आ.अ. 38(अ).— यतः जिर्ााचि आयोग के अपिे प्रेस िोट सं. ईसीआई/पीएि/114/2026 दििांक 7^th जसतम्बर,

2026 द्वारा घोजित तजिलिाडू के 35-ििुरांटकि (अ.िा.) और 101-धारापुरि (अ.िा.) जर्धािसभा जिर्ााचि क्षेत्रों, पुडुचेरी

की 09-थट्टािचार्ाडी जर्धािसभा जिर्ााचि क्षेत्र, पजिि बंगाल के 70-रेिीिगर और 210-िन्िीग्राि जर्धािसभा जिर्ााचि

क्षेत्रों और असि की 09-िगांर् लोकसभा जिर्ााचि क्षेत्र के र्तािाि उपचुिार्ों के जलए कायाक्रि की घोिणा कर िी गई है;

और

2. यतः, लोक प्रजतजिजधत्र् अजधजियि 1951 (संक्षेप िें लो.प्र.अजधजियि, 1951) की धारा 126क िें यह जर्जिर्िाष्ट

दकया गया है दक "(1) कोई भी व्यजि कोई जिगाि ित सर्ेक्षण िहीं करेगा और दकसी जिगाि ित सर्ेक्षण के पररणाि का,

ऐसी अर्जध के िौराि िो जिर्ााचि आयोग द्वारा इस संबंध िें अजधसूजचत की िाए, प्प्रंट या इलेक्ट्रॉजिक िीजडया के िाध्यि

से प्रकािि या प्रचार या दकसी भी प्रकार की अन्य रीजत िें प्रसार िहीं करेगा।

(2) जिर्ााचि आयोग, उपधारा (1) के प्रयोिि के जलए, जिम्नजलजखत को ध्याि िें रखते हुए साधारण आिेि द्वारा

तारीख और सिय अजधसूजचत करेगा, अथाात :-

(क) साधारण जिर्ााचि की ििा िें, र्ह अर्जध ितिाि के पहले दिि के संबंध िें ितिाि के जलए जियत सिय

के आरंभ होिे से िुरू होगी और सभी राज्यों और संघ राज्य-क्षेत्रों िें ितिाि सिाप्त होिे के आधे घंटे तक

िारी रहेगी;

(ख) दकसी उप-जिर्ााचि या एक साथ कराए िािे र्ाले अिेक उप-जिर्ााचिों की ििा िें र्ह अर्जध ितिाि के

पहले दिि से ही ितिाि के जलए जियत सिय के आरंभ होिे से िुरू होगी और ितिाि सिाप्त होिे के

पिात् आधे घंटे तक िारी रहेगी;

परंतु जभन्न-जभन्न दििों पर एक साथ कराए िािे र्ाले अिेक उप-जिर्ााचिों की ििा िें, र्ह अर्जध

ितिाि के पहले दिि के संबंध िें ितिाि के जलए जियत सिय के आरंभ होिे से िुरू होगी और अंजति

ितिाि सिाप्त होिे के पिात आधे घंटे तक िारी रहेगी।

कोई व्यजि, िो इस धारा के उपबंधों का उल्लंघि करेगा ऐसी अर्जध के कारार्ास से, िो िो र्िा तक की

हो सकेगी या िुिाािे से या िोिों से, िंडिीय होगा।"

3. अब, इसजलए, लोक प्रजतजिजधत्र् अजधजियि, 1951 की धारा 126क की उपधारा (1) के अधीि िजियों का प्रयोग

करते हुए जिर्ााचि आयोग उि धारा की उप-धारा (2) के उपबंधों के िृजष्टगत, 06-10-2026(िंगलर्ार), को पूर्ााहि 7.00

बिे से अपराह्ि 6.30 बिे के बीच की अर्जध को, ऐसी अर्जध के रूप िें अजधसूजचत करता है जिसके िौराि ऊपर

उजल्लजखत उप-जिर्ााचिों के संिभा िें दकसी भी प्रकार के एजजिट पोल का आयोिि करिे तथा प्प्रंट या इलेक्ट्रॉजिक

िीजडया द्वारा इसके पररणाि के प्रकािि या प्रचार अथर्ा दकसी भी अन्य तरीके से उसका प्रचार-प्रसार करिे पर प्रजतबंध

होगा।

4. यह भी स्ट्पष्ट दकया िाता है दक लोक प्रजतजिजधत्र् अजधजियि, 1951 की धारा 126(1)(ख) के अधीि उपयुाि उप

चुिार्ो के संबंध िें ितिाि की सिाजप्त के जलए जियत सिय पर सिाप्त होिे र्ाली 48 घंटों की अर्जध के िौराि दकसी भी

इलेक्ट्राजिक िीजडया िें दकसी भी ओजपजियि पोल या दकसी अन्य ितिाि सर्ेक्षण के पररणािों सजहत दकसी भी प्रकार के

जिर्ााचि संबंधी िािले के प्रििाि पर प्रजतबंध होगा ।

O.N. 38(E).— Whereas, the schedule for the current bye-elections to the 35-Madurantakam (SC) and

101-Dharapuram (SC) Assembly Constituencies in Tamil Nadu, 09-Thattanchavady Assembly Constituency in

Puducherry, 70-Rejinagar and 210-Nandigram Assembly Constituencies in West Bengal and 09-Nagaon

Parliamentary

No. ECI/PN/114/2026 dated 07.09.2026; and

2. Whereas, Section 126A of the Representation of the People Act, 1951(in short R.P. Act, 1951) specifies that “(1)

No person shall conduct any exit poll and publish or publicise by means of the print or electronic media or disseminate

in any other manner, whatsoever, the result of any exit poll during such period, as may be notified by the Election

Commission in this regard.

(2) For the purposes of sub-section (1), the Election Commission shall, by a general order, notify the date and

time having due regard to the following, namely: —

(a) in case of a general election, the period may commence from the beginning of the hours fixed for poll

on the first day of poll and continue till half an hour after closing of the poll in all the States and

Union territories;

(b) In case of a bye-election or a number of bye-elections held together, the period may commence from

the beginning of the hours fixed for poll on and from the first day of poll and continue till half an hour

after closing of the poll;

Provided that in case of a number of bye-elections held together on different days, the period

may commence from the beginning of the hours fixed for poll on the first day of poll and continue till

half an hour after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be punishable with imprisonment for a term

which may extend to two years or with fine or with both.”

3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the

Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period

between 7.00 A.M. to 6.30 P.M. on 06.10.2026 (Tuesday), as the period during which conducting and publishing or

publicizing exit poll by means of the print or electronic media or dissemination in any other manner whatsoever, the

result of any exit poll in connection with the aforesaid bye elections, shall be prohibited.

4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including

results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of

48 hours ending with the hours fixed for the conclusion of the poll in connection with the aforesaid bye elections.
