एफ. सं. बीसीसी:डीपी:118:09.— बैंककारी कंपनी (उपक्रमों का अिजन और अंतरण) अजधजनयम, 1970 (1970

का 5) की धारा 19 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, बैंक ऑफ़ बड़ौदा का जनदेिक मंडल, केंद्र सरकार की पूवज

मंिूरी और भारतीय ररिवज बैंक के परामिज से, बैंक ऑफ़ बड़ौदा अजधकारी कमजचारी (अनुिासन और अपील) जवजनयम,

1976 में संिोधन करने के जलए एतद्द्वारा जनम्नजलजखत जवजनयम बनाता है, यथा:—

1. (1) ये जवजनयम बैंक ऑफ़ बड़ौदा अजधकारी कमजचारी (अनुिासन और अपील) संिोधन जवजनयम, 2026कहलाएंगे।

(2) ये जवजनयम आजधकाररक रािपत्र में प्रकािन की तारीख से प्रभावी माने िाएंगे।

2. बैंक ऑफ़ बड़ौदा अजधकारी कमजचारी (अनुिासन और अपील) जवजनयम, 1976 ( जिसे इसके पश्चात् उि जवजनयम कहा

िाएगा) के, जवजनयम 6 में,—

(ए) उप-जवजनयम (3) के स्ट्थान पर, जनम्नजलजखत उप-धारा प्रजतस्ट्थाजपत की िाएगी, अथाजत्:—

“(3) िहां िांच प्रस्ट्ताजवतहो, वहां अनुिासनात्मक प्राजधकारी द्वारा अजधकारी कमजचारी के जखलाफ आरोपों के आधार पर

जनजश्चत और स्ट्पष्ट आरोप तय दकए िाएंगे और आरोपों के जववरण के साथ आरोपों के कथन, जिन दस्ट्तावेिों को आधार

बनाया गया है उनकी सूची के साथ ऐसे दस्ट्तावेिों की एक प्रजत और गवाहों की सूची, यदद कोई हो, जिन पर वे आधाररत

हैं के बारे में, अजधकारी कमजचारी को जलजखत रूप से सूजचतदकया िाएगा, अजधकारी कमजचारी द्वारा अनुिासनात्मक

प्राजधकारी द्वारा जनर्दजष्ट समय के भीतर,15 ददनों से अजधक नहीं या उि प्राजधकारी द्वारा ददए िाने वाले जवस्ट्ताररत समय

के भीतर अपने बचाव का एक जलजखत बयान प्रस्ट्तुत करना होगा:

बिते बचाव का जलजखत बयान दाजखल करने के जलए समय का जवस्ट्तार दकसी भी पररजस्ट्थजत में आरोप-पत्र की

प्राजि की तारीख से पैंतालीस ददन से अजधक नहीं होना चाजहए:

बिते दक िहां दस्ट्तावेिों की प्रजतयां प्रस्ट्तुत करना संभव न हो, वहां अनुिासनात्मक प्राजधकारी

अजधकारीकमजचारी को इस संबंध में जनर्दजष्ट समय के भीतर ऐसे दस्ट्तावेिों की िांच करने की अनुमजत देगा।";

(बी) उप-जवजनयम (12) के स्ट्थान पर, जनम्नजलजखत उप-जवजनयम प्रजतस्ट्थाजपत की िाएगी, अथाजत्:—

“(12) उप-जवजनयम (11) के तहत मांग प्राि होने पर, प्रत्येक प्राजधकारी जिनके पास भ़ौजतक या जडजिटल रूप से मांगे गए

दस्ट्तावेिों की अजभरक्षा या कब्िा है, उन्हें ऐसी मांग प्राि होने के एक माह की अवजध के भीतर उसे िांच प्राजधकारी के

समक्ष प्रस्ट्तुत करना होगा या अनुपलब्धता प्रमाण पत्र िारी करना होगा।

बिते दक यदद मांगे गए दस्ट्तावेिों की अजभरक्षा या कब्िा रखने वाला प्राजधकारी, उसके द्वारा जलजखत रूप में

दिज दकए िाने वाले कारणों से संतुष्ट हो िाता है दक ऐसे सभी या दकसी भी दस्ट्तावेि को प्रस्ट्तुत करना लोकजहत या

राष्ट्रजहत के जवरुद्ध है, तो वह तदनुसार िांच प्राजधकारी को सूजचत करेगा और िांच प्राजधकारी ऐसा सूजचत दकए िाने पर,

अजधकारी कमजचारी को सूचना संप्रेजषत करेगा और ऐसे दस्ट्तावेिों को प्रस्ट्तुत करने या खोि के जलए उसके द्वारा की गई

