(2016 का 49) की धारा 100 की उप-धारा (1) और (2) द्वारा यथा अपेजित, प्रकाजित दकया गया था, इसे एतद्वारा उि

धारा की उप-धारा (1) द्वारा यथा अपेजित, उन सभी व्जियों की िानकारी के जलए प्रकाजित दकया िाता है जिनके इससे

प्रभाजित होने की संभािना है;और एतिद्वारा यह सूचना िी िाती है दक उि प्रारूप जनयमों पर उस तारीख से, जिस

तारीख को रािपत्र की प्रजतयां जिनमें यह अजधसूचना प्रकाजित की गई है, िनता को उपलब्ध करा िी िाती हैं, तीस दिनों

उि जिजनर्दिष्ट अिजध के समाि होने से पहले दकसी भी व्जि से उि प्रारूप जनयमों के संबंध में प्राि होने िाली आपजियों

और सुझािों पर केंद्रीय सरकार द्वारा जिचार दकया िाएगा।

और चूंदक, सािविजनक सुजिधाओं और सेिाओं के जलए सुगम्यता मानकों और दििाजनिेिों को बाि में उि जनयमों के जनयम

15 में िाजमल दकया गया था;

और चूंदक, भारत के माननीय सिोच्च न्यायालय ने 2005 की ररट याजचका (जसजिल) संख्या 243 और 2006 की 228

[रािीि रतूडी बनाम भारत संघ ि अन्य] में दिनांक 8 निंबर, 2024 के अपने जनणवय द्वारा, अन्य बातों के साथ-साथ, केंद्र

सरकार को उि जनयमों के जनयम 15 (F) के तहत जनधावररत जिस्ट्तृत दििाजनिेिों से गैर-परक्राम्यजनयमों को अलग करके

अजधजनयम की धारा 40 की अपेिानुसार उन्हें स्ट्पष्ट रूप से पररभाजित करने का जनिेि दिया था, तथा िेत्रिार मानकों में

एकरूपता और स्ट्पष्टता की आि‍यकता पर बल दिया था;

अतः, अब, अजधजनयम की धारा 40 के साथ परित धारा 100 की उप-धारा (1) और (2) द्वारा प्रिि िजियों का प्रयोग

करते हुए, केंद्र सरकार एतद्द्वारा दिव्ांगिन अजधकार जनयम, 2017 में आगे संिोधन करने के जलए जनम्नजलजखत जनयम

बनाती है, अथावत्:

प्रारूप जनयम

संजिि नाम और प्रारंभ—

इन जनयमों को दिव्ांगिन अजधकार (संिोधन) जनयम कहा िाएगा।

ये आजधकाररक रािपत्र में इनके प्रकािन की जतजथ से प्रिृि होंगे।

जनयम के खंड (घ) का संिोधन—

दिव्ांगिन अजधकार जनयम में, जनयम के उप-जनयम ( के खंड (घ) को जनम्नजलजखत रूप में प्रजतस्ट्थाजपत और

संिोजधत दकया िाएगा:—

(घ). सहायक उत्पाि और प्रौद्योजगकी

)

मानक और सुगम्यता

(

अध्याय I – प्रारंजभक

संजिि नाम और प्रारंभ—

इन जनयमों का नाम सहायक उत्पाि और प्रौद्योजगकी (मानक और सुगम्यता) जनयम, है।

ये रािपत्र में इनके प्रकािन की तारीख को प्रिृि होंगे।

पररभािाएूँ—

इन जनयमों में, िब तक दक संिभव से अन्यथा अपेजित न हो,

(क “सहायक उत्पाि” से िह िास्ट्तजिक िस्ट्तु या उपकरण अजभप्रेत है जिसका उपयोग दिव्ांगिन अपनी िैजनक

गजतजिजधयों को अजधक स्ट्ितंत्रता से करने के जलए करते हैं, चाहे िह व्हीलचेयर, श्रिण यंत्र, सफेि छडी, स्ट्क्रीन रीडर, ब्रेल

जडस्ट््ले या संचार ऐप हो।

ऐसे उत्पािों को आगे इस प्रकार िगीकृत दकया िा सकता है:

i “आि‍यक सहायक उत्पाि” से ऐसे सहायक उत्पाि अजभप्रेत हैं जिनकी आि‍यकता दिव्ांगिनों को अपनी

