का.आ. 5423(अ).— .केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाईन (भूजम में उपयोग के अजधकार का अिजन)

अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात् उक्त अजधजनयम कहा गया हैं) की धारा 3 की उप-धारा (1) के अधीन

िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का.आ. 3344(अ), तारीख 18 िुलाई

2025, िो भारत के असाधारण रािपत्र, क्रमांक 3271 तारीख 21 िुलाई 2025, में प्रकाजित की गई थी, इस अजधसूचना से

संलग्न अनुसूची में जवजनर्िजष्ट भूजम में गुिरात राज्य में "कांडला गोरखपुर एल.पी.िी. पाइपलाइन पररयोिना अनुभाग: िहेि से

िुमाड टर्मजनल” तालुका करिण, जिला वडोिरा में एल.पी.िी. के पररवहन हेतु आई.एच.बी. जलजमटेड द्वारा पाईपलाइन जबछाने

के प्रयोिन के जलए उपयोग के अजधकार के अिजन करने के जलए अपने आिय की घोषणा की थी;

और उक्त रािपत्र अजधसूचना की प्रजतयां संबजन्द्धत भू-स्ट्वाजमयों को तारीख 08 जसतम्बर, 2025 तक उपलब्ध करा

िी गई थी ;

और श्री अवलाभाई खातराभाई बारीआ, सक्षम प्राजधकारी और सेवाजनवृत नायब कलेक्टर, कांडला गोरखपुर एल.पी.िी.

पाइपलाइन पररयोिना, आई.एच.बी. जलजमटेड, वडोिरा (गुिरात) ने उक्त अजधजनयम की धारा 6 की उप-धारा (1) के अधीन

केन्द्रीय सरकार को ररपाजट िे िी है ;

और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात् और यह समाधान हो िाने पर दक उक्त भूजम

पाइपलाईन जबछाने के जलए अपेजक्षत है, उसमें उपयोग के अजधकार का अिजन करने का जवजनश्चय दकया है ;

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए

यह घोषणा करती है दक इस अजधसूचना से संलग्न अनुसूची में जवजनर्िजष्ट भूजम में पाइपलाईन जबछाने के जलए उपयोग के

अजधकार का अिजन दकया िाए ;

और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उप-धारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए, यह

जनिेि िेती है दक उक्त भूजम में उपयोग का अजधकार इस अजधसूचना के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने

के बिाए, सभी जवल्लंगमों से मुक्त होकर आई.एच.बी. जलजमटेड में जनजहत होगी ।

पेरोजलयम और खजनि पाइपलाईन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए

आई.एच.बी. जलजमटेड पूणजतय: उतरिायी होगी और पाइपलाईन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जवरुद्ध

कोई वाि, िावा या कानूनी कायजवाही नहीं हो सकेगी।

NOTIFICATION

New Delhi, the 30th September, 2026

S.O. 5423(E).— Whereas by the notification of the Government of India in the Ministry of Petroleum

and Natural Gas, Vide S.O. No. 3344(E) dated 18 July 2025, published in the Extra Ordinary Gazette of India

No. 3271 dated 21 July 2025, issued under Sub-Section (1) of Section-3 of the Petroleum and Minerals Pipelines

(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the

Central Government declared its intention to acquire the Right of User in the land specified in the Schedule

appended to that notification for the purpose of laying “Kandla -Gorakhpur LPG Pipeline Project, Section :-

Dahej to Dumad Terminal” for the transportation of LPG in Tehsil Karjan, District Vadodara in the State of

Gujarat by IHB Limited;

And whereas, copies of the said Gazette notification were made available to the concerned land

owners up to 08^th September, 2025;

And whereas, Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy Collector (Retd.),

Kandla -Gorakhpur LPG Pipeline Project, IHB Limited, Vadodara (Gujarat) has under Sub-Section-(1) of

Section-6 of said Act, has submitted his report to the Central Government;

And whereas, the Central Government, after considering the said report and on being satisfied that

the said land is required for laying the pipeline, has decided to acquire Right of User therein;

Now, therefore, in exercise of the powers conferred by Sub-Section-(1) of Section-6 of the said Act,

the Central Government hereby declares that the Right of User in the land specified in the Schedule appended

to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by Sub-Section-(4) of Section-6 of the said Act, the

Central Government hereby directs that Right of User in the said land for laying the pipeline shall, instead of

vesting in the Central Government, vests on the date of publication of this declaration, in IHB Limited, free

from all encumbrances.

IHB Limited shall be exclusively liable for any compensation in terms of Section-10 of the P&MP

Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter

relating to the pipeline.
