1. समय-समय पर यथासंिोजधत सीमा िुल्क टैररफ अजधजियम, 1975 (जिसे इसके बाद 'अजधजियम' के रुप में
कहा गया है) और समय-समय पर यथासंिोजधत सीमा िुल्क टैररफ (पारटत वस्ट्तुओं पर पाटिरोधी िुल्क
की पहचाि, आकलि और संग्रहण तथा क्षजत का जिधाारण) जियमावली, 1995 (जिसे इसके बाद
'जियमावली' के रुप में कहा गया है) को ध्याि में रखते हुए, आरती इंडस्ट्रीि जलजमटेड (जिसे इसके बाद

के अथवा वहां से जियााजतत पैरा िाइरोटोलुईि (पीएिटी) (जिसे इसके बाद 'जवचाराधीि उत्पाद' या 'संबद्ध
वस्ट्तु' के रुप में कहा गया है) के आयातों के संबंध में पाटिरोधी िांच िुरू करिे के जलए जिर्दाष्ट प्राजधकारी
(जिसे इसके बाद 'प्राजधकारी' के रुप में कहा गया है) के समक्ष एक आवेदि दायर दकया था।
2. प्राजधकारी िे आवेदक द्वारा प्रस्ट्तुत दकए गए प्रथम दृष्टया साक्ष्य के आधार पर, भारत के रािपत्र -
असाधारण में प्रकाजित की गई ददिांक 16 िूि 2025 की अजधसूचिा फा. सं. 6/24/2025- डीिीटीआर के
माध्यम से एक सावािजिक सूचिा िारी की, जिसमें जियमावली के जियम 5 के साथ परित अजधजियम की
धारा 9क के अिुसार संबद्ध िांच िुरू की गई, तादक संबद्ध देिों के मूल के अथवा वहां से जियााजतत
जवचाराधीि उत्पाद के संबंध में दकसी कजथत पाटि की मौिूदगी, मात्रा और प्रभाव का जिधाारण दकया िा
सके और पाटिरोधी िुल्क की ऐसी राजि की जसफाररि की िा सके, जिसे यदद लगाया िाता है तो वह
घरेलू उद्योग को हुई क्षजत को दूर करिे के जलए पयााि होगी।
ख. प्रदिया
3. प्राजधकारी िे जियमावली के जियम 5(5) के अिुसार िांच िुरू करिे से पूवा वतामाि पाटिरोधी आवेदि की
प्राजि के संबंध में भारत में यूरोपीय संघ के प्रजतजिजधमंडल को सूजचत दकया।

प्राजधकारी िे संबद्ध वस्ट्तुओं के आयातों के संबंध में पाटिरोधी िांच िुरु करते हुए ददिांक 16 िूि 2025
की अजधसूचिा फा. सं. 6/24/2025- डीिीटीआर के माध्यम से एक सावािजिक सूचिा िारी की, जिसे
भारत के रािपत्र - असाधारण में प्रकाजित दकया गया ।

प्राजधकारी िे िांच िुरु करिे के उपरांत भारत में यूरोपीय संघ के प्रजतजिजधमंडल, संबद्ध देि में ज्ञात
उत्पादकों/ जियाातकों, भारत में ज्ञात आयातकों/ उपयोगकतााओं, आवेदक कंपिी के साथ-साथ भारत में
संबद्ध वस्ट्तुओं के घरेलू उत्पादकों को, आवेदक द्वारा उपलब्ध कराए गए पते के अिुसार िांच िुरुआत
अजधसूचिा की एक प्रजत भेिी तथा उिसे अिुरोध दकया दक वे जियमावली के जियम 6(2) के अिुसार
जिधााररत समय सीमा के भीतर अपिे जवचारों से जलजखत रूप में अवगत कराएं।