दिनचयाव और िैजनक गजतजिजधयों को पूरा करने के जलए होती है, िैसे दक श्रिण यंत्र, गजतिीलता सहायक उपकरण,

स्ट्क्रीन रीडर, च‍मे और व्हीलचेयर;

ii “जिजिष्ट सहायक उत्पाि” से दिव्ांगिनों के जिजिष्ट समूहों के जलए अपेजित अजधक उन्नत सहायक उत्पाि

अजभप्रेत हैं, िैसे दक संिधवक और िैकजल्पक संचार उपकरण, कोजक्लयर इम््लांट, और कृजत्रम अंग;

iii “उभरते सहायक उत्पाि” से निीन और उन्नत प्रौद्योजगदकयाूँ अजभप्रेत हैं िो स्ट्ितंत्रता और भागीिारी को बढा

सकती हैं, िैसे दक एआई-सिम संचार उपकरण, रोबोरटक्स, और ब्रेन-कं्यूटर इंटरफेस प्रणाजलयाूँ;

(ख “सहायक प्रौद्योजगकी” िह सब कुछ है िो सहायक उत्पाि का उपयोग करने िाले व्जि के जलए उसके अच्छी तरह से

काम करने में सहायता करती है। इसमें यह आकलन करना िाजमल है दक दकस उत्पाि की आि‍यकता है, उसे दफट करना

या अनुकूजलत करना, व्जि को उसका उपयोग करने का प्रजििण िेना, मरम्मत करना और जनरंतर सहायता प्रिान करना

तथा इस प्रकार यह सुजनजश्चत करना दक सहायक उत्पाि का प्रभािी ढंग से और स्ट्ितंत्र रूप से उपयोग दकया िा सके;

(ग) गजतिीलता सहायक पासपोटव एक पोटेबल सूचना मागवि्िका है िो व्हीलचेयर या अन्य संचाजलत गजतिीलता

उपकरण के सटीक आयामों, ििन, बैटरी के प्रकार और उसे अलग करने के जनिेिों का जििरण िेती है;

(घ “सेिा प्रिाता” से सहायक प्रौद्योजगकी के आकलन, जप्रजस्ट्क्र्िन, दफटटग, प्रजििण, रखरखाि या मरम्मत में लगे दकसी

भी व्जि या इकाई अजभप्रेत है। स्ट्पष्टीकरण: इन जनयमों के प्रयोिनों के जलए, ििाबिेहता सुजनजश्चत करने हेतु जिजनयामक

प्रयोिनों के जलए यह पररभािा अपनाई गई है।

(ङ “उपयोगकताव” से दिव्ांगिन अजधकार अजधजनयम का के अधीन दिव्ांगिन अजभप्रेत है।

स्ट्पष्टीकरण: ‘उपयोगकताव’ के अंतगवत दिव्ांगिन अजधकार अजधजनयम के अधीन दिव्ांगिन िाजमल हैं, और इसका

जिस्ट्तार अस्ट्थायी कायावत्मक सीमाओं (िैसे दक फ्रैक्चर या िल्य-जचदकत्सा पश्चात की जस्ट्थजतयों) िाले व्जियों तक हो

सकता है।

अध्याय - II – सहायक उत्पािों का िगीकरण

सहायक उत्पािों की श्रेजणयाूँ.—

सहायक उत्पािों को जनम्नजलजखत तीन श्रेजणयों में िगीकृत दकया िाएगा, —

(i) आि‍यक सहायक उत्पाि;

(ii) जिजिष्ट सहायक उत्पाि; और उपयोगकताव-जिजिष्ट कायावत्मक आि‍यकताओं को पूरा करने के जलए उत्पािों की सभी

श्रेजणयों में सहायक प्रौद्योजगकी उपलब्ध होगी। प्रत्येक सूची के अंतगवत अजधसूजचत उत्पािों की सूची की समय-समय पर

समीिा की िाएगी और ऐसे सहायक उत्पािों के जनमावण में हुई प्रगजत के आधार पर दकया िाएगा। उिाहरणस्ट्िरूप, एक

