18/01/2025 को

“थे टेलीग्राफ [इंधललि]” , 18/01/2025 को “आनंिा बजाि पधत्रका” , 18/01/2025 को “थे टेलीग्राफ [इंधललि]” ,

18/01/2025 को “आनंिाबाजाि” िोनों में प्रकाधित ककया र्या था ;

जबकक सक्षम प्राधिकािी को िािा 3-र् के तहत िायि आपधि प्राप्त हुई है, धजस पि धवचाि ककया र्या है औि

उसका उधचत रूप से धनपटान ककया र्या;

औि सक्षम प्राधिकािी ने उक्त अधिधनयम की िािा 3घ की उपिािा (1) के अनुसिण में, केन्द्रीय सिकाि को अपनी

रिपोटग िे िी है ;

अतः अब, केन्द्रीय सिकाि, सक्षम प्राधिकािी की उक्त रिपोटग प्राप्त हो जाने पि औि उक्त अधिधनयम की िािा 3घ

की उपिािा (1) द्वािा प्रिि िधक्तयों का प्रयोर् किते हुए, यह घोषणा किती है कक उक्त अनुसूची में धवधनर्िगष्ट भूधम का

पूवोक्त प्रयोजन के धलए अजगन ककया जाना चाधहए ;

औि अब, केन्द्रीय सिकाि, उक्त अधिधनयम की िािा 3घ की उपिािा (2) के अनुसिण में यह घोषणा किती है कक

इस अधिसूचना के िाजपत्र में प्रकािन पि, उक्त अनुसूची में धवधनर्िगष्ट भूधम सभी धवल्लंर्मों से मुक्त होकि आत्यधन्द्तक रूप

से केन्द्रीय सिकाि में धनधहत हो जाएर्ी ।

NOTIFICATION

New Delhi, the 12th December, 2025

S.O. 5755(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport

and Highways, 5414 Dated:13/12/2024 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-

section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter

referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule

annexed to the said notification for building (widening/four-laning, etc.), maintenance, management and operation

of NH31D in the stretch of land from Km. 83.34 to Km. 113.2 in the district of Alipurduar in the state of WEST

BENGAL

And whereas the substance of the said notification has been published in “The Telegraph” dated 18/01/2025 ,

“Ananda Bazar Patrika” dated 18/01/2025 , “The Telegraph” dated 18/01/2025 , “Anandabazar” dated 18/01/2025 ;

under sub-section (3) of section 3A of the said Act;

And whereas the Competent Authority has received objections filed under Section 3-C, considered and

settled the same appropriately;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has

submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers

conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land

specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby

declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall

vest absolutely in the Central Government, free from all encumbrances
