का.आ. 5253(अ).— केन्द्रीय सरकार ने पेट्रोलियम और खलनज पाइपिाइन (भूलम में उपयोग के अलिकार का
अजजन) अलिलनयम 1962 (1962 का 50) (लजसे इसके पश्चात् उक्त अलिलनयम कहा गया हैं) की िारा 3 उप िारा (1) के
अिीन जारी की गई, भारत सरकार के पेट्रोलियम और प्राकृलतक गैस मंत्रािय की अलिसूचना लजसका प्रकाशन भारत
के राजपत्र संख्या 938 लिनांक 29.02.2024 का.आ. 983(अ) लिनांक 29.02.2024 भाग (II) खण्ड (3), उपखण्ड (II) में
लकया गया है, इस अलिसूचना से संिगन अनुसूची में लिलनलिजष्ट उत्तर प्रिेश राज्य की तहसीि कुण्ड़ा लजिा प्रतापगढ़ की
भूलम में उत्तर प्रिेश राज्य में कांडिा (गुजरात) से गोरखपुर (यूपी) तक एिपीजी पररिहन के लिए आई0एच0बी0
लिलमट्ेड द्वारा लियान्वित लकए जा रहें ‘‘कांडिा (गुजरात) से गोरखपुर (यूपी) पररयोजना’’ के सम्बन्ध में पाइपिाइन
लबछाने के प्रयोजन के लिए उपयोग के अलिकार का अजजन करने के लिए अपने आशय की घोषणा की थी।
और उक्त राजपत्र अलिसूचनाओं की प्रलतयां जनता को लिनांक 02.09.2025 तक उपिब्ध करा िी गई थी।
और उक्त अलिलनयम की िारा 6 की उपिारा (1) के अनुसरण में श्री अबुि किाम, सक्षम प्रालिकारी,
आई0एच0बी0 लिलमट्ेड, कांडिा-गोरखपुर एि.पी.जी. पाइपिाइन, िखनऊ (यू.पी.) ने केन्द्रीय सरकार को अपनी
ररपोट्ज िे िी है।

और केन्द्रीय सरकार ने उक्त ररपोट्ज पर लिचार करने के पश्चात् और यह समािान हो जाने पर लक उक्त भूलम
पाइपिाइन लबछाने के लिए अपेलक्षत हैं, उसमें उपयोग के अलिकार का अजजन करने का लिलनश्चय लकया है।
अतः अब, केन्द्रीय सरकार उक्त अलिलनयम की िारा 6 की उपिारा (1) द्वारा प्रित्त शन्वक्तयों का प्रयोग करते
हुए एति् द्वारा घोषणा करती है लक इस अलिसूचना से संिग्न अनुसूची में लिलनलिजष्ट भूलम में पाइपिाइन लबछाने के उपयोग
का अलिकार अलजजत लकया जाए।
और केन्द्रीय सरकार उक्त अलिलनयम की िारा 6 की उपिारा (4) द्वारा प्रित्त शन्वक्तयों का प्रयोग करते हुए,
यह लनिेश िेती है लक उक्त भूलम में उपयोग का अलिकार इस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में
लनलहत होने के बजाय सभी लिल्लंगमों से मुक्त होकर आई0एच0बी0 लिलमट्ेड मे लनलहत होगा।
पेट्रोलियम और खलनज पाइपिाइन अलिलनयम, 1962 की िारा 10 के अिीन लकसी भी क्षलतपूलतज के लिए
आई0एच0बी0 लिलमट्ेड पूणजतया उत्तरिायी होगी और पाइपिाइन से सम्बन्वन्धत लकसी भी मामिे पर केन्द्रीय सरकार
के लिरूद्ध कोई िाि, िािा, या कानूनी कायजिाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 23rd September, 2026
S.O. 5253(E).— Whereas by the notification of The Government of India in the Ministry of Petroleum and
Natural Gas, Published in the Gazette No. 938 Dated 29.02.2024, S.O. No. 983(E) Dated 29.02.2024 Part-II, Section-3,
Sub-Section (ii) issued under Sub-Section (1) of Section 3 of the Petroleum and minerals pipeline(Acquisition of Right
of User in Land) Act, 1962 (50 of 1962), (Hereinafter referred to as the said Act), the central Government declared its
intention to acquire the right of user in the land situated in Tehsil Kunda District Pratapgarh, in Uttar Pradesh State,
Specified in the schedule appended to that notification for the purpose of laying pipeline for the transportation of LPG
from Kandla to Gorakhpur by the IHB Ltd for implementing the Kandla to Gorakhpur LPG Pipeline Project.
And whereas the copies of the said Gazette notification were made available to the public up to
02 September 2025.
And whereas Shri Abul Kalam, Competent Authority, IHB Limited, Kandla Gorakhpur LPG Pipeline Project,
Lucknow (UP) has under sub-section (1) of section 6 of the said Act, has submitted his report to Central Government.
And whereas, the Central Government after Considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of the user therein;
Now, therefore, in exercise of the powers conferred by Sub-section (1) of section 6 of the said Act, the Central
Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is
hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user of the said land for laying the pipeline shall, instead of vesting in the
Central Government, vests on the date of publication of this declaration, in IHB Ltd, free from all encumbrances.
IHB Ltd shall be exclusively liable for any compensation in terms of section 10 of the P&MP Act, 1962 and no suit,
claim or legal proceeding would lie against the Central Government on any matter relating to pipeline.