उभरते सहायक उत्पाि के रूप में सूचीबद्ध उत्पाि को एक बार इसके जिजनिेिों को मानकीकृत कर दिए िाने और जनमावण

को सुव्िजस्ट्थत कर दिए िाने के बाि आि‍यक या जिजिष्ट सहायक उत्पाि के रूप में सूचीबद्ध दकया िा सकता है।

(iii) उभरते सहायक उत्पाि।

अध्याय III – मानक और प्रमाणन

सहायक उत्पािों के मानक.—

भारतीय मानक ब्यूरो या ऐसी अन्य प्राजधकारी जिसके पास अपेजित जििेिज्ञता है जिसे या तो ब्यूरो या केंद्रीय

सरकार द्वारा नाजमत दकया िाता है, आि‍यक और जिजिष्ट सहायक उत्पािों के जलए मानक जिजहत करेगा।

यदि यह जिजनिेि चरणबद्ध तरीके से दकया िाता है, तो ब्यूरो या अन्य नाजमत प्राजधकारी उन चरणों को

अजधसूजचत करेगा जिनमें मानक जनधावरण दकया िा रहा है और इस कारविाई के तरीके को अपनाने के तकनीकी कारण

बताएगा।

अपनी मानक जनधावरण अनुसूची तैयार करने में, ब्यूरो या अन्य नाजमत प्राजधकारी ऐसे सहायक उत्पािों या

उपकरणों पर जििेि ध्यान िेगा िो मानकीकरण के अभाि में िुघवटनाओं या आपिाओं का कारण बने हैं।

केिल ब्यूरो या अन्य नाजमत प्राजधकारी द्वारा जिजनर्दिष्ट मानकों के अनुसार जन्मत सहायक उत्पािों पर ही मानक

जचह्न (स्ट्टैंडडव माकव) होगा।

दकसी उत्पाि को मानक जचह्न के साथ िनता के उपयोग के जलए तभी उपलब्ध कराया िा सकता है िब िह

भारतीय मानक ब्यूरो या अन्य नाजमत प्राजधकारी द्वारा जिकजसत जिजनिेिों के अनुसार बनाया गया हो।

भारतीय मानक ब्यूरो या अन्य नाजमत प्राजधकारी उस प्रदक्रया को जिजहत करेगा जिसके द्वारा सहायक उत्पािों या

उपकरणों का जनमावता अपने उत्पाि पर बीआईएस जचह्न का उपयोग करने की अनुमजत प्राि कर सकता है।

जसक्योरमेंट (सुरिात् मक) ब्रैकेट और गजतिीलता सहायक पासपोटव की अजनिायव आि‍यकता

इस बात के पूिावग्रह के जबना दक बीआईएस या अन्य नाजमत प्राजधकारी सहायक उत्पािों के जलए क्या जिजनिेि

जिकजसत कर सकते हैं, सभी मानक मैनुअल व्हीलचेयर और मोटराइज्ड व्हीलचेयर / पजहएिार गजतिीलता उपकरणों में

रांजिट-रेडी, टाई-डाउन जसक्योरमेंट ब्रैकेट लगाए िाएंगे।

संचाजलत (पािडव) व्हीलचेयर या अन्य गजतिीलता उपकरण के सभी जनमावताओं का यह जिजधक कतव्

होगा दक िे ऐसे

सहायक उत्पाि के साथ गजतिीलता सहायक पासपोटव प्रिान करें।

अध्याय IV – खरीि (अजधप्राजि) और जितरण

खरीि—

सहायक उत्पािों की सरकारी खरीि— जिसमें उपकरण, सॉफ्टिेयर और एकीकृत प्रणाजलयाूँ िाजमल हैं — एक

पारििी टेंडर प्रदक्रया के माध्यम से की िाएगी।

िबदक आि‍यक सहायक उत्पािों की खरीिस्ट्ि-प्रमाजणत इकाइयों से की िा सकती है,

जिजिष्ट सहायक उत्पािों की सोर्ससग केिल प्रमाजणत जनमावताओं से की िाएगी, जिसका अथव ऐसे जनमावता होंगे

