का.आ. 5366(अ).— केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अिजन और जिकास) अजधजनयम, 1957 (1957 का
20) (जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया है) की धारा 4 की उपधारा (1) के अधीन िारी भारत सरकार के
कोयला मंत्रालय की अजधसूचना संखयांक का. आ. 308 (अ), तारीख 20 िनिरी 2026, िो भारत के रािपत्र, असाधारण,
भाग 2, खंड 3, उप-खंड (ii), तारीख 20 िनिरी, 2026 द्वारा प्रकाजित की गई थी, उस अजधसूचना से उपाबद्ध अनुसूची में
जिजनर्िजष्ट पररक्षेत्र की भूजम में जिसका माप 7.017 हेक्टर (लगभग) या 17.339 एकड़ (लगभग) है, कोयले का पूिेक्षण करने
के अपने आिय की सूचना िी थी;
और केन्द्रीय सरकार का यह समाधान हो गया है दक इस अजधसूचना में संलग्न अनुसूची में जिजहत की गई उक्त भूजम
के भाग में कोयला अजभप्राप्य हैI
अत, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए,
इससे संलग्न अनुसूची में िर्णजत 6.195 हेक्टर (लगभग) या 15.308 एकड़ (लगभग) माप िाली भूजम में या उस के भू-सतह
अजधकार का अिजन करने के अपने आिय की सूचना िेती हैंI

रटप्पण 2: उक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध्यान आकृष्ट दकया िाता है, जिसमे जनम्नजलजखत उपबंध है: -
“8 अिजन की बाित् आपजत्तयां. - (1) कोई व्यजक्त िो दकसी भूजम में जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की
गई है, जहतबद्ध है, अजधसूचना के जनकाले िाने से तीस दिन के भीतर सम्पूणज भूजम या उसके दकसी भाग या ऐसी भूजम में या
उस पर के दकन्द्हीं अजधकारों का अिजन दकए िाने के बारे में आपजत्त कर सकेगा।
स्ट्पष्टीकरण: - इस धारा के अथाजन्द्तगजत यह आपजत्त नहीं मानी िाएगी दक कोई व्यजक्त दकसी भूजम में कोयला उत्पािन के जलए
स्ट्ियं खनन संदियाएं करना चाहता है और ऐसी संदियाएं केन्द्रीय सरकार या दकसी अन्द्य व्यजक्त को नहीं करनी चाजहए।
(2) उपधारा (1) के अधीन प्रत्येक आपजत्त सक्षम अजधकारी को जलजखत रूप में की िाएगी और सक्षम अजधकारी, आपजत्तकताज
को स्ट्ियं सुने िाने का या जिजध व्यिसायी द्वारा सुनिाई का अिसर िेगा और ऐसी सभी आपजत्तयों को सुनने के पश्चात् और
ऐसी अजतररक्त िााँच, यदि कोई हो, करने के पश्चात, िो िह आियक समझे, िह या तो धारा 7 की उपधारा (1) के अधीन
अजधसूजचत भूजम का या ऐसी भूजम में या उस पर के अजधकारों के संबंध में एक ररपोटज या ऐसी भूजम के जिजभन्न टुकड़े या ऐसी
भूजम में या उस पर के अजधकारों के संबंध में आपजत्तयों पर अपनी जसफाररिों और उसके द्वारा की गई कायजिाहीयों के अजभलेख
सजहत जिजभन्न ररपोटज केन्द्रीय सरकार को उसके जिजनश्चय के जलए िेगा |
(3) इस धारा के प्रयोिनों के जलए िह व्यजक्त दकसी भूजम में जहतबद्ध समझा िाएगा िो प्रजतकर में जहत का िािा करने का
हकिार होगा, यदि भूजम या दकसी ऐसी भूजम में या उस पर के अजधकार इस अजधजनयम के अधीन अर्िजत कर जलए िाते है"।

MINISTRY OF COAL
NOTIFICATION
New Delhi, the 30th September, 2026
S.O. 5366(E).— Whereas, by the notification of the Government of India in the Ministry of Coal
number S.O. 308 (E), dated the 20th January, 2026, issued under sub-section (1) of section 4 of the Coal
Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said
Act), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 20th
January, 2026, the Central Government gave notice of its intention to prospect for coal in 7.017 hectares
(approximately) or 17.339 acres (approximately) of the lands in the locality specified in the Schedule
annexed to the said notification;
And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands
prescribed in the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act,
the Central Government hereby gives notice of its intention to acquire the land measuring 6.195 hectares
(approximately) or 15.308 acres (approximately) and all rights in or over the said land described in the
Schedule appended hereto;
Note 1. - The plan bearing number SECL/BSP/GM(L&R)/LAND/27, dated the 8th April, 2026, of the area
covered by this notification may be inspected in the office of the Collector, Anuppur and Shahdol Districts
or in the office of the Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Scope Minar, 5th
floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the South Eastern Coalfields Limited (Land
and Revenue Department), Seepat Road, Bilaspur-495006 (Chhatisgarh)
Note 2. - Attention is hereby invited to the provisions of section 8 of the said Act which provides as
follows: -
“8. Objection to Acquisition. - (1) Any person interested in any land in respect of which a notification under
section 7 has been issued, may, within thirty days of the issue of the notification, object to the acquisition of
the whole or of any part of the land or any rights in or over such land.
Explanation. - It shall not be an objection within the meaning of this section for any person to say that he
himself desires to undertake mining operations in the land for the production of coal and that such operations
should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and
the competent authority shall give the objector an opportunity of being heard either in person or
by a legal practitioner and shall, after hearing all such objections and after making such further
inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been
notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports
in respect of different parcels of such land or of rights in or over such land, to the Central
Government, containing his recommendations on the objections, together with the record of the
proceedings held by him, for the decision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land who would be
entitled to claim an interest in compensation if the land or any rights in or over such land were
acquired under this Act.”.
Note 3. - The Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Scope Minar, 5th Floor,
Core II, Laxmi Nagar, Delhi 110092, has been appointed by the Central Government as the competent
authority under section 3 of the said Act, vide notification number S.O. 905, dated the 20th March, 1987,
published in Part II, Section 3, Sub-section (ii) of the Gazette of India, dated the 4th April, 1987.
