का.आ. 114(अ).— यतः, केन्द्रीय सरकार ने, भारतीय राष्ट्रीय रािमागग प्राजधकरण अजधजनयम, 1988 (1988 का

68) की धारा 11 के अधीन िारी की गई भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संख्या

का.आ. 4143 (अ), दिनांक 19 नवंबर, 2019 तथा का.आ. 1507 (अ), दिनांक 12 मई, 2020 द्वारा केरल राज्य में

क्रमिः राष्ट्रीय रािमागग संख्या 17 (नया एनएच-66) के दकलोमीटर 230.400 से दकलोमीटर 258.800 (वेंगलम िंक्िन

से रामनट्टुकारा िंक्िन खंड) तक के खंड और राष्ट्रीय रािमागग संख्या 17 (नया एनएच-66) के दकलोमीटर 258.800 से

दकलोमीटर 438.827 तक कनागटक/केरल सीमा- कासरगोड-कन्नूर-पोन्नानी- एडापल्ली खंड के िेष आंजिक खंड को

भारतीय राष्ट्रीय रािमागग प्राजधकरण (जिसे इसके पश्चात् ‘प्राजधकरण’ कहा िाए) को सुपुिग दकया है;

अतः, अब, राष्ट्रीय रािमागग िुल्क (िर अवधारण एवं संग्रहण) जनयम, 2008 के जनयम 3 (जिसे इसके पश्चात

“जनयम’’ कहा िाए), के साथ परित राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 द्वारा प्रित्त िजियों

का प्रयोग करते हुए, केंरीय सरकार एतिद्वारा, केरल राज्य में राष्ट्रीय रािमागग संख्या 66 के के जडिाइन दकलोमीटर

230.400 से जडिाइन दकलोमीटर 335.850 (जवद्यमान दकमी 230.400 से जवद्यमान दकमी 349.260) तक (वेंगलाम

िंक्िन से कजपपररक्कड़ सेक्िन) चार या अजधक लेन खंड के उपयोग के जलए नीचे िी गई ताजलका 1 के स्ट्तंभ (1) में

जवजनर्िगष्ट वाहनों के प्रकार पर 90.078 दकमी की जनवल सड़क खंड लंबाई (सारणी-2) तथा 96.59 दकमी (9.659

दकलोमीटर की लंबाई वाली, सारणी-4) की समतुल्य संरचना लंबाई (60 मीटर से अजधक लंबाई वाली) के जलए यांजत्रक

वाहनों पर सारणी 1 के स्ट्तम्भ (2) में जवजनर्िगष्ट िरों पर और 10 करोड़ रु. या उससे अजधक की लागत वाले 5.695 दकमी

संबंजधत श्रेणी के वाहनों के जलए जवजनर्िगष् ट अनुज्ञेय भार से अजधक भार लिे यांजत्रक वाहन का चालक

या स्ट् वामी या प्रभारी व्यजि, राष्ट्रीय रािमागग पर अजतभार लिे वाहन के प्रवेि के जलए टोल संग्रहण एिेंसी को

ऐसी श्रेणी के वाहनों के प्रवेि के जलए, कजथत जनयमों के जनयम 10 के उप जनयम 1ए के अनुसार अनुप्रयोज् य

िुल् क के समतुल् य िुल् क का भुगतान करने के जलए उत् तरिायी होगा और वह रािमागग खंड का प्रयोग करने के

जलए तब तक हकिार नहीं होगा िब तक ऐसे यांजत्रक वाहन से लिा अजतभार हटाया नहीं िाता।

सभी पररभाषाएं, यांजत्रक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्वगस रोड,

वैकजल्पक सड़क इत् यादि उि जनयमों में जवजनर्िगष्ट पररभाषाओं के अनुरूप होंगी।

उि जनयमों के जनयम 12 के अनुसार, उपयोगकतागओं की िानकारी के जलए िुल्क की िरों को प्रिर्िगत

दकया िाएगा।

उपयुगक् त ताजलका-1 में यथा-उजल्लजखत, आधार वषग 2007-08 के जलए प्रजत दकलोमीटर िुल्क की

आधार िर के आधार पर यांजत्रक वाहनों से िुल् क की वास्ट् तजवक राजि और छूटों की गणना प्राजधकरण द्वारा खंड

की पूरी हो गई लंबाई के आधार पर की िाएगी और उसे उक् त जनयमों के जनयम 5 के अनुसार प्रजत वषग संिोजधत

दकया िाएगा तथा तिनुसार उसे अंग्रेिी और क्षेत्रीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाजित

दकया िाएगा।

इस पररयोिना की अनुमाजनत पूंिीगत लागत 15,011.95 करोड़ रुपए है। चूंदक भूजम

अजधग्रहण, उपयोजगता स्ट्थानांतरण, पेड़ों को काटने, इत्यादि कामों को अभी पूरा दकया िाना है, इसजलए,

पूंिीगत लागत पररवतगन के अध्यधीन है। प्राप त प्रयोक् ता िुल् क के माध् यम से वसूल की गई पूंिीगत लागत का

प्राजधकरण द्वारा ररकॉडग रखा िाएगा।

S.O. 114(E).—Whereas by notification of the government of India in the Ministry of Road Transport and

Highways numbers S.O. 4143(E) dated the 19 ^thNovember, 2019 and S.O.1507(E), dated the 12^thMay, 2020,

issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central

Government has entrusted the stretch from Kilometer 230.400 to Kilometer 258.800 (Vengalam junction to

Ramanattukara junction section) of National Highway No.17 (New NH-66) and the remaining partial stretches of

Karnataka/Kerala border- Kasaragod- Kannur- Ponnani- Edappalli section from Km. 258.800 to Km. 438.827 of

National Highway No.17 (New NH-66) in the state of Kerala respectively to the National Highways Authority

of India (hereinafter referred to as the “Authority”);

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of

1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008

(hereinafter referred to as the "rules"), the Central Government hereby levies the fee at the rate specified in column

(2) of the Table 1 for net road section length of 90.078 Km [Table -2] and for equivalent structure length (having

length more than 60m) of 96.59 Km (having length of 9.659 Km [Table 4]) and at one and half times the base

rate for bypasses having length of 5.695 km [Table 3] costing rupees ten crore or more on the type of vehicles

specified in column (1) of the Table 1 below for use of four or more lane of (Venglam Junction to Kappirikkad

section) from design kilometer 230.400 to design kilometer 335.850 (existing km 230.400 to existing km 349.260) of

National Highway 66 in the State of Kerala and authorises the Authority to collect, either through its officials or

through a contractor, the said fee, namely:-

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial

purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.340.00 (Rupees Three

Hundred and Forty only) for the year 2025-26 and is subject to revision every year as per the provisions of

the said rules.

For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district

where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service

road or alternative road is available for use of such commercial vehicles.

The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of

permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the

National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules,

and shall not be entitled to make use of the highway section unless the excess load has been removed from such

mechanical vehicle.

All definitions including category of mechanical vehicles, its permissible load, category of exempted

vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the

actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the

Authority on the basis of the completed length of the section and revised annually in accordance with the rule

5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

The estimated capital cost of the project is Rs. 15,011.95 Crores. The capital cost is subject to variation as

the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall

maintain a record of the recovery of capital cost through user fee realised.