प्राजधकारी िे जियमावली के जियम 6(3) के अिुसार ज्ञात उत्पादकों/ जियाातकों तथा भारत में संबद्ध देिों के
दूतावासों को आवेदि के अगोपिीय पाि की एक प्रजत उपलब्ध कराई।
7.
भारत में यूरोपीय संघ के प्रजतजिजधमंडल से अिुरोध दकया गया था दक वे अपिे देि के जियाातकों/ उत्पादकों
को जिधााररत समय सीमा के भीतर प्रश्नावली का उत्तर देिे का परामिा दें। उत्पादकों/ जियाातकों को भेिे गए
पत्र और प्रश्नावली की एक प्रजत के साथ ही उन्हें संबद्ध देिों के ज्ञात उत्पादकों/ जियाातकों के िाम और पते
भी भेिे गए
8.
िांच िुरुआत अजधसूचिा और सूचिा के प्रत्युत्तर में, संबद्ध देिों के जियाातकों/ उत्पादकों और आयातकों/
उपयोगकतााओं िे जियाातक प्रश्नावली उत्तर और जवजधक प्रस्ट्तुजतकरण को भरकर प्राजधकारी को उत्तर ददया।

सभी जहतबद्ध पक्षकारों की एक सूची डीिीटीआर की वेबसाइट पर अपलोड की गई और साथ ही उि सभी
से अिुरोध दकया गया दक वे अपिे प्रस्ट्तुजतकरणों का अगोपिीय पाि अन्य सभी जहतबद्ध पक्षकारों को ईमेल
करें।
ग. आवेदक कंपिी से प्राि अिुरोध
10. आवेदक िे ददिांक 26 िवंबर 2025 को भेिे गए एक ईमेल के माध्यम से अपिा आवेदि वापस ले जलया है
और िांच को समाि करिे का अिुरोध करते हुए कहा है दक:

"घरेलू उद्योग की ओर से, जियमावली के जियम 14 के तहत हम िांच की अवजध के उपरांत महत्वपूणा बािार
बदलावों को देखते हुए एतद्द्वारा वतामाि आवेदि को वापस लेते हैं।
हम आपसे अिुरोध करते हैं दक कृपया वतामाि िांच को समाि करें।"
घ. प्राजधकारी द्वारा िांच
11. आवेदक द्वारा दकए गए उक्त अिुरोध की िांच की गई है। प्राजधकारी यह िोट करते हैं दक जियमावली के
जियम 14(क) में यह प्रावधाि है दक जिर्दाष्ट प्राजधकारी द्वारा एक सावािजिक सूचिा िारी दकए िािे के
उपरांत िांच को तत्काल समाि कर ददया िाएगा, यदद "उसे प्रभाजवत घरेलू उद्योग से अथवा उसकी ओर
से, जिसके कहिे पर िांच िुरू की गई थी, ऐसा करिे के जलए जलजखत में कोई अिुरोध प्राि होता है।"
12. आवेदक द्वारा आवेदि को वापस जलए िािे और िांच को समाि दकए िािे के जलए दकए गए अिुरोध को
देखते हुए, प्राजधकारी कई जहतबद्ध पक्षकारों द्वारा उिाए गए जवजभन्न मुद्दों पर जवचार करिा उजचत िहीं
समझते और एतद्द्वारा इस िांच को समाि करते हैं।
ड. जिष्कषा
13. आवेदक कंपिी अथाात आरती इंडस्ट्रीि जलजमटेड द्वारा उपरोक्तािुसार आवेदक को वापस जलए िािे और
पाटिरोधी जियमावली, 1995 के जियम 14 (क) को देखते हुए, प्राजधकारी एतद्द्वारा यूरोपीय संघ के मूल के
अथवा वहां से जियााजतत "पैरा िाइरोटोलुईि (पीएिटी)" के आयातों के संबंध में ददिांक 16 िूि 2025 की
अजधसूचिा फा. सं. 6/24/2025- डीिीटीआर के तहत िुरू की गई पाटिरोधी िांच को एतद्द्वारा समाि
करते हैं।