मांग अनुरोध को वापस ले लेगा।“;

(सी) उप-जवजनयम (21), में खंड (ii) के पश्चात, जनम्नजलजखत उप-खंड को िोडा िाएगा, अथाजत्:—

“(iii). (ए) िांच प्राजधकारी को िांच पूरी करनी होगी और िांच प्राजधकारी के रूप में अपनी जनयुजि के आदेि की प्राजि की

तारीख से छह महीने की अवजध के भीतर अपनी ररपोटज प्रस्ट्तुत करनी होगी।

(बी) िहां खंड (ए) में जनर्दजष्ट समय सीमा का पालन करना संभव नहीं है, वहां िांच प्राजधकारी कारणों को ररकॉडज कर

सकता है और अनुिासनात्मक प्राजधकारी से जलजखत में समय जवस्ट्तार की मांग कर सकता है, िो इस प्रकार की िांच पूरी

करने के जलए अजतररि समयदे सकताहै िोदक एक बार में छह महीने से अजधक नहीं होगा।

(सी) अनुिासनात्मक प्राजधकारी या अनुिासनात्मक प्राजधकारी द्वारा प्राजधकृत दकसी अन्य प्राजधकारी द्वारा जलजखत रूप में

अजभजलजखत दकए िाने वाले दकसी भी उपयुि और पयाजि कारण पर जवस्ट्तार की अनुमजत दी िा सकेगी िो एक बार में

छह महीने से अजधक की अवजध के जलए नहीं होगी “।

उि जवजनयम में,अनुसूची के स्ट्थान पर जनम्नजलजखत अनुसूची प्रजतस्ट्थाजपत की िाएगी, अथाजत्:—

BANK OF BARODA

NOTIFICATION

New Delhi, the 9th January, 2026

F. No.BCC:HRM:118:09. —In exercise of the powers conferred by section 19 of the Banking

Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the

Bank of Baroda, after consultation with the Reserve Bank of India and with the previous sanction of the

Central Government, hereby makes the following regulationsfurther to amend the Bank of Baroda Officer

Employees’ (Discipline and Appeal) Regulations, 1976, namely:–

(1)These regulations may be called the Bank of Baroda Officer Employees’ (Disciplineand Appeal)

Amendment Regulations, 2026.

(2) They shall be come into force on the date of their publication in Official Gazette.

In the Bank of Baroda Officer Employees’ (Discipline and Appeal) Regulations, 1976(hereinafter

referred to as the said regulations), in regulation 6,—

(a) for sub-regulation (3), the following sub-regulation shall be substituted, namely:—

“(3) Where it is proposed to hold an inquiry, the Disciplinary Authority shall frame definite

and distinct charges on the basis of the allegations against the Officer Employee and the

articles of charge, together with a statement of the allegations, list of documents relied on

along with a copy of such documents and list of witnesses, if any, on which they are based,

shall be communicated in writing to the Officer employee, who shall be required to submit,

within such time as may be specified by the Disciplinary Authority not exceeding fifteen days,

or within, such extended time as may be granted by the said Authority, a written statement of

his defence:

Provided that under no circumstances, the extension of time for filing written statement of

defence shall exceed forty-five days from the date of receipt of articles of charge:

Provided further that wherever it is not possible to furnish the copies of documents, the

disciplinary authority shall allow the Officer Employee to inspect such documents within a

time specified in this behalf.”;

(b) for sub-regulation (12), the following sub-regulation shall be substituted, namely:—

“(12) On receipt of the requisition under Sub regulation (11), every authority having the

custody or possession of the requisitioned documents physically or digitally shall produce the

same or issue a non-availability certificate before the Inquiring Authority within a period of

one month of the receipt of such requisition:

Provided that if the authority having the custody or possession of the requisitioned documents

is satisfied for reasons to be recorded by it in writing that the production of all or any of such

documents would be against the public interest or security of the State, it shall inform the

Inquiring Authority accordingly and the Inquiring Authority shall on being so informed,

communicate the information to the Officer Employee and withdraw the requisition made by it

for the production or discovery of such documents.”;

“(iii)(a) the Inquiring Authority shall conclude the inquiry and submit its report within a period of

six months from the date of receipt of order of his appointment as Inquiry Authority;

(b) where it is not possible to adhere to the time-limit specified in clause (a), the Inquiring

Authority may recordthe reasons and seek extension of time from the Disciplinary

Authority in writing, who may allow an additional time not exceeding six months at a

time for completion of such Inquiry.

In the said regulations, for the Schedule, the following Schedule shall be substituted, namely:—