जिन्हें भारतीय मानक ब्यूरो या अन्य नाजमत प्राजधकारी द्वारा लाइसेंस दिया गया हो।

सहायक उत्पािों के जलए ऑनलाइन पोटवल

सिम प्राजधकारी आिेिनों, प्रमाणन, खरीि, जितरण रैककग और जिकायत जनगरानी के जलए एक ऑनलाइन

सहायक उत्पाि पोटवल स्ट्थाजपत करेगा।

उपभोिा मामले मंत्रालय के 'राइट टू ररपेयर' (मरम्मत का अजधकार) पोटवल के साथ समन्िय में, यह पोटवल

मरम्मत के अजधकार का जिस्ट्तार सहायक उत्पािों तक करेगा।

अध्याय V – जििीय सहायता और िहनीयता

जििीय सहायता —

केंद्रीय सरकार और राज्य सरकारें पात्र उपयोगकतावओं को सहायक उत्पािों की अजधप्राजि (खरीि) के जलए

जििीय सहायता प्रिान करने हेतु स्ट्कीमें तैयार करेंगी। इन स्ट्कीमों में सजब्सडी, प्रजतपू्त (रीइंबसवमेंट) और बीमा

किरेि के प्रािधान भी िाजमल होंगे।

सभी बीमा पॉजलजसयाूँ और सरकारी योिनाएं न केिल सहायक उत्पािों की प्रारंजभक लागत को किर करेंगी,

बजल्क िहाूँ उपयोगकतावओं ने सीधे लागत िहन की है।िहां प्रजतस्ट्थापन (रर्लेसमेंट), मरम्मत और प्रजतपू्त को भी

किर करेंगी।

जिकायत जनिारण, बीमा किरेि और प्रजतस्ट्थापन के प्रािधान सहायक उत्पािों की आि‍यक श्रेजणयों पर लागू

होंगे।

मरम्मत और प्रजतस्ट्थापन का अजधकार

उपभोिा मामले मंत्रालय की ‘मरम्मत का अजधकार’ योिना का जिस्ट्तार आि‍यक और जिजिष्ट सहायक उत्पािों

तक दकया िाएगा।

आपिाओं या आपात जस्ट्थजतयों की जस्ट्थजत में, राष्ट्रीय और राज्य आपिा प्रबंधन प्राजधकरण, राहत और पुनिावस

उपायों के एक भाग के रूप में प्रभाजित उपयोगकतावओं को आि‍यक सहायक प्रौद्योजगकी की तत्काल प्रजतस्ट्थापन या

प्रािधान सुजनजश्चत करेंगे।

अध्याय VI – निाचार, िागरूकता और प्रितवन

राष्ट्रीय टोल-फ्री हेल्पलाइन —

उपयोगकताव की प्रजतदक्रया और जिकायतों के जलए एक राष्ट्रीय टोल-फ्री हेल्पलाइन स्ट्थाजपत की िाएगी, जिसकी

अजनिायव समाधान समय-सीमा तीस दिन होगी।

सभी उपयोगकतावओं के जलए सुगम्यता सुजनजश्चत करने के जलए टोल-फ्री हेल्पलाइन, जिकायत जनिारण प्रणाजलयाूँ और

िन िागरूकता अजभयान बहु-मॉडल (मल्टीमॉडल) होंगे, जिसमें िॉयस, टेक्स्ट्ट-आधाररत ्लेटफॉमव और भारतीय

सांकेजतक भािा की व्ाख्या िाजमल होगी।

राष्ट्रीय सहायक उत्पाि िुघवटना डेटाबेस

यदि कोई सहायक उपकरण खराब हो िाता है और चोट या िुघवटना का कारण बनता है, तो घटना की िाूँच की

िाएगी और िाूँच के जनष्किों को जिजधित ििव दकया िाएगा।

सिम प्राजधकारी, सहायक प्रौद्योजगकी िुघवटना डेटाबेस स्ट्थाजपत करने और उसका रखरखाि करने के जलए,

बीआईएस या दकसी अन्य अजधसूजचत जनकाय को नाजमत करेगा।

यह डेटाबेस जनयम में उजल्लजखत सहायक उत्पािों के जलए मानक जनधावरण के चरणों का मागवििवन करने