TERMINATION NOTIFICATION

Subject: Termination of anti-dumping investigation concerning imports of Para Nitrotoluene (PNT) originating
in or exported from the European Union.
F. No. 6/24/2025-DGTR.—A. INTRODUCTION
1.
Having regard to the Customs Tariff Act, 1975 as amended from time to time (hereinafter referred as
the ‘Act’) and the Customs Tariff (Identification, Assessment, and Collection of Anti-Dumping Duty on
Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time
(hereinafter referred to as the ‘Rules’), Aarti Industries Limited (hereinafter referred to as the
‘applicant’) had filed an application before the Designated Authority (hereinafter referred to as the
‘Authority’), for initiation of an anti-dumping investigation concerning imports of Para Nitrotoluene
(PNT) (hereinafter referred to as the ‘product under consideration’ or ‘subject goods’), originating in or
exported from the European Union (hereinafter referred to as the ‘subject country’) .

The Authority, based on prima facie evidence submitted by the applicant, issued a public notice vide
Notification F. No. 6/24/2025-DGTR dated 16th June 2025, published in the Gazette of India -
Extraordinary, initiating the subject investigation in accordance with Section 9A of the Act read with
Rule 5 of the Rules, to determine the existence, degree and effect of any alleged dumping in respect of
the product under consideration originating in or exported from the subject countries and to recommend
the amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the
domestic industry.

B.
PROCEDURE.

The Authority notified the Delegation of the European Union to India about the receipt of the present
anti-dumping application before proceeding to initiate the investigation in accordance with Rule 5(5) of
the Rules.

The Authority issued a public notice vide Notification F. No. 6/24/2025-DGTR dated 16th June 2025,
published in the Gazette of India - Extraordinary, initiating the anti - dumping investigation concerning
imports of the subject goods.

Post-initiation, a copy of the initiation notification was sent to the Delegation of the European Union to
India, known producers/ exporters in the subject country, the known importers/users in India, the
applicant company as well as the other domestic producers of the subject goods in India as per the
address made available by the applicant and requested them to make their views known in writing
within the prescribed time limit as per Rule 6(2) of the Rules.

The Authority provided a copy of the non- confidential version of the application to the known
producers / exporters and to the embassy of the subject country in India in accordance with Rule 6(3) of
the Rules.

The Delegation of the European Union to India were requested to advise the exporters / producers from
their country to respond to the questionnaire within the prescribed time limit. A copy of the letter and
questionnaire sent to the producers/ exporters was also sent to them along with the names and addresses
of the known producers / exporters from the subject countries.

In response to the initiation notification and intimation, exporters / producers from the subject country
and importers responded to the Authority by filling the exporter and importer questionnaire responses
and legal submissions.

A list of all the interested parties was uploaded on the DGTR's website along with the request there into
all of them to email the non-confidential version of their submissions to all other interested parties.
C.
REQUEST RECEIVED FROM THE APPLICANT COMPANY.

The applicant, through an email dated 26th November 2025, has withdrawn its application and has
requested for termination of the investigation citing that:
“On behalf of the domestic industry, under Rule 14, we hereby withdraw the application in view of
significant market developments in the post investigation period.
We request you to kindly terminate the present investigation”
D.
EXAMINATION BY THE AUTHORITY.

The said request made by the applicant has been examined. The Authority notes that Rule 14(a) of the
Rules provides that the Designated Authority shall, by issue of a public notice, terminate an investigation
immediately if “it receives a request in writing for doing so from or on behalf of the domestic industry
affected, at whose instance the investigation was initiated.”

In view of the withdrawal of the application and the request for termination of the investigation, the
Authority does not consider it appropriate to deal with the various issues raised by several interested
parties and hereby terminates this investigation.
E.
CONCLUSION

In view of the aforesaid withdrawal of the application made by the applicant company, i.e., Aarti
Industries Limited and Rule 14(a) of the Anti-dumping Rules, 1995 the Authority hereby terminates the
anti-dumping investigation initiated vide Notification F. No. 6/24/2025-DGTR dated 16th June 2025
concerning the imports of “Para Nitrotoluene (PNT)” originating in or exported from the
European Union.