और गैर-मानक सहायक उत्पािों के उपयोग को प्रजतबंजधत करने पर साक्ष्य-आधाररत जनणवय लेने के जलए मागवििवक

होगा।

NOTIFICATION

New Delhi, the 8th September, 2026

S.O. (E).— Whereas the Rights of Persons with Disabilities Rules, 2017 were published, as required by

sub-sections (1) and (2) of section 100 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016) is hereby

published as required by sub-section (1) of the said section, for the information of all persons likely to be affected

thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a

period of thirty days from the date on which the copies of the Official Gazette in which this notification is published

are made available to the public;

Objections and suggestions, if any, may be addressed to Shri Ram Charan Meena Under Secretary to the

Government of India, Department of Empowerment of Persons with Disabilities (Divyangjan), Room No 11 A, 5th

Floor, PanditDeenDayal Antyodaya Bhawan, CGO Complex, Lodhi Road, New Delhi, 110003 or by email at

The objections and suggestions, which may be received from any person with respect to the said draft rules

before the expiry of the period specified above, will be considered by the Central Government.

And whereas accessibility standards and guidelines for public facilities and services, were subsequently

incorporated in rule 15 of the said Rules;

And whereas the Hon’ble Supreme Court of India, by judgment dated the 8th November, 0 in Writ

Petition (Civil) Nos. 243 of 2005 and 228 of 2006 [RajiveRaturi v. Union of India & Ors], inter alia, directed the

Union Government to delineate non-negotiable rules as required by section 40 of the Act by segregating such non-

negotiable rules from the expansive guidelines prescribed under rule 15(f) of the said Rules, and observed the need for

uniformity and clarity across sectoral standards;

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (2) of section 100 of the Act read

with section 40 thereof, the Central Government hereby makes the following rules further to amend the Rights of

Persons with Disabilities Rules, 2017, namely:

Draft Rules

1. Short title and commencement.—

(1) These rules may be called the Rights of Persons with Disabilities (Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Insertion of clause (d) in rule 15 (1).—

In the Rights of Persons with Disabilities Rules, 2017, clause (d) in sub-rule (1) of rule 15 shall be inserted and

amended as follows:—

(d). Assistive Products and Technology (Standards and Accessibility)

Chapter I – Preliminary

1.Short Title and Commencement.—

(1) These rules may be called the Assistive Products and Technology (Standards and Accessibility) Rules, 0

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—

In these rules, unless the context otherwise requires,

(a)

“Assistive product” is the actual thing or device that a person with disability uses be it a wheelchair, hearing

aid, white cane, screen reader, Braille display or a communication app. to carry out everyday activities more

independently.

Such products may be further classified as:

i “Essential Assistive products” means such assistive products that persons with disabilities need to carry

out their routine and everyday activities such as hearing aids, mobility aids, screen readersspectacles, and

wheelchairs;

ii “Specialised Assistive products” means more advanced assistive products required for specific groups of

persons with disabilities, such as augmentative and alternative communication devices, cochlear implants,

and prosthetics;

iii “Emerging Assistive products” means innovative and advanced technologies that may enhance

independence and participation, such as AI-enabled communication devices, robotics, and brain-computer

interface systems;

b “Assistive technology” is everything that helps the assistive product work well for the person using it It includes

assessing what product is needed, fitting or customising it, training the person to use it, carrying out repairs and

providing ongoing support and thereby ensuring that the assistive product can be used effectively and independently

dissembling instructions of the wheelchair or other powered mobility device.

d “Service provider” means any person or entity engaged in the assessment, prescription, fitting, training,

maintenance, or repair of assistive technology. Explanation: For the purposes of these Rules, this definition is adopted

for regulatory purposes, ensuring accountability.

e “User” means a person with disability under the Rights of Persons with Disabilities Act, 016 (49 of 2016).

Explanation: ‘User’ includes persons with disabilities under the RPwD Act, 0 , and may extend to those with

temporary functional limitations (such as fractures or post-surgical conditions).

Chapter II – Classification of Assistive Products

3. Categories of Assistive Products.—

Assistive products shall be classified into the following three categories,—

(i) EssentialAssistive products;

(ii) Specialised Assistive products; and Assistive technology shall be available across all categories of

products to meet user-specific functional requirements. The list of products notified under each list shall be

periodically reviewed and depending upon the progress made in the manufacture of such assistive products.

Illustratively a product listed as an emerging assistive product could be listed as an essential or specialised

assistive product once its specifications have been standardised and manufacture streamlined.

(iii) Emerging Assistive products.

Chapter III – Standards and Certification

4. Standards of Assistive Products. —

The Bureau of Indian Standards or such other authority possessing the requisite expertise which either

the Bureau or the central government designatesshall prescribe standards for essential and specialised

assistive products

If this specification is undertaken in a phased manner, the Bureau or other designated authority shall

notify the phases in which the standard setting is being undertaken and the technical reasons for adopting

the course of action

In creating its standard setting schedule, the Bureau or Other designated Authority shall accord special

attention to assistive products or devices which have resulted in accidents or mishaps due to absence of

standardisation

Only Assistive products made in accordance with the standards specified by the Bureau or other

designated Authority shall carry the standard mark.

A product can be made available for public use with the standard mark only if it has been made in

accordance with the specifications developed by the Bureau of Indian Standards or other designated

authority

The Bureau of Indian Standards or other designated authority shall prescribe the process by which a

manufacturer of assistive products or devices can obtain permission to use the BIS mark on their

product.

5. Mandatory Requirement of Securement Brackets and Mobility Aid Passport

Without prejudice to the specifications that BIS or other designated authority may develop for

assistive products all standard manual wheelchairs and motorised wheelchairs / wheeled mobility devices

will be fitted with transit -ready, tie down securement brackets.

(2) All manufacturers of powered wheelchairs or other mobility device shall be under a legal duty to provide

a mobility aid passport along with such assistive product.

Chapter IV – Procurement and Distribution

6. Procurement-

The Government procurement of assistive products — including devices, software, and integrated systems —

shall be through a transparent tendering process.

Whilst essential assistive products could be procured from self-certified entities

Specialised assistive products shall be only sourced from certified manufacturers from certified

manufacturers, which shall mean manufacturers either licensed by the Bureau of Indian Standards, or other

designated authority.

7. Online Portal for Assistive Products

The Competent Authority shall establish an online Assistive Products Portal for applications,

certification, procurement, distribution tracking, and grievance monitoring.

In coordination with the Right to Repair portal of the Ministry of Consumer Affairs this portal shall

extend the right to repair to assistive products.

Chapter V – Financial Support and Affordability

8. Financial Support.—

(1) The Central Government and State Governments shall frame schemes for providing financial support for

procurement of assistive products to eligible users.The schemes shall also include provision for subsidies,

reimbursements, and insurance coverage.

All insurance policies and government schemes shall cover not only the initial cost of assistive

products but also replacement, repair, and reimbursement where users have borne costs directly.

The provisions of grievance redressal, insurance coverage, and replacement shall apply to essential

categories of assistive products.

9. Right to Repair and Replacement

The Right to Repair Scheme of the Ministry of Consumer Affairs shall be extended to essential and

specialised assistive products

In the event of disasters or emergencies, the national and state disaster management authorities, shall ensure

immediate replacement or provision of essential assistive technology to affected users as part of relief and

rehabilitation measures.

Chapter VI – Innovation, Awareness, and Enforcement

10. National Toll-Free Helpline.—

A national toll-free helpline shall be established for user feedback and complaints, with a mandatory

resolution timeline of thirty days.

The toll-free helpline, grievance redressal systems, and public awareness campaigns shall be multimodal,

including voice, text-based platforms, and Indian Sign Language interpretation, to ensure accessibility for all

users.

National Assistive Products Accident Database

If any assistive device becomes dysfunctional and causes injury or accident, the incident shall be investigated

and the findings of the investigation duly recorded.

The Competent Authority shall designate BIS or any other notified body, to establish and maintain an

Assistive Technology Accidents Database.

This Database shall guide the phases of standard setting for assistive products mentioned in Rule 4(2) and to

make an evidence-based decision on prohibiting the use of non-standard assistive products.
